I became too bored to read it thoroughly, but once again their motions come across as very childish, poorly written and containing typos ("damming"?!).

and the part about "throwing evidence" :what:

I went back and listened to the Judge again. The Judge does mention 'testimony' and 'follow up'. So there an issue that ALV still needs to testify about? Plus there is another issue as per the Judge.

As I recall, she also mentioned that it's an issue that she knows about, and that she wants it put "on the record". Don't know if that means the jury will be there or not. If not, the judge might just want her testimony on the record about approaching Samantha and what she said to her.

When the youtube videos are up, go back over the portion at the end where the judge is talking to ALV about the schedule. Right before that exchange the judge inquires whether someone is in the courtroom. To me it sounded like she (the judge) said "Grace Ho". Was there not a journalist named Grace Ho who covered the Scott Peterson case?

It does not sound like Alyce's return on Tuesday is for further testimony on the stand. It is for something that is scheduled, at a particular time. And per the judge, Alyce "knows what the issue is". I too believe this is going to be a further hearing about Alyce's complaint about being "cyber-lynched".

What I absolutely cannot understand is that Alyce seems to be totally unable to perceive WHY this huge backlash against her and her testimony has happened. She has admitted on the stand to her lack of education within the field of psychology. Has admitted to "errors" (ahem) on her CV. Has admitted errors regarding very basic facts in the case - such as thinking Travis made the recording of the sex tape. And today has admitted to "mis-speaking" about how many trials she has testified in, along with yesterday having testified that Jodi told her that she shot Travis while inside the closet.

Combine all of the above - and more - with her continuously beligerant attitude day after day along with her overall lack of professionalism throughout her testimony, and there is little wonder that the public would judge her harshly.

I think, as was predicted here on the first day of her cross examination, that Alyce is now very worried about her professional future. What she thinks she can possibly gain in terms of saving her professional credibility by whining to the judge about people on the internet dissing her is beyond me. If anything, she's only making it worse.

We do have the right as citizens to express our views. At this particular website we do not make personal attacks on witnesses. We stick to facts. We do not call people names. We do not threaten in any way - not even by urging boycotts. Other websites may not or do not follow the same rules.

Alyce needs to go home now.

There was this one motion AND the issue of public harrassment is one of the issues.
Attaching (have a feeling JA wrote the first page due to absurd pretentiousness)

Oh wow. I don't see it in the court records. Maybe it wasn't just a rumor.

In Nurmi's request for mistrial, because of prosecutorial misconduct, part of his complaint was that the expert witnesses could not successfully testify because of problems with social media blowback. I wonder if they are calling her back to testify to that?

Aren't trial witnesses supposed to refrain from looking at social media and news about the case while they can be called to testify? I thought that's how the defense was able to have the Hughes' removed from coming to court, because they were possible witnesses?

]I can't stand all this drama surrounding this trial![/B] Why can't there be some order and discipline!? So much secrecy that keeps us guessing every other day about what's going on! I'm glad that atleast Travis' family know what is going on. Prayers for them and everyone supporting Travis.

This is DAY 101. I read somewhere the States case was 9 days long. So the reason for all the drama is The Killer and her Team. However, we are one day closer to the Guilty of First Degree Murder verdict so that's a good thing:woot:

her greatest gift was her absurdity.

anyone paying attention could ask a very good question back to her after every answer she gave. they were that absurd. she was the most slithery expert i've ever seen.

Yes her arrogance and narcissism was screaming at us - so condescending. Bleck!! IMO

Her testimony was insulting the the jury and mankind in general.

We have a very intelligent jury in this case and I believe Travis and his family will be gifted with the DP against this .... "defendant" (I want to say a whole bunch of bad things and swear words, but I don't want a TO, but I think you can probably guess .... :blushing:)

Quick question .. if they find that she has been impeached as a witness, does that mean all of her testimony will be stricken?

My response to that motion: Cry me a freaking river!

I sounded like a jealous middle school girl making an argument that the girl she thinks is prettier than her in class should have to be in another class so that she's the prettiest girl.

Oh and Salem Witch Trials...seriously?

which ended in 1692

Excellent point there my friend!!

Well I saw some and missed some so I have alot of reading to catch up on and watching hln to show some court proceedings.

Y'all might not want to be posting about this publicly.

If your were concerned perhaps quoting the original poster or pming us would have been a better idea. I removed the quote I was speaking about.

