Can you please help me understand the difference between the two dates of
08/04/2023 & 08/11/2023?
It's basically like the court knows that there will be a continuance or reset with both of the dates are for the pre-trial hearing? TYSM

Not much of a difference between the 2 hearings. Here's some info:

''The punishment trial for the mother of Jason Wilder McDaniel will likely take place in Fort Worth, a judge said Friday.

Thirtieth District Judge Jeff McKnight told the defense and prosecution that he anticipates moving Amber Nichole McDaniel's punishment proceedings set for Sept. 11 to Tarrant County.

McKnight said he plans to sign an official change of venue order Aug. 25, the same day of Amber’s next pretrial hearing.

McKnight is waiting to sign the order because after he does, court happenings must take place in the other county.''

''McDaniel, 33, has pleaded guilty to endangering 2-year-old Wilder, who was murdered by her ex-boyfriend, and to tampering with evidence connected to the murder investigation. She waived her right to a jury trial for the guilty-not guilty phase of the trial.''

Amber has no prior felony convictions. She is eligible for probation but faces the possibility of prison time.

She could be sentenced to two to 10 years in prison for tampering with evidence, a third-degree felony, and six months to 24 months in state jail for child endangerment, a state jail felony.

Amber may go before a jury in the Tim Curry Criminal Justice Center in downtown Fort Worth

Not too sure what is happening in her case. I have in my notes she plead guilty & sentencing will be on 9/11/23. But I see the court site says "Jury Trial".... ??

Did she change her plea? Anyone?

''Two other trials in Wichita County were switched to Tarrant County at the Tim Curry Criminal Justice Center in Fort Worth. The changes of venue were to ensure defendants could receive fair trials.

They include the capital murder trial of James Irven Staley III, 40. He was convicted and sentenced to life in prison without parole earlier this year for killing 2-year-old Jason Wilder McDaniel in 2018 in Wichita Falls.

In addition, a Tarrant County jury will determine the punishment for Amber Nichole McDaniel, Wilder's mom, for child endangerment and tampering with evidence in connection with her son's death.

Amber, 33, pleaded guilty to those charges earlier this year. Proceedings to determine her punishment will begin Sept. 11 in downtown Fort Worth. She is eligible for probation.''

Since McDaniel has already entered her pleas on both charges, the jury of 12 men and women from Tarrant County will not be tasked with determining whether she is guilty or innocent, only what her sentence will ultimately be.

According to officials with the Wichita County District Attorney’s Office, McDaniel faces anywhere from 6 to 24 months in a state jail for the endangerment charge and anywhere from 2 to 10 years in prison for the tampering charge. Since McDaniel has no prior felony convictions on her record, she will be eligible for probation on these charges.''

FORT WORTH (KFDX/KJTL) — Amber Nichole McDaniel, who pleaded guilty to felony charges connected to the 2018 murder of her 2-year-old son will soon face a jury of 12 men and women from Tarrant County, who will determine her sentence.

Fort Worth, Texas (KAUZ) - The trial resumed after lunch, with more of the 9,751 text messages between Stately and Amber read in the courtroom until approximately 4 p.m. Some of the messages spoke about a “tinder box” that Staley would joke about putting Wilder in.

After discussing the messages, Gillespie showed the jury a video that Staley sent Amber of Wilder with a bump on his head. In the video, Staley says that Wilder fell off the bed.

Then, defense attorney Barber questioned WFPD detective Fowler. During his line of questioning, he revisited some of the messages and pointed out that Amber was sad to leave Wilder at daycare, alone in his bed, and so forth. Barber asked Fowler if he knew Staley and Amber well enough to know if they were joking in their text messages.

Opening statements began with Wichita County District Attorney John Gillespie. He took this time to lay out the relationship between James Staley and Amber McDaniel. Gillespie highlighted the violent signs that Staley had shown towards Wilder McDaniel, Amber’s son.

After the Defense ended their opening statements at 10:05 a.m., Gillespie called the first witness, WFPD Detective Tanner Fowler. Fowler has been with WFPD for just over 10 years.

During questioning, Fowler stated that Amber did not disclose certain text messages, including one mentioning how Wilder “... should be culled.” Gillespie then mentioned how there were 9,751 text messages between Amber and Staley that were deleted.

As of 4:45 p.m., the trial is in recess until 9 a.m. tomorrow, Sept. 12. Detective Fowler is allowed to leave but is still under court subpoena.

FORT WORTH, Texas — A Tarrant County jury heard opening arguments and testimony for the prosecution's case Tuesday in the punishment trial of Amber Nichole McDaniel, mother of 2-year-old Jason Wilder McDaniel.

Her trial on Tuesday has involved going over some ground familiar from Staley's trial earlier this year. He is Amber's ex-boyfriend and is serving a life sentence without parole.

10 a.m.: Gillespie reads to the jury from Wilder's autopsy and also submits into evidence the judgement against Staley for his capital murder conviction.

His trial was moved to Fort Worth on a change of venue because of safety concerns and pre-trial publicity.

10:50 a.m. The jury heard text messages from the beginning of Amber and Staley's relationship read in court.

State witness: Wichita Falls police Detective Tanner Fowler. The jury heard text messages from the beginning of Amber & Staley's relationship read in court. The prosecutions shows a video to the jury of Staley & Wilder that was also shown in Staley's murder trial.

*James Irven Staley III (38 @ time of crime/40/now 41) - Trial started 2/27/23 & ended 3/13/23. Staley has been found guilty of capital murder for the 2018 killing of Wilder McDaniel. Staley was sentenced to life in prison without parole. Filed appeal on 3/13/23. 4/13/23: Staley was transferred TDCJ John Middleton Unit in Abilene.

Wednesday's testimony

9 a.m. Wednesday: Wichita Falls police Detective Chad Nelson is called to the stand to be the first witness of the day.

He responded to the death scene at Staley's home on Irving Place in the Country Club area after Amber found Wilder dead on the floor of a bedroom and called 911.

10:59 a.m. The jury watched Ambers second interview with Nelson. It took place Oct. 12, 2018, and this time, Wichita Falls attorney James Eaves is there to represent her.

1:39 p.m. The jury began viewing a videotape of the interview. It has apparently never been shown in open court before.

4:49 p.m. Barber is allowed to have a witness called to the stand and interview her out of order. The witness, Amanda Vickers, had to rearrange scheduled clients to be able to testify.

Vickers, a Wichita Falls counselor, began testifying. She is a licensed professional counselor who has worked for Child Protective Services.

5 p.m. The judge recesses the trial until 9 a.m. Thursday and lets the jury go.
 
Thursday, Sept. 14th:
*Jury Trial continues for Sentencing (Day 4) (@ 9am CT) - TX - *Jason Wilder McDaniel (2) murdered on October 11, 2018, Wichita Falls) - *Amber Nichole McDaniel (28 @ time of crime/31/now 33) aka Amber Odom, mother charged & indicted (7/22/21) & arraigned (8/6/21) with abandon/endangering a child & tampering with physical evidence in connection with incidents 10/11/18, the day her son was discovered dead. Amber was free Thursday from Wichita County Jail on $60K bond. Tampering with physical evidence charge dismissed 7/30/21.
Trial was set to begin on 9/11/23 was cancelled as McDaniel plead guilty. Jury trial selection for sentencing began & ended on 9/11/23.
Jury: 7 women & 5 men.
Trial began on 9/12/23. Judge Jeff McKnight presiding.
Wichita County DA John Gillespie is the lead prosecutor, assisted by Chief Felony Prosecutor Kyle Lessor.
Wichita Falls defense attorney Mark Barber.
