Anyone venture reasons for not 'finishing Mali off'?

He may not have known Marli wasn't dead, she was probably unconscious and then he may have been downstairs for much of the remaining time, when she started to move.
 
I really hope it can be proven without a doubt by a doctor that HvB never fell unconscious, that it wasn't possible.
 
HvB looking more confident today, spring in his step.

I've checked out a number sites including the Mayo clinic and fainting or falling unconscious usually lasts anywhere between a few seconds to several minutes but can last up to 30 minutes. I've seen nothing to indicate it can extend to 3 hours.

The morning session of the eleventh day of the Van Breda murder case was a hairy affair - not only boasts Henri van Breda (who is facing the triple ax murder of his mother, father and elder brother) with a shorter hairstyle; defending the hair parted on the testimony of the state's forensic scientist.

Lieutenant Colonel. Henry James Stuart, a hair specialist, testified a hair sample matching that of Henri, was found in his little sister, Marli's palm after the brutal attack on the Van Breda family in their mansion on the De Zalze Golf Estate in Stellenbosch

All the journalists tweeting now spelling Stuart as Stewart. Isn't there a memo with the list of witnesses?

Defence advocate Botha continuing with his cross-examination of Stewart.
Stewart says the kit numbers of the samples are all he looks at when doing his tests. He does not look at names or other numbers. This is concerning Stewart's testimony that he did not know who the samples belonged to when doing his tests. Botha questions this

Botha: You are not saying that they are the same hairs? Stuart - I only state that it shows resemblance.

Stuart says he uses the kit number as the reference numbers.

He reiterates that he refers to kit numbers, which is the only important number. He doesn't look at the names linked to that, he says.

Botha - is your evidence that you concentrated more on the kit number than the bag seal number? Stuart says he does.

News24 is still sticking with Stuart. There is usually a witness list but perhaps it hasn't been handed out to the journos.

Botha is continuing to show evidence that calls colonel Stewart's testimony of not knowing whose samples the hair belonged to into question. However, Stewart is sticking to his guns with stating that he did not know the origins of the samples.
 
In your statement, you made a mistake when you refer to the reference kit number? Yes, Stuart says.

Botha says he finds it strange because this is the number you concentrated on. Stuart replies that its an easy mistake to make.

Botha says in April 2015 cover letter (from SAPS) Stuart was told whose samples those were.

Stuart says he only looks at the hair.

Another officer would open the sealed bag, document what is inside, then sends samples to Stuart.

It is couriered to Stuart in one docket

Botha asks if clerk would open it, or Stuart? He says another officer opened it and attached it to docket.

Docket arrives at our office and its registered by our offices. The clerk receiving it do they open the sky net pack
I received the sky net package and handed it to my warrant officer AJ Botes who opens and puts together the contents
there were a lot of entries in this case file combined into 1
Does officer Botes open the package put docket together and hands to you - yes.
Warrant officer Nel obviously needs to open the seal? What I received is no longer sealed - in separate evidence

Adv Botha tells Stewart that his evidence is NB he can't state something as fact and then say he isn't certain
Ur report refers to evidence bag seal nos. 3.1-3.4, 3.7-3.10. when u received them were those sealed bags opened
Yes they were already opened by someone else. Adv Botha says good lets carry on.

The docket is then handed over to Stuart, whereafter it is in his physical custody.

It is already in the docket, but not sealed anymore, Botha asks? Stuart says it is resealed before it comes to him, although he "might be mistaken".

Stuart says the case file was received in a sealed bag. Adv Botha asks if they were sealed when he received it, and Stuart says it was already opened.

Botha says blood soaked t-shirt, pants and towel used to cover her was collected by police while Marli was in hospital.

Botha asked if she had been grasping the towel, could she have gotten hairs in her hand from the towel? Stuart says it is a possibility.

Botha: A pillow was also taken from the room in which the two men were found. The pillow was put under head to help her breathe. Could hairs have been transferred to her hand if she grasped it? Yes, Stuart responds.

Towel would also contain hair, Botha points out. Stuart concedes.

Botha asks Stuart how he knew she had been wearing the panty. He says he couldn't have known that unless he had read the covering letter.

B asks witness to his look at the statement he made.B reminds Stewart that his testimony & statement is very important in this..case because if he found Henri's hair in Marli's fist (as the report suggests), it can create problems for his client.
