In this aggravating kidnapping case challenges were made to the constitutionality of the aggravated kidnapping statute:

Challenge to Constitutionality of the Statute: Tex. Pen. Code Section 20.04 (a)(5). Paragraph three of the Indictment is based upon an unconstitutional law. Tex.
Pen. Code Section 20.04 (a)(5).

This subsection states it is an offense to abduct with the specific intent to “terrorize” a person, or a third person. The term “terrorize” is not defined by statute. Even by its accepted ordinary and common usage the term is vague and overly broad for due process under the 14th amendment. Appellant acknowledges antiquated authority to the contrary.
