Oh dear Nel.

I agree kaos, maybe a fatal mistake.

Nah, I don't think so .. I doubt they have to ask OP about every single thing that is considered as evidence at the crime scene .. just like the jeans outside on the ground. If it is something which is not in dispute, and can be proven, then it's just taken as evidence .. it's not circumstantial evidence that needs to be put to him for him to give an explanation.

Nel: For no apparent reason, Reeva opened the bthroomwindow. Milady, it's 3 am in the morning. Why would she do that?....Why would she take her cell phone?

Nel: He's standing in front of the door, shouting, saying, 'Reeva, call the police'. She doesn't say a word? It's ridiculous.

Why would she take her cell phone?

All posts are MOO

Nel: She's standing right in front of the door, she's not hiding....it's important to see that A is her right hip. She knew the danger was in front of her....

Shouldn't the defence have been pinned down by the judge about what the actual defence is? Nel shouldn't have to address two different defences.

I do find that Nel reminds me with this line of presentation more of a defense atty challenging the state's evidence.

Nel: Quoting OP, 'Before I knew it, I had fired four shots....I had no intention of shooting anyone'.....His vacillation between, 'I never wanted to/ I wanted to - the court cannot accept it. Cannot rely on it.

I thought there were 4 different defenses? :D

Nel: On Derman's evidence, it was a knock. On accused's, it sounded 'like wood'.....it's not a startle......Then he changed, said it sounded like a magazine rack. Derman accepted it, never questioned it. He was just happy to get a sound.

Then Nel mentions how OP changed versions yet again; 'I thought the sound was a door opening'.

Nel: On Op's version, he heard a sound and fired.,,,,inconceivable Reeva sitting on toilet, kicking mag rack, she cannot get up in front of the door in time to be shot. His version is he fired immediately in response to that startle...

Oh, that was clever. Nel Showing how he believe's OP's need to create a startle noise has messed up idea that Reeva was hiding or sitting on toilet. He covered any idea Reeva somehow kicked backwards at mag rack too, dismissed it: 'She did not'.
