I have said this before, but I'll say it again...could it be that the jury is confused about the jury instructions? I'm sure they have read over this part again amongst themselves, but when JW was talking, remember she kept saying, "if you find one mitigating factor," and "if you individually find one mitigating factor." She made it sound like if you find one mitigating factor, then you have to spare her life. I mean, is this true? I don't see how that could be true. Then another part though, JSS read that the totality of the mitigation has to be greater than the totality of the aggravation.

So perhaps there is a juror or two who says, I think her age is a mitigating factor, and well JW told us that if we find one we have to give her life.

I think Juan was much less clear in this phase than with the others...it could be that he just couldn't say much b/c this phase is so subjective, I don't know. I will gladly eat my words if the jury comes back with death verdict. Then I'm sure I'll be saying Juan did a GREAT JOB in the mitigation phase. But I wish he would have gone after what JW said, which she said multiple times that if you find one mitigating factor, you must give life.

Any thoughts on this? Did anyone else feel that way? I have to say I was confused after the closing statements about how exactly they wree supposed to go about determining death or life, but then again I didn't actually read the instructions, just followed along with JSS and then watched the arguments.

I said that weeks ago the jury instructions are sometimes the hardest part of the case. You've got twelve people who can interpret them differently. I really don't think Juan could have done a better job. Even if she gets lwop it will be hard on her to know she'll be forgotten in there. As the years go by less and less people will care about her. No more press conferences, no more cameras she will just be another murderer getting older and older.

Most people assume he had to be the foreperson for the jury. There are only 12, but those 12 were picked from a pool of more than 12, so the numbers go higher than 12.

Just a theory and hope this isnt right, but
Have a theory that maybe a couple of the jury members came into the deliberations and just said that there is no way they can give this person the DP because they know she is sick in the head, and therefore they cannot give her DP no matter what anybody else tells them.

Maybe that is why they got deadlocked so fast. If that is what happened, hopefully they will think it through tonight and the rest of the jury can convince them to reconsider.

I think they had taken a break and someone was reading through the forms and had a question of "what if" I am hoping this is not a big thing. The jurors' all sounded firm when they answered "yes" on the conviction and cruelty phase and they knew from the start this was a death penalty and it would be hard. If at any point during the trial they discovered they couldn't consider the DP than that juror should have called it quits at that time.

Yes, I agree. This should've been very clearly explained. It's like the ol' scales of justice...each juror should put anything that they feel justifies the death penalty on one side, balanced with anything they believe justifies sparing her life. The mitigation has to outweigh the aggravation and I just don't think these jurors feel that way. It really didn't take them long to be unanimous in their verdict or in deciding death eligible. I think they will be unanimous soon.

Hi guys,

Finally back after a long long day at the courthouse.

I worked this morning and came out of my last session to find a ton of texts about the "deadlock", rushed down to the courthouse to find my pals in fight or flight...we all ran back upstairs and immediately held a prayer circle, led by Katie Wick in a small hallway. She led a beautiful prayer and we tapped in to the collective good energy and prayers coming from around the world and to be led in the ways to be supportive and helpful to the family in all the best ways.

So we were just mingling, talking to various journalists from Beth Karas to Jeff Gold to WildAboutTrial (who got me in a fit of hysteria over the word "blouse" asking me "What is a blouse? I thought it was a bird").

I was standing over at the wall charging my phone with Katie and we saw this article Kiefer wrote which included apparently a verbatim account of the note the jurors sent out, including the signed "foreperson". I found that odd as no other journalists were reporting on this set of details and usually notes like that are NOT released to the media/public. I'm sure you all know my feelings on Kiefer and of course I lean to thinking someone from the defense wanted that "out there" so they got that info to "their man".

Anyway, suddenly Katie turns to me and says "have you actually read this note?" and goes on to have this lightbulb moment asking if I thought maybe the jurors were just asking a question about the instructions, clarifying how they are to handle things if certain decisions were made/not made. Not necessarily saying they were THERE but how to handle it if they ever GET THERE.

So it caught my attention and we sat there kind of chewing on this idea, the timing, etc. What we realized is that with the timing of how things went down today, is that this note/question came in about 40 minutes after they started deliberating today. Kind of a quick timeframe to get "deadlocked". What if they were just asking a question? Not indicating they were not in agreement!

We discussed it with another journalist who kind of poo pooed the idea as, apparently it was just drummed up by lowly "trial watchers" and not REAL JOURNALISTS (I'm not gonna name this person but not one of my faves and in Kiefer's back pocket imo). He actually got a bit aggressive when we were having the audacity to question this. He showed us Judge S's words on his cell phone but we kept saying "but that's not what the jury said!". What they asked was IF they are deadlocked. A whole lot in those two little letters.

So we float this idea to both Beth Karas AND Mike Galanos (super nice guy) and Ted Rowlands who are all ears and saying "you might have a point there!". Imagine that, a journalist who is listening and open to a new idea than the one they've wedded themself to.

