Anyway, the expert is all over the place now .. so well done, Nel .. he's made this bloke look a total fool.

He was wasting his time and going nowhere not so long ago according to some too :facepalm:

Just another expert who's only interest is helping precious little Oscar get away scot free rather than assisting the court.

The freaky part is that he doesn't even understand how ridiculous it is, for an 'expert' witness', to complain to the judge that the reason they can't answer any hypotheticals, is that THEY ALREADY KNOW THE FACTS---because the Accused told them.

Conflict of interest, defense would have done better getting athlete team medical specialist to testify about Pistorius' disability and effects on his past behaviour.

Then had second expert not connected with Pistorius detailing disability and psych fright/flight research. Now it appears hostile and inappropriate for an independent expert witness. IMO

The state's case is that he was on his stumps at the time he fired, (as is the defense's) unless they've changed it...again.

This really does need to be cleared up by the prosecution. My understanding is that back in March-- around March 18-19th (day 12 or 13)-- Nel accepted Mangena's findings about the more probable firing position with Oscar on his stumps holding the gun with both arms raised out in front of him at eye level, but Nel also asked him to acknowledge it was still possible that Oscar fired from his prosthetics with arm bent at his side-- which was Mangena's second scenario for another possible firing position for the bullet trajectories they measured with the laser.

However, nearly a month later (!) Oscar testified on April 14th (sometime around 1:12pm-- sorry, will provide links later when not on my mobile) that he fired with one hand on the gun with elbow bent and the gun at his side. Oscar said he was bracing himself with the other hand.

So, I don't know how else to interpret this-- if he fired with his arm down at his side with elbow bent, then the only bullet trajectories that line up according to Mangena's ballistics testimony a month earlier would be if Oscar were on his prosthetics.

It always seemed to me that many people grabbed the media headline that "Oscar shot from his stumps!" without reading the entire ballistics testimony about probable and possible firing positions. Oscar's own statement would IMHO, indicate this would not fit with the ballistics evidence. Can anyone help with other evidence to the contrary?
 
I still think the first supposed "startle" - the window banging into the frame - is a crock, as those windows slide inward away from the frame and only the width of one panel (1/3 of the way). No way OP heard a sound loud enough to reach him standing near the balcony next to the big fan blowing away.

After watching this morning's evidence, nobody could blame Professor Derman if he wished to go into a dark room and sit alone for a while, quietly sobbing.

Prosecutor Gerrie Nel showed exactly why he has a fearsome reputation as he attempted to completely destroy Derman's credibility as an expert witness.

Savage stuff.

Since there was no intruder, any window banging would have been done by Reeva. Why would she bang the bathroom window open, rather than quietly slide it, unless she was in panic mode and saw it as the only way of escape?

It appears this "expert" witness cannot distinguish between a hypothetical question and Oscar telling him there were three noises. He's obviously biased or just plain dumb. An expert should be able to respond to each question based on his expertise surely
Nel would be better off telling him to forget about Oscar's version and simply pose a hypothetical scenario where there is one stimuli, then only move on to the next stimuli/noise after he gets an answer. This Prof is trying to pre-empt every question and how it would relate to Oscar. He's a halfwit who likes the sound of his own voice imo.

It was:

1. Window sliding open
2. Toilet door slamming shut
3. Magazine rack

Yes, the door slam. TY. Doesn't make sense for Reeva to slam the door on a normal bathroom visit and certainly not if she was hoping to hide from intruder/s.
 
I can't remember the exact words about OP being gentle etc with woman, but here's a good example of his charm, gentleness and non-aggression. Actually the whole article is interesting.

It was a pure and simple act of arrogance and aggression. When Marilyn (in a firm but extremely non-aggressive manner) told Oscar that his behaviour was rude and unacceptable, she was met with a flurry of verbal abuse! This included being labelled “f…ing lesbians” and a significant amount more. Good manners preclude a repetition of the full gamut of the tirade. Marilyn – profoundly taken aback – said to Oscar “what is your problem”. His reply: “I’m drunk, what’s yours.”
