Nel indicates that he may apply to reopen state case to call Dr Kotze "in all probability".

Roux: we have come to the end of our case, we’re not calling Dr Fine, but we might call another witness.
 
Nel says both sides have accepted the reports and the DT don't have the right. Each entity had a witness appointed.

True both accepted the report/s in respect of OP criminal responsibility, i.e. the State of Mind at Time of Offence, but they both put caveats and possible disputes on the rest of the report since it covered a lot more than just what was asked in Masipa's order.
 
Masipa saw one page of the report. Did Counsel have access to the full report? She wants to know if they've had access to a full report.
Roux: No. He says they've only seen the one page report.

I don't understand this. Why doesn't anyone have the full reports?
 
Now the judge is asking about the psych report: have you had access to the full report?

R: no milady.

J: But there must be a full report?

R: I don't know milady, that's why we want to consult

Roux explains how they are not asking for state's privileged info. nel says the full report is the report Roux has, and continues to argue against this.
 
I think Roux's correct. He's supposed to have access to what the state know.
 
I thought his speaking voice was more masculine in the video. As though he's raised it in court to sound more feminine.

Yep! He sounds deeper in other interviews I've watched too.
 
Nel: Why would there be a need to consult with a different psychiatrist if you have your own?
 
Nel: The state psychiatrist is available to the state - the defence cannot consult with everyone.

Nel says Roux needs to use his own psychiatrist and to keep his grubby paws off the states shrink. <<< just being cheeky lol:floorlaugh:

Does anyone know if the DT consulted with Mangena or any of the other people working with the PT, or did they have their own people, kinda like this issue?

But they were witnesses called by the State. Had the State not called them then the DT could have called them. This was even stated by Nel during another day when he said something about that the DT could have called Botha but chose not to.
 
The Judge wants a few minutes to think it over... and probably look up any precedents. jmo
 
I wonder what it is about the state's psych that everyone is fighting over. The DT is desperate to speak with her, and Nel is desperate to block them. What is the issue ?//
 
Nel was making it sound like Roux doesn't actually want to call his own psych witness, Dr Fein/Fine?
