Nope, you have the procedures right. The reasoning is still probable cause. Evidence in hand, which I assume you mean enough evidence to present to a court to determine guilt, is probable cause. Law enforcement cannot make an arrest unless they have probable cause, otherwise the arrest is unlawful. Now this does not mean they have to have all of the evidence that they are going to present to the judge or jury, just enough evidence that all of the elements of a particular crime have been met with the evidence they have in their possession.

For example, if a police officer witnesses A hit B on the head with a steel pipe, the police office has probable cause to arrest A. The police officer acyually onserving this battery is enough evidence to convict A. But, most likely, the pipe will be admitted into evidence, any blodd evidence on that pipe, B's testimony, etc. On the other hand, let's say that the police officer arrived on the scene after B was hit, the pipe is lying on the ground, A is long gone and B informs the police officer that A hit him on the head. Does the officer have probable cause? Not yet. A is a suspect worth investigating, but there is no evidence other than B's testimony. Now once the investigation proceeds, probable cause may arise (ie, A's DNA found on pipe, another witness saw A running from the scene, A has B's blood on his clothes). But to put it simply, in order for police to arrest and charge you with a crime, they need to have evidence tending to prove each and every element of the crime.

I just want to clear up something. If someone is the victim of a brutal attack, they name the alleged attacker, that is probable cause for a judge to issue an arrest warrant.

There isn't any new news, but please don't forget about Brittanee. Maybe someone new will join Web Sleuths and see Brittanee's thread at the top of the list. Maybe even someone new who sees this will have new information and/or input. Hey, you should comment and let us know if our "bumps for Britt" are working. Anyone new checking because they see Britt at the top of the list? Let us know if it's working.

What a sad week. Wednesday, June 23, is the Gates-Chili High School graduation. Brittanee should be graduating high school. I just watched my little sister graduate -- why isn't Brittanee doing the same? I am depressed.

Don't forget Brittanee. This beautiful girl needs you. Her family needs you. Chad's Facebook page is back up for those of you who had noticed it was down for a while. It's his second Father's Day without his daughter. This is uncalled for.

Hello WSers. I'm currently visiting my baby granddaughter and do not have a lot of time to research this but we saw something on a "Cold Case" program today and it got me to wondering if this could help LE in Brittanee's case. There is a "society" called "Vidocq" society. Apparently they are experts forensics, etc and "concerned citizens" and they meet once a month and a cold case is presented by some law enforcement team and they offer their expertise and suggestions to help to see if the original investigation may have missed something. Wondering if anyone here has heard of this and if it may be possible to suggest it somehow to the investigators in BD's case? I did not read enough to see what criteria a case would have to meet for acceptance. http://www.vidocq.org/

The CUE Center for Missing Persons says Brittanee Drexel will be honored at Gates Chili High School in Rochester, NY on June 23, the date she would have graduated with her class.

Brittanee is graduating with her class... I'm sure she will be there in spirit and I'm so glad they are honoring her. My son graduates at the same location 2 days later and I live down the street so maybe I'll go in to see DD and CD accept if they allow it.

Thanks RoseC. How lovely that Britt's HS is honoring her with and honorary diploma. I can't imagine the sadness her family must feel. I was glad to read in the article that Britt's case is still actively pursued by LE. Thank goodness for Monica Caison and the CUE center for their continued efforts in helping to find her!

We're not giving up on ya Britt! You will be found. Whoever did this to you sweetie is messed up in the head. Lot's of peeps are working to bring you home and to bring the perps to justice.

Not to be a downer here...but have to wonder if any of the MB "friends" will be attending that graduation...of course they would not be going for little Brittanee but perhaps they have someone graduating and they will have to be there as her family accepts her diploma. Hoping they are there and realize how horrible this whole ordeal really is....In fact what a shame they cannot be forced to be there. Okay..now I said it...sorry for this "outburst"...

Thanks I'll let you all know if I could get in no tickets are required at my son's but with all this press not sure how the Gates-Chili Grad will go tomorrow. If I get in (It's a huge place) I'll try to see if I can see any of the MB "friends" very doubtful they would go since they haven't gone to anything else.. but your right they might have been friends or have family members with other students in Brit's class.

This is a lil off topic but I just saw on Today where MB boardwalk has been named 2nd best boardwalk in the US. Coney Island BW was first and Hollywood Beach FL BW was named 3rd. (my personal favorite) Congrats to MB. Oh and The Gay Dolphin was even mentioned in the segment! KUDOS!

Hope parents with children keep an eye on their babies while on vaca down there what with the recent reports of attemped child abductions.

Honoring Brittanee on Graduation Day

Gates-Chili students arrived on the RIT campus Wednesday night, ready to celebrate their graduation day. Seniors wore their caps and gowns, and walked into the Gordon Field House with their families by their sides.

But the Class of 2010 was missing one member -- another student who was supposed to accept a diploma Wednesday night: Brittanee Drexel. She disappeared last April, during a spring break trip to Myrtle Beach.

"I've spent about a week preparing for this," said Drexel's father, Chad Drexel. "I was trying to figure out how I'd feel, but you can't. You really can't."

Chad and Dawn Drexel came to the ceremony to accept an honorary diploma bearing Brittanee's name.

"It's difficult because she's not here," Dawn Drexel said. "She's not crossing that stage, and I know a lot of her friends that are graduating are thinking about her."

As hard as it was, family members were glad to be part of the ceremony.

"It was a total shock and surprise to me and Dawn last week when they called us," Chad Drexel said. "It gave me shivers. I wasn't expecting it."

They also received a copies of the school yearbook. It's been a source of comfort for her parents during a difficult time.


"There are two pages for Brittanee," Dawn Drexel said. "It also has a lot of senior pictures. So that meant a lot to us. It means a lot to us to be here."

There is no active search for Brittanee, but Chad and Dawn Drexel say police and their own private investigator continue to follow leads in the case.

 
 
I can't imagine how hard this is going to be for the Drexel's. Mixed emotions I'm sure. The two pages dedicated to Brittanee make is seem so final...that part makes me sad.

You're loved by so many baby girl. We won't forget you.

As seniors at Gates-Chili High School arrived for the ceremony, there was one senior missing.

Hundreds donned the cap and gown Wednesday evening, graduating high school and entering a new chapter in their lives. But for one Chili family, they can't even turn the page.

Brittanee Drexel was supposed to graduate Wednesday night with her friends. Instead no one knows where she is or if she's even alive.

"We just wish she was here, and I know a lot of graduates wish she was here too," said Brittanee's mother Dawn Drexel.

The Gates Chili Central School District honored one of its students in a rare and special way. The district presented an honorary diploma for Brittanee Drexel to her family during graduation ceremonies Wednesday at Rochester Institute of Technology. Drexel, who has been missing since April 25, 2009, would have graduated this year. She disappeared during a spring break trip to Myrtle Beach, S.C. The last image of the teenager is security camera footage of her walking out of the Bar Harbor Motel wearing a multicolored shirt, black shorts and flip-flops.

Mytle Beach -- A New York teen who hasn't been seen since her disappearance last April will be honored at her high school graduation in Rochester, N.Y., according to a news release from the Community United Effort Center for Missing Persons.

Brittanee Drexel -- missing since April 25, 2009 -- would have been among those graduating today from Gates Chili High School.

Drexel's family will attend the graduation and accept the school's honor.
