3/5/20 Update: Hearing on Motion for Subpoena Duces Tecum; pending further investigation. Return of records on 4/6/20. Next pretrial hearing on 4/27/20. 4/6/20: Due to the coronavirus pretrial hearing on 4/27 has been rescheduled on 5/26. 5/26/20 Update: Pretrial hearing has been rescheduled to 6/29/20.

WARWICK, R.I. (WPRI) ─ While the lawyers representing a Warwick woman charged in the death of her adopted daughter appeared in court Wednesday, their client was nowhere to be found.

A pretrial conference Wednesday lasted less than two minutes, and Rothgeb was not in attendance.

Judge John McBurney set a return date for Sept. 23 and was direct in letting Rothgeb’s attorneys know he expects her to be present.

“I want Ms. Rothgeb here that day also,” McBurney told her attorneys. “Unless there is some overarching reason why she can’t be. You understand me?”

Zahnae’s death led to sweeping changes at the Department of Children, Youth and Families (DCYF).

A report released by DCYF’s oversight agency, the Office of the Child Advocate, found Rothgeb should never have been a licensed foster parent and concluded: “the actions or inactions of DCYF staff contributed to the death of this child.”

Michele Rothgeb, the former Warwick woman charged with manslaughter in the death of one of her eight adopted children with special needs, surrendered herself to authorities Thursday, days after a judge issued a warrant for her arrest as a possible bail violator.

Rothgeb walked into the Kent County Superior Court courtroom of Magistrate John F. McBurney III with her legal counsel. According to the attorney general’s office, she is being held without bail until at least a Sept. 23 contempt hearing.

Warwick woman charged in daughter's death to remain in prison for now

WARWICK -- Michele Rothgeb, the former Warwick woman charged with manslaughter in the death of one of her eight adopted children with special needs, will remain behind bars until at least Oct. 26, when a court magistrate said he will entertain arguments to resolve the almost two-year case.

Through her lawyers, Rothgeb, 57, on Wednesday waived her right to a bail violation hearing in Superior Court.

Magistrate John F. McBurney III said the bail violation issue could be taken up again at the Oct. 26 hearing or "some other procedure that may lead to her incarceration or release."

Besides the manslaughter charge, Rothgeb faces seven other felonies of child cruelty or neglect involving the seven other children who were in her care on Jan. 3, 2019, hearing or "some other procedure that may lead to her incarceration or release.".....
