I believe the allegation is that Maria was the typist on the other JA twitter account, not this new 'updates' one.

Perjury is still not OK, of course, because perjury is a crime, not a rule of evidence. I know you know that...just making sure no one misunderstands.
No, I wasn't talking about perjury, just the statement "being governed by the same laws as the guilt phase". That and sev'l questioning how "abuse" or her version of actions at the crime scene have anything to do with mitigation, are what I was thinking of. Relaxed rules of evidence, almost anything being relevant as long as it relates to " any aspect of the defendant's character, propensities or record and any of the circumstances of the offense" along with a lower standard of proof, IMO, all combine to give her a lot of leeway in what she can do in this phase. I know she bears the burden of proof, but that fact shouldn't mean that she gets to introduce almost anything that she thinks might stick to the wall either. Considering what a nightmare defense made of the earlier trial with it's restrictions in place, I'm beginning to think maybe it might be better for my health not to be able to see this one live.
 
Did JSS really rule that the PI must have access to the crime scene?

For what purpose? If he is proving abuse what could possibly be at that scene now that was not found then? And if he is trying to disprove the cruelty aspect, how is that pertinent to this penalty phase? That would be an appeal issue at this point, would it not? If an appeal issue, how is it being ruled on in the current venue?

Someone clue me in because it is looking like this judge is giving in to things that could be denied without any issues down the road. Unless there is more to all this than we know. (Can't imagine what, though.)

It is very confusing trying to figure out what is going on right now and why certain things are being allowed. I can't see how a PI going to the crime scene could possibly factor in as a mitigator.

We don't know if the court had Arias explain her reasons for requesting the PI go there. Right now, there is so much we don't know.

A lot of this is going to boil down to knowledge of the law and its application when it comes to the penalty phase, how strongly Martinez objects to things and cites case law and then how Judge Stephens rules.

IDK, maybe Juan is just letting Arias spin her wheels and waste time, knowing that he will object and has a huge log of case law to support his argument so that JSS has to rule in his favor???

Yes, her plotting and planning so well in advance is what did her in on a claim of self defense. That's what it was called at first--self defense, as in he attacked her and she had no choice but to defend herself, etc., blah blah blah...

But self defense is a joke given they lived a thousand miles apart, he was hardly a threat to her from that distance and she was the one who made the journey...in a rented vehicle with dyed hair and gas cans in the trunk no less.

So the claim had to morph into a syndrome...an ongoing abuse resulting in a mental hold he had on her that left her almost robotic in her actions, and she is hoping she has a witness willing to state that she was under such hold mentally by TA. (I do not think it will even be touted as physical abuse during retrial because that does not excuse overkill the way mental issues can.)

All of it a lie. Yet all of it believable by people who are never able to accept that the male did not force the female's hand somehow. This is precisely where women like this score their points in court and defense attorneys know this.

But...I still fail to see how any of this necessitates JSS ordering JA's PI be given access to the crime scene (if she did so order).

Does anyone think the mystery witness and the PI are one and the same?

The State pays for a capital defendant to have an investigator, but I suppose she could have hired her own as well with all her donations.

Yep, an investigators and more investigators and lawyers and paid witnesses and on and on and on and on...The State aka the taxpayers. grrrr (not at you, at the system)
 
Usually to find mitigation witnesses.

I guess they would need a PI with a trench coat and magnifying glass for that. Seeing the ones in plain sight--aka her parents, siblings and other relatives as well as the formally suited Daryl Brewer who showed up then refused but testified on television via local media--all have declined to stand up for Her Heinous (nod to Zuri).

Was wondering.

Since this penalty phase of the trial is separate from the first phase.
If something procedurally goes wrong with just this phase, then wouldnt the defendent be limited to just appeal of just this sentencing phase?

And if the answer is yes. Then I think the judge should play hard ball with her because JA is obviously going to appeal no matter what. There is no sense in letting JA make a mockery of the court or of the Alexanders or any of his friends.

Time to play hardball. The only thing that is potential to be lost is a DP getting overturned to a life sentence.
So, slam down that gavel a few times and let her have it. This is no time to let JA walk all over the system.

Speaking of old fun alien type movies. Does anyone remember the movie called "Splice". :) LMAO

It had an alien girl that grew up rapidly and her name was "Dren".

It was one of the most interesting and good low budget alien movies I have ever seen. :)

I think she grew from a baby to an adult in like a week. LMAO

ETA: I fell in love with the name "Dren" from that movie. If I ever had a girl child, I think I would name her "Dren". But dont worry. My wife would most likely never allow it. Then again, she kind of liked that name too, so you never know. LOL
