He recalled to jurors seeing Josue lying face down in the grass with his backpack still on and bloodstains on his clothes. He said he flipped the child over and saw several stab wounds on his chest and neck. The officer described Josue as not being responsive and gasping for air but not seeing his chest move. He described the child's condition as "dire" when he arrived to the scene.

That officer did not turn on his body camera when they arrived to the scene, but his partner did. That video has not been shown in the court.

Another person who took the stand was a crime scene investigator. Jurors were shown photos of the crime scene, including one depicting a pool of blood on the sidewalk of Fulton Street in front of a home. The investigator testified that it was 23 feet from the blood on the sidewalk to where the child was found in the grass. Photos showed his zip up Marshall Middle School sweatshirt and his backpack right next to a second blood spot where the initial officer found him.

The jacket Jackson had on, said prosecutors, is the same green jacket that they said belonged to Jackson the day Flores was killed, which contained his DNA.

Wednesday afternoon, the prosecution in the Josue Flores murder trial called four people to the stand who were in the area of Fulton Street when the 2016 murder happened. Each of them had a different description of what the attacker was wearing.

"A man ran up and stabbed this kid," the witness could be heard saying to a 911 operator.

He told the operator that he had been stabbed in the arm and abdomen and noted that a police officer was driving by and had stopped.

His fellow bandmate said he saw the suspect throw the little boy into the grass as he ran north on Fulton Street. He too thought the suspect was just "roughing him up".

Defense attorneys took issue with the detailed account this witness gave in court on Wednesday in comparison to what he told police back when it happened. He was made to watch his interview with police captured on body camera during court and return to testify about an hour later.

He told attorneys when he returned that he did not feel comfortable telling police at the time. He did not end up giving officers more information until 2017.

Figueroa says when he ran into the street, the attacker ran away north on Fulton, and Flores fell on his stomach.

“I was like, ‘Hey kid, you alright?’” recalled Figueroa. “I didn’t think anything of it. I just thought he had been roughed up.”

When he saw blood and Flores didn’t respond, Figueroa said he told Hubbard to grab his gun and he called 911.

Today, prosecutors also brought a green jacket with distinctive lettering to court. They said it matches the one a man seen running from near the murder site was wearing. Surveillance video showed him running minutes after the attack.

An HPD homicide detective testified the jacket was hanging on a chair six feet from Jackson inside his room at a men’s shelter when he was arrested.

Jackson’s lawyer raised questions about the process to get the search warrant for Jackson’s room.

On Tuesday, the defense made the claim that they did not receive a piece of evidence, specifically details of what was recovered following the execution of a search warrant.

Judge Collins ruled that the trial would continue, but that one of the witnesses, Jimmy Turpin Lt. with the Special Crime Unit, would not be able to discuss the process to locate the defendant at the Salvation Army unless she approved the context in which the question is raised.

For the first time, we are hearing what accused killer Andre Jackson had to say to authorities shortly after his arrest on June 3, 2016, for the murder of Josue Flores. Prosecutors played the police interview for the jury on Thursday.

Jackson was heard repeatedly denying that he had anything to do with the young boy’s murder.

“This is so ridiculous! What makes you think I killed this guy?” said Jackson on the recording.

In the taped interview with police, Jackson said at the time of Josue’s murder he was looking for a Walgreens or Fiesta store before he saw something that made him run but wouldn’t tell the investigator what it was, claiming he was afraid of retaliation. He was concerned someone might hurt or kidnap him.

He admitted to investigators that he’s the man shown in surveillance images heading away from the murder scene but continued to deny accusations that he killed Flores.

When he was asked why he ran from the scene, he said he was afraid of retaliation.

"Wouldn’t you run if you just seen someone die?" he said in the video. "I obviously did not kill this kid."

Jurors listened and watched the entire hour and a half long interview on day four of the murder trial.

The lead HPD homicide detective was the 27th person to take the stand.

He recounted arresting and charging the wrong man in the days following Josue's murder. He said they used surveillance video and witness statements to corroborate his alibi. The detective spoke about two others they looked at as possible suspects but quickly cleared.

The next day he said they got a call from the owner of a Chevron on North Main St. The owner said the same man in the photos was in his store using the ATM on the morning of the murder. He recalled the distinct green jacket the man was seen wearing. Police were given a copy of his surveillance video and the transaction record from the banking machine.

Through a grand jury subpoena, the detective testified, that they were able to get records from Chase bank that linked the card used at the Chevron to Jackson.

In the recorded interview, Jackson identified himself as the man seen in the surveillance photos. He said he had been living at the Salvation Army for about a month at the time he was interviewed.

"These photos are part of the crime scene or what?" Jackson asked the detective.

Tanya Dean, a Texas Department of Public Safety DNA forensic analyst, testified the DNA on Jackson’s belongings was “inconclusive” when first tested. That’s why Jackson’s murder charge was initially dropped in 2017.

However, Sgt. Richard Rodriguez, a supervisor for Houston Police Department’s Cold Case Homicide division, testified he later had the sample sent to a Florida lab that had newer technology.

The mother explained to the jury that she rode in the same ambulance as her son to the hospital. She was in the front and Josue was in the back.

“When the doors opened, I saw my son with a very big tube in his mouth and I saw my son was dead,” Maria testified.

The jacket investigators said Jackson had on the day Josue was killed was the focus of a DNA Chief Scientific officer’s testimony on Monday.

The chief testified that 85% of the DNA belonged to Jackson, ten percent belonged to Flores and 5% belonged to an unknown individual, she said.

The day started with a high ranking member of DNA Labs International in Florida being called back to the stand first thing Monday morning. The witness said their lab was sent a quantitation list of extracts from HPD, how much liquid was in each tube sent, a little bit of case background, the Texas DPS testing reports dated July 10, 2017 and notes from a supervisor with the DPS lab.

She testified that they were able to get results from an extract of DNA from Jackson's sleeve cuffs that DPS had not been able to get conclusive results on.

Josue's mother said she was sick the day he was murdered. He had stayed late at school that day because of an end of the year science fair party.

A Harris County judge on Wednesday afternoon sentenced Andre Jackson to life in prison for the murder of 11-year-old Josue Flores.

Jackson testified at his sentencing hearing saying he was a devout Christian. He claimed he didn't see Flores' murder but heard the screams. He testified that he believes someone intentionally placed Flores' DNA on his jacket or that it was cross-contaminated in a lab.

Flores' family took the stand during the sentencing phase. His father, Juan Flores, told the court the family moved from their home in an attempt to move past that horrible day.
