4/15/24 Monday, Trial Day 3: Judge Boyce just denied defense's request to include 2007 incident (involving Alex Cox & Joe Ryan). Too far outside of scope of conspiracy, plus JR is not listed as a victim in this case.
State witnesses: Vince Kaaiakamanu. He was an investigator with the Fremont County Sheriff’s Office until taking a job as the Chief Deputy with the Madison County Sheriff’s Office earlier this year. Kaaiakamanu now oversees the Madison County Jail & oversees the Telmate phone/video system that inmates use in the jail. The exhibit is a thumb drive containing a call (June 9, 2020) between Chad & Lori while police search his property. Wood played the call for jurors.
Rexburg Detective Eric Wheeler. Wheeler’s role was to maintain scene security, traffic & crowd control while investigators conducted the search (6/9/20). He detained Chad & put him in his patrol vehicle. Cameras in vehicle. The videos are over an hour long but only 15 minutes were played in court. Prosecutors & defense each agree they can play whatever portions of the videos they would like. The video shows Chad in the backseat of the car. Emma, Chad’s daughter, comes up to the side of the car & is crying. Also showed his body camera footage.
Fremont County Lt. Joe Powell. Received notification of Tammy's death. Gilbert police asked Powell if they could locate the grey Jeep Wrangler with Texas plates. Powell proceeded to do surveillance on Lori’s apartment.
Nicole Heideman, FBI Tactical Specialist. She was assigned to research data & phone attribution. Phone attribution is meant to determine the likely primary user of a phone number. The presentation shows the phone attribution of Chad, Lori & Alex. Chad had 9 phone numbers – 3 of interest. Lori had 6, 3 of interest. Chad had 6 phone numbers, 3 of interest.
Blake says the exhibit is finished but has more for the witness. She says this would be a logical stopping point for the day. The exhibit is admitted. Tomorrow court will run from 8:30-3:30 but a motion will be taken up at 1 p.m. outside of the jury’s presence.

Trial continues on Tuesday, 4/16/24.
An Order to Show Cause hearing is scheduled on 4/18/24 @ 3:30pm per Judge Steven Boyce. A motion to delay the trial of Chad Daybell was filed late Friday night but little is known about why it was filed and what is contained in the motion. Terry Ratliff, a lawyer who practices in Mountain Home, filed the motion through the iCourt portal. Wendy Olson, an attorney hired by EastIdahoNews.com last year to argue for camera access during the trial, was served the motion, along with prosecutors & the defense. Judge Boyce instructed the attorneys not to disseminate the motion & on Tuesday, he signed an order sealing it. Boyce temporarily sealed the motion until he’s able to schedule a hearing to determine whether it will remain sealed “and set the substance of the motion for hearing [on 4/18].”
