Do we know if Jodi was under a court order to cooperate with the States psychologist?
Could her lawyers have prevented her being interviewed and tested?

If the defense team brings in psychological evidence, then the PA has the right to bring in his own independent evaluator, or least thats what I remember from that other trial which shall not be named.

The only info I can draw on is in the FLORIDA CASE NEVER TO BE NAMED AGAIN the defense wanted to put a psychologist on to testify "for" the defense, but the State said ok...if you do that then our psychologist gets to examine her....and the defense quickly withdrew that expert.

Here, the defense put up Dr. Samuels, so .. tit for tat.

But I'm not sure about a court order....
 
ok folks....don't all jump on me but Dr DeMarte seemed a little snarky to JW when cross began and they went through her CV. Seemed like the Dr's demeanor changed immediately. I think she needs to watch that. She seems like a real brainiac...you know, like Einstein!! JA did seem to me to very childlike over at the def table. Coloring maybe!!

Agree, but Dr. D seemed to settle down later in the cross. Hopefully, she will come in today more relaxed. Just startled with the difference between Stabby and the Dr. Same age but eons apart!
 
i just think the comparison between working with abused children and an adult accused murderer is ludicrous. i think the jury understands the difference, and JW, as usual, looks stupid making it.



That's a kinda trick/loaded question. Yes, there are millions of abused children, people, we can feel sad that this is the way things are. Dr. D's profession is in this field. Her job is to either treat the people who come to her or direct them to the correct helper. I'm sure it can be heart wrenching to have to listen to abusive situations, but that comes with the territory, and people in Dr. D's profession expect to be hearing these stories. Sure there can be others with very similar or a worse set of circumstances.

We can see where JW wants to go with this ... but I think Dr D is going to use words to JW that will show her question is nothing more than a loaded question...yeah, nice try JW, just what we would expect from you

I like DD very much and think she is a great witness and did a good job with JM. However, I became a little nervous when JW did her cross. Everyone knows JW was going to go after her about the length of her experience. She should have been prepared for this. She seemed nervous and a little combative on her answeres. True she does not have 30 yrs experience, but she should be proud of her studies and the years she does have and supply her answers with more confidence.

I have been at my job for 20 years. I have not done anything amazing in that 20 years. I have a director that started fresh out of college and moved up in my company in 4 years. Its not the years its what you learn in those years.

I thought the exact same thing. But then I listened to this brilliant young woman, and putting her next to the two defense experts, IMHO, is like night and day DESPITE the fact that she is young and relatively new to her career.
 
My mother's got BPD, and it's NOT nothing. It's very real and very debilitating for those who suffer the disorder, as well as those close to them. It's horrific, and I take great offense to your comment. People should really educate themselves about mental illness.

None of the personality disorders are just "nothing." One of my jobs is working in a mental health ER and also in a subacute unit. 12 hours of dealing with with one or more people who are diagnosed with at least one (and who usually have a diagnosis that is biochemical as well) will wear you down so much mentally and emotionally. For those who must deal with this regularly I truly salute you. If I could, I would rather deal with several detoxing addicts or several with biochemical disorders unmedicated then deal with someone who has one or more personality disorders in all seriousness.

He has tremendous mental agility, which JW lacks, imo.

I think he can "see" exactly where he needs to go and how he's going to get there. And he's never thrown off course, no matter how many sidebars the DT throw at him.

Few people are that adroit, let alone moving as quickly as he does.

I think JM is what every lawyer strives to be or should strive to be.

I believe it was on her last day of testimony in the morning. JM was calling her out on something she did not like. She did not say it out loud (almost under her breath) but if a jury member was looking at her at the time they would have known what she said.

She said it while facing the jury just as the lawyers were walking to yet another sidebar.

It was yesterday, JM was trying to give an example to DD, something along the lines of, "Say I am a jerk...." SIDEBAR, blah blah blah...

Not sure of the point he was trying to make, I got super busy @ work....

Yes work is getting in our way!!!!!!!:furious:

I think ALV and RS are too stuck in their ways with out-dated approaches. DD is clearly more in tune with the latest advancements in her field.

Didn't ALV say something along the lines that women are taught to be passive etc. I think she is a generation or two behind.

JW and the entire defense team also lacks preparedness. They should not be experiencing any surprises at all. KN's been on this for years, and JW has at least a year+ in the bag, too. They simply haven't done their homework.

Posed this question yesterday and got a response that if the DT gets to have expert testimony and witness who does a psychological exam/testing then the Prosecution has the same opportunity.

I'm sure JM prepared JD for the cross and she didn't seem combative. She's just defended her CV and she has a right to do this. She doesn't seem snarky to me.

Despite being 32 yo, DD projected maturity and command of the applicable facts in her field. ALV and Samuels, both 65+ yrs. old, are two generations away from the sexual mores, social media, IT technology, etc. of today. Both relied on personal, subjective input provided by Jodi, ALV even ignoring what Jodi herself wrote in her journals in favor of ALV derived "context". I love the contrast, and think DD was a brilliant choice by JM.
 
I found it amusing how JW tried to act like the fact that DD was teaching is not considered work. Does JW not consider her training trial attorneys as work? It important enough for her to illustrate on her website bio.

Now we know why JM asked ALV about getting her Master 10 years after her Bachelor's.

Also by ALV saying she doesn't understand differences between texting, IM's, etc. since her testimony was involved so much in the written word and how they were exchanged you would think she would have researched that before testifying. It's not hard to understand the basics.

He said it yesterday when Dr Demarte was on the stand. There was a sidebar after. I do believe it was directed at ALV's comment on the stand. I think the court reporter caught it on his machine,when ALV said jerk. I am told thecourt reporting machines are very sensitive and pick up everything. Hope ALV got reprimanded for her jerk remark.
