Surely LE has BB's cell phone by now and has documentation of all (any !) calls to DV that night she returned to the airport.

My sneaking suspicion is that she knew full well he wasn't going to be at the airport, and why
 
@gitana1 if M is found deceased & someone was supposed to have M in their custody, but did not, can charges be levied against them?

I'm not sure. It depends I think whether there's a statute in Texas that allows charges for disobeying CPS orders they agreed to or whether allowing the child to be in the care of another somehow amounted to child neglect due to what the person knew.

Like if a mother knew her neighbor had molested kids and was on Megan's law list and allowed him to take her four year old who was thereafter raped and murdered,That would more than likely constitute child neglect. Reckless endangerment. Whatever law applies in the state.

Bottom line is what the person knew.
 
They had probable cause (head injury) to suspect abuse. The children were given to a different relative during this time. Then the children were given back to parents.

I think whatever caused the injury is irrelevant. It just makes any potential abuse after the fact potentially that much more dangerous. I see no definite reason to throw shade at the mother's actions or decision making at this time. And I ask anyone posting about past incidents or abuse by DV that the mother should have been aware of to link them.

On another note - I've seen a map but is there a more detailed map that shows their appt, the hospital, where he says he was jumped, the airport, and where the car was found?

We've pointed out the meaning and intent of that filing ad nauseam. I'm going to quit trying to address the issue until the media gets it right.

9pm 5/3 - DV assaulted and abducted at 69 & Greens Road.
?? Morning 5/4 - family reports DV missing to police.
3pm 5/4 - Nissan spotted by traffic camera near Cheesecake Factory (near First Colony Mall)
6pm 5/4 - DV "wakes" on the side of the road with son and Maleah missing at Highway 6 and Southwest Freeway (near First Colony Mall)
9-10pm 5/4 - DV arrives at Houston Methodist Sugar Land Hospital with son. He is treated for minor injuries. He was dropped off in a vehicle and did not walk.
11am 5/9 - Nissan found in parking lot at Highway 6 & Murphy Road

I was referring to mrsmmm's map. Sorry you can't access it. Not sure why as it opens fine for me. It is very thorough and has all areas of interest, apt, airport, hospital, mall, etc on it.

I've just been reading about depressive craniectomy, and the follow up craniotomy, and I am sadder than ever for her.
She had a major head injury where she was put under and a piece of her skull was removed, and she survived, and continued to survive for months - with a piece of her skull missing.
Then she goes back to surgery to have her skull flap replaced, and again, she survived.

And then... poof! She's gone. All that trauma and from the looks of it, she fought it out with a sweet smile on her face. And then some *expletives deleted* comes along and more likely than not, takes her out of the world.

It's heartbreaking. :(

  • DV was driving a silver 2011 Nissan Altima with TX paper tags 3092G9 to IAH with Maleah and her 2-year-old brother to pick up Maleah’s mother (“BB”), who was returning from her father's funeral in MA. [1] [2]
  • DV heard a popping noise and pulled over when a blue Chevrolet pickup w/crew cab, possibly a 2010, pulled behind him and two Hispanic males got out. One of them said Maleah looks very nice, looks very sweet. The other male hit DV on the head and he lost consciousness. [2] The Altima was allegedly stolen. [1]
  • When DV didn’t show up at the airport, BB called her mother, (“BB2”), to come and get her, but didn’t report DV and the children missing. [2]
  • DV was in and out of consciousness, but at one point he was in the back of the suspects' truck with his son and Maleah and then there were three suspects in the vehicle. [1]
  • Maleah was last seen approx 8 p.m. per the Amber Alert. [3]
  • BB did not have her house keys and spent the night with BB2 [11]
Saturday, May 4, 2019
  • BB told ABC13 they called police Sat a.m. to file a report because they were concerned they had not heard from DV, but detective clearly stated no report was filed [2].
  • BB2 explained that on Sat, they went to the PD again when nobody was contacting them and found out they had to fill out more forms, call the missing person’s unit, etc. [11]
  • 2:54 p.m. - The Nissan Altima was seen on a traffic camera near Hwy 59 & State Hwy 6 in Sugar Land. [1] [2]
  • 6 p.m. DV woke up on the side of the SW Freeway near SH 6 in Sugar Land, about 22 miles SW of Houston - near First Colony Mall. [2] His son was with him and he wandered around for four or five hours trying to summon help. [2]
  • 10 or 11 p.m. – DV and his son arrived on foot at Houston Methodist Sugar Land Hospital. DV and his son were treated for minor injuries, released, and police were called around midnight. [4] [5] From the mall to the hospital (.4 miles/10 min walk): Google Maps

  • Houston PD issued a press release at 6:57 a.m. [9]
  • Amber Alert was issued at 8:27 a.m. [9]
  • Amber Alert was updated to correct Maleah’s age; she is 4 years old
  • Houston PD press conference 12:18 p.m. [9]
  • Flyers were distributed and Oyster Creek Park at Hwy 6 and I-59 was searched by volunteers [6]
  • Neighbors said investigators were at the family’s apt on Kirkwood in Meadows Place on Sun, collecting evidence and talking to neighbors. [10]
Monday, May 6, 2019
  • Texas Equusearch (“TXEQ”) joined the search at 10:30 a.m. and requested volunteers on foot and ATV to meet at Eastex Freeway and Greens Road. [7]
  • BB was interviewed by ABC13 and said she is terrified for Maleah. [8]
  • TXEQ searched on foot and ATV near Hwy 59 & Greens Rd in NE Houston where DV said the assault/abduction took place. Tim Miller (“TM”) said, "We want to start checking every single dumpster just in case." [12] Later, crews were seen searching near First Colony Mall in Sugar Land. [14]
  • 6.p.m. Volunteers met in Sugar Land to hand out fliers with Maleah's photo. [13]
  • 6:30 p.m. BB and BB2 were interviewed by KHOU [11]
  • CPS said Maleah was returned to her home in Feb after she was removed last Aug when allegations of physical abuse were investigated. CPS maintained temporary conservatorship and visited the home at least once a month. BB said it was determined that the injury was caused by a fall. [18]
Tuesday, May 7, 2019
  • TXEQ searched near Hwy 59 and Greens Road, then suspended efforts there and moved to Bissonnet and Kirkwood, near the family’s home at 9850 S. Kirkwood. [15]
  • DV was named a person of interest in Maleah’s disappearance. Sugar Land PD (“SLPD”) said he changed his story, first saying he walked to the hospital, then saying someone dropped him off. SLPD is reviewing surveillance cam footage. [16]
  • Maleah’s biological father (“CD”) said he is searching the Brazos River for signs of the missing car. [18]
  • CD was interviewed for the first time and says he can’t control his emotions and has unanswered questions he needs DV to answer. [19]
  • SLPD said the photo of the Nissan came from their license recognition camera close to the Cheesecake Factory near First Colony Mall. [20]

  • TXEQ’s search was suspended due to heavy rains and flooding. [21]
  • Police released new photos of the Nissan Altima. [22]
  • HPD revisited Maleah's apt. complex [24]
  • TM flew over the Brazos River by helicopter looking for the Altima. [24]
  • BB and volunteers handed out flyers in the area of the family’s apt. and asked for more volunteers on Thurs [23] [24]
  • TXEQ requested volunteers to search on foot and ATV's in specific areas on Thurs for the Nissan Altima. [25]
Thursday, May 9, 2019
  • TXEQ’s search shifted to searching very specific areas for the Nissan Altima. [26] BB said she hasn’t spoken with DV in days, he doesn’t return her calls. [27]
  • Maleah has not been at daycare since April 26. The owner said Vence picked up his son Friday but Maleah wasn't with him. [28]
  • The Nissan Altima was found about 10 a.m. in a Missouri City business parking lot along Highway 6 near FM 1092/Murphy Road. [29]
  • DV and BB are banned from having any contact with any of their children. The ruling came during an emergency hearing Wednesday. [30]
