This has always bothered me, especially in conjunction the comment that he would be late. Foreknowledge, perhaps?



I find his route peculiar, but it's not unfathomable to me that a person would choose that route. What I find extracoincidential is that Ross choose this route AND happened to discover Cooper at the last place with an audience.



I can assure that would not be a possibility at that time of day. Ross would have had to commute through the second largest and congested intersection in the city.



What in the world could innocently explain this?

What could explain it is RH looking for a hook-up after sexting all day, whether he had time to go to that specific Econolodge or not.

Sounds like he might have decided the day before that he was going to go play on the 18th whether LEANNA approved or not, and that the entire day was a FU to her.
 
Not to interrupt the flow of this trial, but aren't we on Week 3?? This thread says Week 2... plus this thread takes very Long to upload!

Defense going after this witness forgetting to tell LE about home depot. (I think he said the interview was 2 days after his death.)

"Were you trying to mislead the officer?" "No I was not."

**I wonder why he's doing that. We know for a fact RH bought light bulbs that day. This witness has absolutely no reason to hide info. I think it's pretty obvious there is nothing nefarious going on with this guy's testimony.

He is trying to draw a parallel to Ross forgetting to tell LE about their trip to HD to purchase the light bulbs.
 
The theater is a “massive” traffic area, Kilgore said, especially at 4:30 p.m.

Nothing remarkable about them leaving early for the movie, given the traffic, Kilgore said. No, Milling replied.

At 3:44 p.m. on the 18th, Harris talking about carpooling for something the next day to a Habitat for Humanity build, making future plans, Kilgore said.

Milling said he never heard Harris talking about living “child free.”
 
I'm reserving my trust in the accuracy of the claims by the defense until I see the testimony. But JMO


Just FYI and fwiw, that info (church group prayers, etc) doesn't come from the defense, but from multiple interviews with RH friends, etc. in multiple online articles going back to 2014.

As a local, this attempt to portray that area as a huge traffic area has me scratching my head. Yes, it's congested, and yes, there is traffic... as a general rule. However, congestion is significantly lighter during the summer when school is in session, AND Ross made it from the Tree House to Akers Mill Square in just over 5 minutes IIRC. On top of that, Piper was able to respond from Shane's Rib Shack, which is just beyond the movie theater, in just over 1 minute. I can say with a high degree of confidence that neither of those things would have been possible at a congested time. Even if it is congested, so what?

From Ross's office, he could have stayed off the congested roads and made it to the theater in about 10 minutes. IMO traffic and congestion does not account for Ross leaving 45 minutes early for a movie that was less than 10 minutes from his office, especially when he had a tight deadline at work. I am not buying it, and in this particular case, the DT is working too hard to convince me. It looks like nothing more than smoke and mirrors IMO.

So the defense hasn't claimed this, at all? (I missed the opening statements and haven't watched them entirely.)

LE arrived at the scene at 4:24.

He messaged the group at 4:09 that he would be at the theatre ASAP. So...when was his message to them that he would be late??

Wonder if they will ask Winston where RH normally parked, since they went to lunch couple times a week together.
Interesting too that again the State didn't include all the chats, Def added the rest of the 17th, State only put in a portion. (just like they did on the Report of Yeager, 7/25/14 instead of the full report of 1/23/15. * think the Def knew this too because they had to review and ok, States exhibit when being presented to be entered. :thinking:

He had enough triggers for his memory that day. Coffee cup, being near his car, opening up the door for the lightbulbs, going past the CFA multiple times to go to lunch and HomeDepot store. This is too unbelievable to me. Asking Leanna when she is picking up Cooper...the list goes on....


A scenario that falls short of intent but imo more than criminal negligence:

He was pissed at Leanna & resentful on the 17th, texted late into night, started up in AM, continued at CFA, he "forgot" Cooper because he wasn't thinking about Cooper at all, drove to work, dove into sexting, and continued to not think about him until something DID cue him, before lunch.

Rather than running out right then, RH arranged a lunch time where he could have witnesses when he "found" Cooper. And the reason I think that might be so, in a scenario in which RH is especially angry with Leanna, about the last thing that makes sense is that he goes out at lunchtime to pick up lightbulbs for her.
