  • June 19, 2019 - Jackson makes his first court appearance since his re-indictment.
The new arrest has been a long time coming, not only for Josue's family, but for neighbors. Some of them showed up to the courthouse to show their support.

"We hope to send the message that justice will prevail no matter how difficult the situation is. We hope that justice is prevailed and that justice is served," said MC, a neighbor of the Flores' family.

Jackson says he was framed for the murder of Josue Flores, 11, who was stabbed more than 20 times walking home from school in 2016.

During the conversation, Jackson said there was no motive for him to murder Flores and believes the district attorney’s office rushed to an arrest because the case had gone cold.

Jackson said no DNA evidence was recovered linking him to Josue Flores following his first arrest and believes any evidence gathered recently was planted.

KHOU Legal Analyst Gerald Treece says, from a lawyer’s perspective, nothing good can come from Jackson speaking publicly without an attorney present.

He explains anything he says can be used against him in court.

"Maybe this will be his defense at trial, but if it’s not, the government has another inconsistent statement this man has made," said Treece.

Well, duh. Obviously there was no motive to stab a 11-year-old boy more than 20 times, besides pure malice and perversity. He was coming home from school, minding his own business, not causing any problems, not bothering anyone. So no, there is no possible motive to this awful crime. Which really doesn't prove that this dude didn't kill him. He probably thought that he got away with it at first and that there was no way LE would ever bring it up again. He annoys me so much. Excuses and more excuses.

Program honors Josue Flores, aims to keep students safe while walking to, from school
Members of Safe Walk Home, police and local leaders welcomed students back at Marshall Middle School Monday.

Stella Mireles-Walters began Safe Walk Home four years ago after the death of Josue Flores in Houston’s north side. Josue was walking home from Marshall Middle School.

Community honors Josue Flores with memorial marker in Near Northside

A permanent granite marker acknowledging the life of Josue Flores was installed Wednesday in Near Northside, Houston City Councilwoman Karla Cisneros announced.

The marker is located near where the 11-year-old boy was stabbed to death while walking home from school in 2016.

Since Flores’s death, community members have faithfully and lovingly maintained an altar in his honor, Cisneros said in a Facebook post. Due to the coronavirus pandemic, the community was not able to gather on the anniversary of his death.

“Josue’s mother is requesting that people begin to remember Josue on his birthday, instead of the day he died,” Cisneros said. “Many thanks to all the City of Houston Departments that worked so closely with me to get the memorial marker installed in time for Josue’s birthday next week.”

Flores’ case remains unsolved. Authorities named two suspects. The first one was cleared by his alibi.

The second, a Marine named Andre Jackson, was released a year after his arrest when investigators said DNA evidence made it impossible to prove beyond a reasonable doubt that he is responsible for the crime. Prosecutors said Jackson remained a suspect in the case, and in June 2019, he was indicted.

5 years later: Family of Josue Flores say they’re still awaiting answers (click2houston.com)

The family is demanding answers from local officials Friday afternoon after they say the case has been stalled out for years.

The Harris County District Attorney’s Office released the following statement regarding the family’s request for answers:

“This case is incredibly important to us. We will never forget young Josue and we remain focused on delivering justice for his family, friends and the community. Unfortunately, the pandemic has caused trial delays nationwide.” Dane Schiller, HCDAO said.

Josue Flores murder: 5 years later and family of 11-year-old boy killed still seeking justice - ABC13 Houston
At the place where 11-year-old Josue Flores was brutally attacked, community activists and elected officials joined Flores' sister Friday afternoon to bring his case back to the forefront.

"We want to speak to [Harris County District Attorney] Kim Ogg and we want to speak to the judge," said one community activist. "Justice delayed is justice denied. Let's put an end to this."

The court system was at a standstill most of 2020. There have been three re-sets since December. Jackson's next court setting is in June. He remains in jail.

Josue's family is still grieving, but his sister said they are also grateful for those who have stood by them over the years and have kept Josue's giving spirit alive.

Jackson was indicted by a Grand Jury in 2019, and is now charged with murder for the second time.

But, it's been two years since then, and Jackson is still in jail, awaiting trail. He is due in court on June 10, and his trial is scheduled for October 22.

One of the reasons for the delay, according to the District Attorney, is the coronavirus pandemic.

From March 2020 to March 2021, there were only eight district court felony trials held in Harris County.

But, for Josue's family, justice feels overdue.

"He's just a name on a paper now to them. That name just went into a pile of papers," LF said. "Everybody is still getting their checks, whether they get it done or not and I just don't think it's fair."

"I wake up hearing his scream, scream, and I can't go to sleep or nothing," RG said. "Everybody is mad because everybody wants justice. It's been too long already."

"Those are examples that the community needs to see," added neighbor JCM. "That if people commit such a horrendous and insidious crime, the community needs to see that action is taken."

Safe Walk Home to kick off event for Houston ISD students returning to school Monday - ABC13 Houston
As Houston ISD students prepare to return to school Monday, a group of volunteers with Safe Walk Home will be helping them get to and from school safely.

But a conviction won't be easy, according to KHOU 11 legal analyst Carmen Roe. There have been issues with the investigation from the beginning.

"It's unusual to spend six years before you get to trial," Roe said. "In this case, they had an alternate suspect they released, charged Jackson. released him for no evidence and recharged him. So we're going to trial on a case that has a long and troubled history."

She said seasoned attorneys on both sides will have plenty to go back and forth on, but the case may hinge on DNA evidence that police say links Jackson to the murder.

"This is going to be a real time forensic files case right here in Houston," Roe said. "Whether or not that DNA evidence will be enough to find him guilty beyond a reasonable doubt is going to be a question and a fight that will go on for the next several weeks."

The state said during the trial, jurors will hear from several different witnesses, who say they saw a man matching Jackson's description leaving the crime scene shortly after the attack.

They said the jurors will also see surveillance video of Jackson leaving the scene.

Before the opening arguments began, the defense brought up concerns with evidence relating to a green jacket found in a room at the Salvation Army on N. Main, where Jackson was staying at the time.

The defense had concerns about why police took the jacket and how they connected Jackson to it.

During opening statements, prosecutor Chris Conlon said surveillance video captured Jackson running near the murder scene and wearing the same distinctive green jacket found with him during his arrest.

Day one also featured more than 10 witnesses, including a pathologist who described Flores’ injuries in detail; the police officer who found Flores unresponsive after the attack; and a crime scene analyst.

At one point, a prosecutor pulled out two items found with Flores’ body to show jurors in the courtroom: The 11-year-old’s Marshall Middle School sweatshirt and his backpack with cuts along the straps.

Prosecutors also called several residents who provided surveillance video to police. Those witnesses put stickers on a map showing where their cameras were in relation to Flores’ school and the crime scene.