Lo and behold, on Dr. Drew, Beth Karas floats this exact theory! We coached Katie all thru the dinner hour to say this on Dr. Drew which she did! Even though Beth had already suggested this idea.

All the hystrionics and drama today abated in one little two letter word.

So we ended up dining with Harold and Tanisha, I talked to Sam on the phone...they are all doing ok, all things considered.

I also passed messages to them from Janine Driver and Wendy Murphy that came my way...and a sweet message about God from our dear Jayarohh.

After we left I think we were all feeling pretty good.

I DO NOT THINK this jury is "deadlocked". I think they will reach a verdict tomorrow and sentence Jodi Arias to death.

I'm told that every juror looked in the direction of the family today when this went down as they left the courtroom. Jodi's family was not even in the courtroom. This is all good.

Let's all keep breathing and surrounding this jury/family/ourselves in all the strength we can muster. This is where the rubber meets the road.

I'll say the words that said to my friends the moment I saw them today.

Now we have to dig deep.

Now is one of those life moments when you understand how strong you are.

Thank you for bringing this over, I was not here when the thread got shut down.KCL has been great keeping our hopes up that this jury will bring Justice to Travis and his family. She has faith in this jury and so do I.
 
OMG have you seen the video of that? They had video of it for about 2 minutes, it was after JSS read to them some jury instructions she had missed earlier (NOT the heart-attack inducing time when camera were on during the jury "question" or note or whatever it was)....CMJA and the officer were laughing and carrying on...it was mostly CMJA doing the talking, but the officer seemed to be very receptive to what she was saying and also laughing. CMJA was doing a lot of motions with her hand, and you could tell even just from the video that she was flirting with him, and he is after all human, he was falling for it.

yeah. She was doing that "cootie-catcher" movement with her hands. Funny this was, it looked to me like her pinkie finger was wonkey, not her "broken" ring finger. Like maybe all her fingers can do that if she wanted them to......

OMG! I haven't seen all of this one yet! Been dying to see it! I've seen snippets all day! We were at our beach house all day and I couldn't get online there earlier to watch it. Thanks for providing the link! Off to watch now!
 
I agree. I do think Juan could have done better explaining it too. I think his problem is that he knows it so well, but doesnt realize that the jury may be begginners at this.

It is very confusing and I would have to read through all the instructions and understand them better. The TERMS is what I would have to learn. I still dont know how mitigation factors are supposed to help me decide life or DP. So what if she has 1 or 2. If the aggravating factors like cruelty far outweight the 1 or 2 she has, surely they cannot overrule the DP or can they. No need to answer because I am not on the jury , but if I was, I would study them and learn all the rules before deciding.

And THIS is probably what the jury is discussing while we fume and worry.

I heard on NG that Jodi stated she wasn't aware of the media attention...but then I remembered that she called TH out for not airing part of her earlier interview. lol
Someone must definitely be feeding her blow by blow accounts of EVERYTHING she says. Just how much time does she get to chat on the phone in jail??!!

PS- this GMA interview was the only interview I watched in full today (and only after I go the word here it was a doozy!). This guy deserves some kind of an award.
 
He did great, didn't he? I love that he asked some hard questions.

There was another guy from ABC who interviewed her that I liked. I didn't see the entire interview yet (someone gimmie a link please! lol), but I've seen snippets of it all day. I'm talking about the guy who asked her when was she going to tell the truth about what really happened in that bathroom the day she killed Travis - and she glared at the guy, paused and said "I don't know what you are talking about - I have given the truth" and then she adds "I didn't know you were such a hater...blah...blah...blah" What a flipping narcissist! She thinks she's clever sparring with people like that, but if she only knew how it really portrayed her. Lawdy she is a crazy evil mess.


Exactly. The ABC guy brought out her true colors. Her problem is she doesnt realize that it was not that he "hates" her, but it is just that he does not believe her. Same with the jury and most of us. Nobody believes her, and she thinks that means that people just "dislike or hate" her. She loves being the victim.

Poor Jodi the person that everyone hates and sent to prison because we just dont like her. No Jodi, we dont believe you!!! That is why you are going to prison.

Can someone tell me what the reporters questions were and JA answers. I can only get a few stations because my direct tv box is going bad so I have not been able to see any of the interviews. Maybe a good thing...I just want the highlights anyway.
 
GUYS! What do you think? All her life, she's told everyone "I've got this." Her allocution is what comes to mind right now. Smart sociopaths are really scary people (Eric Harris was above average IQ also)(Columbine).

Also, did I already say, "Jaysus. This behavior of JA must've been what Travis was reacting to with his angry email. Look how we're reacting to her and we didn't have the benefit of sex to blind us."

Jodi Arias is becoming a laughing stock. But I don't think she's ever going to be aware of it. Or what it means. She'll always think we're laughing WITH her.
I think you're right and he was reacting to her. Can you imagine she pushes people so far, until they want to hit her. She probably eggs them on... Like "come on hit me..."until someone does and then she cries abuse. I can just hear her saying that to her father.
