Mr. Nettle (sp?) is speaking for the defense and began by talking about a miscarriage of justice. His main point seems to be that Ravi didn't save the files for future viewing, that he didn't view the computer the 21st (second time). Ravi had no idea that Tyler Clemente knew what he was doing until confronted by the dorm counselor (name?)

Dang! They went to their live trial! I hope that they show the entire sentencing tomorrow. I'm sure they will go back to it live at some time. This is disappointing!

Judge: defendant is not entitled to a perfect trial but a fair trial, and he got a fair one. Before the motion was even filed - I reviewed my notes because I antisipated this. I isolated 11 reasons where reasonable people disagree, and in looking at my work, I found that at every fork in the road - I ruled for the defense. Without even being asked I suplemented the jury instructions.

Slamming DR - DR tried to blame me for his actions. i.e. that he vidoed them due to DR thinking MB was a thief.

MB does not believe that DR should be deported, but should get some time in jail.
 
I have never seen these kinds of requests from the defense at a sentencing hearing. Isn't this usually done as part of an appeals process?

I missed the introduction and I didn't know who he was. Thanks for posting. It was a very touching statement. jmo
 
As I listen to Tyler's mother, I have to say that every family member has spoken eloquently to their loss and theiinterpretations ov Ravi's actions.
 
this is so raw for Tyler's family... we read and learn about it, but they lived it.
 
below is not verbatim...just a summary....

Prosecutor: Multiple crimes with multiple victims and multiple motives, commited over a period of many days.

Action and state of mind of defendant, not Tyler's. Evidence proved defendants action's were on purpose.

Law specifically says the defendant should be incarcerated.

Risk and deterrents:

Aggravated circumstances - DR lied to police, destroyed evidence and coerced witnesses.
Seven counts in this indictment involved a cover up - sentence needs to be a deterrent to those that would attempt to hinder LE efforts and coerce witnesses.

Sentence must address: responsibilty, accountablity and deterrent.
 
DR is still looking bored, arrogant and unremorseful...I truly wish the hammer would come down on him for that alone...

He had the chance to plead out and only get probation...he took a chance, rolled the dice and lost...Buh bye, DR....away you will go...if the Judge sees your insulance, your unremorseful nature and your arrogance...
 
Defense up:

Over and over I hear that DR does not accept any responsibility - that he ignores what he did. Slams media. Why are we here? Is it because he refuses to take responsibility or that he was found guilty? We lost the case. We misjudged the jury's take on what happened. We have to put it in perspective. With what they (the jury) had, they convicted DR of everything. Noting Tyler's suicide and its effect on this case.