From the motion:

COMES NOW, Ms. Arias, by and through undersigned counsel to request that a mistrial be declared based on the prosecutorial misconduct that has infested these proceedings with a level of unfairness that cannot be cured by any other means. Ms. Arias bases this assertion on the fact that the circus like atmosphere inside the courtroom that to date has included counsel for the State yelling at witnesses, attacking witnesses on a personal level and throwing evidence. Not content with confining his misconduct to inside the courtroom counsel for the State, pursuant to his own admissions, chose to release evidence that was not coming into evidence at trial to the media and to pose for pictures with his so called fans on the courthouse steps has turned what is supposed to be a trial that comports with the rights due Ms. Arias pursuant to the 5th, 6th and 14th Amendments to the United States Constitution and Art. 2, §§ 4, 15, 23, and 24 of the Arizona Constitution into something that more closely resembles a modern day equivalent to the Salem Witch Trials which ended in 1693. This State of affairs has placed counsel for Ms. Arias in a position that they cannot fulfill the duties they owe Ms. Arias, pursuant Arizona Rules of Criminal Procedure, Rule 6.8. Counsel’s inability to fulfill these duties would thus result in Ms. Arias not having the benefit of the rights she is due pursuant to the 5th, 6th and 14th Amendments to the United States Constitution. Support for this Motion can be found in the attached Memorandum of Points and Authorities that is incorporated herein by reference.
MEMORANDUM OF POINTS AND AUTHORITIES
I. RELEVANT FACTS
OpeningstatementsinthismatterweremadeonJanuary2,20 13. Sincethattimethe State has thrown evidence and his pen, yelled at nearly every witness who took the stand in support of Ms. Arias and has hurled personal insults at defense counsel. In response to this behavior Ms. Arias has had to make several oral motions for mistrial that have beensummarily denied by this court. More recently Ms. Arias has had to make mistrial motions because the State has not confined its misconduct to inside the courtroom. Most prominent amongst this extra-curricular misconduct is his decision to pose for photographs with his “fans” outside the courthouse steps where jurors could potentially see him so doing. In further efforts to prove his case in the court of public opinion rather than a court of law on April 4, 2013, the State unapologetically admitted that it had released a plethora of damming evidence that would not otherwise come into trial to the media. Pending before this court is a motion for mistrial based on the former, Ms. Arias’ motion for mistrial based on the latter was summarily denied.
Note should also be made of the fact that the conduct described above has ramifications that effect the ability of Ms. Arias to present her defense as the public response to this unprofessional conduct has involved berating witnesses via e-mail, telephone and in various internet forums. Said action has not only caused personal distress to these witnesses but has made it difficult for them to provide effective testimony for Ms. Arias....

BBM

I think ALV is coming back Tues to discuss the bolded portion above.

Last time I checked, freedom of speech is protected under the First Amendment. AVL is not the first person involved in a high profile murder case to receive threatening emails, telepone calls, etc. It happens all the time. When you play a game of 'Liar's Poker' on the witness stand, be prepared for the backlash, Alyce.

2 things regarding ALV:
1. Juror question something like...JA receiving minor wounds and TA receiving horrific wounds, wouldn't that mean TA received the worse of the domestic violence...JM had to keep objecting and finally ALV said... NO! Good LORD woman!!!!

2. Seems the "tuesday issue" just might be the ALV speaking to Sam like others have posted. This is from a spectator on twitter who has been in the courtroom... she "observed Alyce La Violette come over to the Alexander family in the spectator section of the courtroom and quietly make a comment to Travis' sister, Samantha. This spectator was unable to hear what the "expert witness" said to Samantha. This spectator was aware that this was in violation of courtroom protocol.

There was some type of distraction in the back of the courtroom or possibly in the hallway, and most of the people in the courtroom were focused on the distraction. Therefore, few individuals saw La Violette speak to Samantha Alexander. A little later, this spectator made a point of talking to Samantha and told her she did not have to endure talking to La Violette. She said Samantha looked at her and softly said, the Prosecutor is already on it.

In all probability, this action by Alyce La Violette is why she was summoned to Judge Sherry Stevens chambers this morning. Perhaps, we will soon learn what the consequences of this action will be. It could possibly be a sanction of the defense team for permitting this inappropriate courtroom decorum to occur. It is possible the consequence may be limited to an admonition by Judge Stevens to Alyce La Violette. However, after testifying 18 times as an expert witness, I am certain Ms La Violette was aware she was breaking courtroom decorum. Therefore, the consequence could be a stiff penalty."

Perhaps the friendly smiley exchange between the judge and LV earlier this week after her testimony was over, has brought into question the judges favorability towards LV.

It wouldn't to me, but we did notice it, and perhaps this is the prosecuters way of taking the air out of LV's credibility?:moo:
