Bumping up, good news and bad news. Court date has been set for October 1, bad news cell phone records WILL NOT be introduced. This is really bad I felt like those phone records were the heart of this case!! Looks like some detective got over zealous and took the phone without probable cause and just left it in his desk.

Even after the cell phone probably cause warrant issue and it being thrown out by the judge.

Can Mariah still testify as to what the text messages said I wonder?

I think Mariah's testimony will be important in this case. JMHO.
 
JMHO but I don't see why he can't get a fair trial in EP. I don't forsee any problems with Jury selection just from media coverage.

This murder wasn't really televised or covered extensively for very long and it didn't go national that I recall.

Sounds like this defense attn is trying to pull rabbits outta his hat to stall the trial. JMHO.

David did this IMHO. He had opportunity and more importantly he actually had motive. The combination of those two is going to get him convicted IMHO.

Prayers for his family even though they do support him at this time, that was their Mother too and it must be horrendous to have to face the fact that your own brother is charged in your Mother's Murder.

This makes me soooo mad:

The cell phone records however, will not be brought into evidence. Presiding Judge Gonzalo Garcia said the cell phone was taken without consent or probable cause, and therefore was taken in violation of the U.S. Constitution. Marmolejo smiled in the courtroom when he heard Garcia's decision to suppress the cell phone and records.

Opening arguments, first witness called in Marmolejo murder trial

After opening arguments, the first witness was called.

The woman found Gloria Marmolejo's body on a dirt road off Pete Domenici Highway in Santa Teresa

They showed pictures of Gloria as she was found in the desert and David started crying but did not look at the pictures.

The defense is not accusing his gf/stepsister but are countering that LE did not investigate her as a suspect but instead focused solely on David.

Did you see her picture Kat. She is there with her attorney, will she testify or will she plead the fifth. Hmmmm I wonder why she needs an attorney?

Police also found blood on a metal cabinet and a washing machine in Gloria Marmolejo's garage. Test results showed that the blood came from Wilson, Ronquillo said.

Scientists tested fingernail clippings taken from Gloria Marmolejo during her autopsy in August 2009, and the DNA found on those clippings was hers, Ronquillo testified

I can't figure out if they mean that the DNA under Gloria's nails were Gloria's or Wilsons?

Kat I think the ME meant the DNA is Gloria's from trying to remove the ligature during the strangulation. She had scratches on her chin the DNA on the nail clippings are from the skin on her chin.

In Gloria Marmolejo's autopsy photos, prosecutors pointed out several scratches on her chin. Dr. Juan Contín, the county's interim chief medical examiner, said the scratches were defensive wounds commonly seen in victims of strangulation. The wounds are often caused as the victim tries to remove the ligature, Contín testified on Monday.

This gives us and idea of what this poor woman must have gone through during the assault. As for Wilson I think she was a very active participate in the murder of this woman.

O.M.G. Can you imagine what was going through her mind while one of her OWN children was murdering her? :(
 
SAN ANTONIO -- Defense attorney Greg Anderson has rested his case in the sentencing phase of David Marmolejo's trial.

Marmolejo, 31, was found guilty earlier today of the murder of his mother, Gloria Huerta Marmolejo, 54, on July 29, 2009. Her body was found six days later in the Santa Teresa desert.

Finally justice for this poor woman. Hopefully he will never ever see the light of day again!
 
Prayers for Manny and his family and the other family members. Knowing that your brother killed your mother has to be just awful :(

I'll be checking back for the sentencing.
 
SAN ANTONIO, Texas -- David Marmolejo faced life in prison for killing his 54-year-old mother but a San Antonio jury sentenced him to 54 years in prison on Wednesday.

He also was given the maximum fine of $10,000. He faced up to life in prison. David will be eligible for parole in 27 years.

It took a San Antonio jury just three hours Tuesday morning to find David, 31, guilty of murder in the July 2009 strangling death of his mother. David's first trial in October 2010 ended with a mistrial when jurors deadlocked on a verdict after more than 2 1/2 days of deliberations.

David did not have any reaction after the sentence was read. Some family members were present for the sentencing, including David's wife Laura, his uncles Conrad Huerta and Mark Huerta and his sister-in-law Jennifer Marmolejo.

Wow. 54 years for killing your own mother. That's a bit disappointing - particularly in light of all else he's is suspected to have done to others. Will have to hope he never gets paroled!
