Defence to jury re body at Kholo Creek - "All of you have been to the site. You have walked the walk" #badenclay @tennewsqld

David Murray ‏@TheMurrayD 1m
Defence is repeating the testimony of the officer lowered down to Allison's body. Mud up to knees #badenclay

Barrister Byrne asks jury to bear in mind the muddy banks of Kholo Creek as they go out for another break during his closing #badenclay

Man, it's not exactly hard to pull a pair of XXXL trackies onto someones legs and put on some shows, without even properly doing up the laces! The top half was likely as she was that night. Not even wearing a bra? I doubt she'd wear a "built in bra" walking. Not exactly supportive!

I'm a bit confused. Was she wearing a bra when found, as in a proper bra or just a built in one? Because I thought Byrne said she did have a bra on?

20 min break #badenclay jury. Defence asked them to consider how sticky mud at Kholo Ck was, difficulty police had there. @7NewsBrisbane

No, she only had on a singlet with built-in bra. They will try to make it sound like Gerard had to dress her in bra etc etc but no, she wasn't wearing an actual bra. Just the singlet with built-in support. And they are no support at all - Allison was not a tiny lady, she'd have worn a proper bra when walking I think!

Crown says he drives home afterwards. Do you think such a scenario is even possible - defence #badenclay
You have been to that site and ventured down the side of the bridge in daylight - defence #badenclay

Byrne tells jury they've "walked the walk", down muddy bank of Kholo Creek, to where body was found. "Is it even possible?" #badenclay

2 cars, one with Allisons body the Captiva, it leaves after body removed from the boot. GBC returns to home after dumping Allisons body in the 2nd car, that's why no plant material or mud from the creek found in the Captiva.

He will, and I venture to say the fact that of the 5 prosecution witnesses (that I can recall), they all dissented in one way or another will be one of the points hammered home.

This sentence is unclear. Are you saying that all 5 witnesses disagreed with what GBC said or with what the Prosecution said???

Thank you! Yes, I am sure Byrne said she had a bra on, but that's not right really. I agree. I don't know anyone who would use the built-ins as a substitute for a real bra, unless you were wearing it to bed...

So I'm in the Banko court which is one of the overflow courts and it is packed. The defence are putting forward a good case but I think most of his arguments will be quite easily dissected by Todd Fuller when it's his turn.

but the jury is expected to believe that Alison, in the cold dark of night, walked herself to the Bridge, all 14 klms , in a panicked suicidal state, and clambered down the muddy bank ...??

as opposed to Gerard driving her body there ..... sure..

Helllooo, Allison's body was dumped there on 19/20 April. Before she was found it rained and raining and rained. Rain + dirt = mud.

No, she only had on a singlet with built-in bra. They will try to make it sound like Gerard had to dress her in bra etc etc but no, she wasn't wearing an actual bra. I agree! I was an athlete so I've worn a good variety of tops with built-in support, only one or two that I would actually use without a sports bra even for activities that aren't "high-impact" such as weight lifting, even when I was much thinner than I am now.

:40am: Mr Byrne has displayed another PowerPoint slide to the courtroom.

The slide is headed: "How did Gerard Baden-Clay dispose of the body?"

The prosecution has alleged Mr Baden-Clay dragged his dead wife to the boot of her Holden Captiva parked in the family's car port and then drove to Kholo Creek at Anstead where he dumped her body on the muddy banks.

"Why is there no blood anywhere in the house, outside the house, on the patio, in the carport, when the prosecution case is the body is somehow either dragged or carried through the foliage and deposited in the car?" Mr Byrne asked.

"No blood.

"But there's one [blood stain] in the car and therefore that's how he did it.

"All you have in the car is a blood stain ... that can't be aged."

She could have been attacked and smothered in the garden at the rear of the house, after trying to leave during a row. The back garden looks quite secluded - not much chance of being spotted. Could explain why the house was clean - although wasn't there mention of the smell of bleach in the house?

The vaccum cleaner down stairs that was taken for forensic testing could have been an old vaccum which was used for real estate purposes. It is quiet possible Allison owned a new vaccum cleaner which was kept upstairs and had been used for vacuuming the captiva. Maybe the new Vaccum cleaner is in the same place as her missing pj's, GBC's boots and clothing.

The defence are, as is their job, pointing to lots of things and suggesting they couldn't have happened therefore there is reasonable doubt that GBC murdered his wife.

Eg, no leaves or mud in car, girls didn't hear anything, a body is hard to dress, too hard to carry her down the slope, no blood in house, no evidence of violent murder etc. the prosecution will address all of these I am certain. Fuller and Boyle will be furiously making notes to compile a list of these items.

Amee, are you able to take over Kate's tweets for me please??:please:

I can try if you want??

One officer says the mud was at the top of his gum boots when he tried to stand. #badenclay

Byrne says to bear in mind how police described it. One officer says he tried to touch down after being winched but mud was thick.#badenclay

This sentence is unclear. Are you saying that all 5 witnesses disagreed with what GBC said or with what the Prosecution said???

Disagreed (in some way) with each other on pertinent points. This page is moving at such a pace that a lengthy explanation would be quickly brushed over but off the top of my head -

1. Consistent with wounds from a razor biopsy.
2. Another concluded that the injury was inflicted by a razor was "definitely possible" (paraphrasing).
3. NSW expert concluded that nothing of probative value could be determined from photographs.
4. Expert could not determine direction of abrasions.
5. Other expert quite vehemently argues that the direction must have been down, totally dismissing the evidence of expert 4.

However what all 5 have in common is that they could not rule out the possibility that the wounds were inflicted by a razor.

Soz, that was supposed to be a reply to Freya1977

Ok thanks - I thought that is what you meant.

I think though that ALL 5 experts agreed that it could have been made from fingernails......sorry to disagree
