APR 26, 2023 - DAY EIGHT

CEDRIC MARKS TRIAL DAY 8: Whataburger Director of Asset Protections Ruben Olivas was the first witness to speak today. He provided the court surveillance footage of a white SUV going through the drive through around 1:15 A.M. January 3. An order receipt was also presented.

Cedric Marks’ former girlfriend Rebecca Adney came to the witness stand next. She owned the home on Mikulec Drive in Killeen which TPD processed for evidence.

The court went through Adney & Marks’ text messages from December 11, 2018 to January 8, 2019. Adney told the court she was in Wyoming during this period and said Marks was in Michigan. Adney mailed Marks her spare house key to pick her up from the airport in Austin.

In a text on January 1, 2019 Marks sent a message to Adney saying: “I used & hurt people & got away for a while….Remember who I am. I have no heart. I’m inhuman. I hope it hurts when they shoot me. I hope there’s a hell. I’m manipulating…”

In this same message from January 1, 2019. Marks says Adney deserves better. He won’t be seeing her again and to stop texting him saying he has a long drive tomorrow.

Adney told the jury she gave Marks money for his kids, she owned the White Toyota SUV that has been in question in the throughout the trial so far, and Adney also bought Marks a red jeep.

In the messages Mark couldn’t pick Adney up from the airport saying he tore his bicep and didn’t give Adney a time when he’d be coming back to Texas from Michigan.

Upon Adney’s return, she noticed a missing hand towel, a missing picture of Adney and Marks on her fridge, and her drivers seat pushed forward. She later noticed all of her trash bags were missing, her electrical tape gone, and her RAV4 was dirty inside, and mud on the wheels.

Before recess Adney identified what appears to be her vehicle being seen driving in Swearingin’s neighborhood on January 3 and identified what appears to be Marks in the Henryetta, Oklahoma Walmart surveillance footage.

UPDATE: Marks is now cross examining Adney. Prosecutors had to object to many questions Marks gave Adney to say they were self-serving statements.

The judge even had to ask the jury to disregard a few questions and answers Marks gave to Adney.

BREAKING: Marks was removed from court after using profanities with the judge and prosecution inside the courtroom after trying to get video footage authenticated.
 


The outburst came as Marks was trying to get evidence admitted in the trial. The evidence in question were personal screenshots and still photos of a video of Marks and Jenna Scott that Marks had previously tried to enter into evidence.
Rebecca Adney, who Marks was in a relationship with off and on for eight years, was the witness on the stand at the time. Adney told the court she saw the footage but did not personally see it filmed.
Despite Adney seeing the footage, prosecutors continuously objected to the way Marks phrased his questions to try and authenticate the evidence, leading to the judge asking Marks if he would like to take a break to discuss with his counsel how to ask the questions.
Once the jury was dismissed and court was in recess, Marks approached the judge, raising his voice and using profanity.
The judge said enough was enough, and had Marks removed from the courtroom for his behavior.
Marks' counsel will take over for the rest of the case.
I wish the jury would have witnessed his wrath! Wow. Just wow.

As of just before 2:50pm, Marks was cross examining Adney. Prosecutors had to object to many questions Marks gave Adney to say they were self-serving statements. The judge even had to ask the jury to disregard a few questions & answers Marks gave to Adney. As of just before 3:30pm, Marks was removed from court after using profanities with the judge and prosecution inside the courtroom after trying to get video footage authenticated. CEDRIC MARKS TRIAL DAY 9: Grand Rapids PD officer Joe Garret was first on the witness stand. He worked with US Marshals to arrest Marks at a mall in Michigan on January 8, 2019.

Michigan State Police Dect. John Forner came to the witness stand next. Forner tracked down where Marks, Maya Maxwell, and Janell McDonough were staying at on Palmer Street, Muskegon, MI. He helped conduct the search warrant and seized Marks Red Jeep and Maxwell’s White Subaru.

Forner gave Maya’s information to the Oklahoma State Bureau of Investigations for the excavation process to begin. After Jenna and Michael’s bodies were found, Forner did additional interviews with Maxwell and McDonough.

Forner also mentioned Maxwell voluntarily gave this information not being taken into custody.

Forner testified he received information in his interview with Maxwell the location where Jenna Scott & Michael Swearingin were buried.

Forner also testified seeing Janell deliver papers, photographs, and VHS tapes to the Bloomington, Minnesota police department.

The car search happened on January 10, and the background report paper had the time code of being printed on October 18, 2018.

In the search and seizure of Marks’ red jeep, Forner said there was a background report paper of Jenna Scott inside the vehicle.

Michigan Detective John McCaw is now on the witness stand. McCaw extracted data from Cedric Marks phone, Maya Maxwell’s phone, and Ginell McDonogh’s phone.

From Marks phone, McCaw was able to extract Facebook data with Ginell’s account attached, documents between Marks and Jenna Scott, and health documents from 1/10/19 for Marks torn bicep.

On Maya’s phone McCaw was able to extract location services data, Google searches on 1/5/19 for car washes, and an accuweather search for Henryetta, Oklahoma. On 1/9/19 there was a Google search for Temple, TX News. Call logs & messages between Maxwells and Marks were also taken.

McCaw said he was able to take a full data extraction from Ginell’s phone. He gathered Ginell’s calls and texts between her and Marks, Maxwell, and Rebecca Adney. The full extraction physically broke Ginell’s phone.

Court is now in recess for Marks to look over the thumb drives with his, Maxwell’s, and McDonogh’s phone data.

The morning of the trial started with the first witness, Special Deputy of the Grand Rapids Michigan Police Department, Joseph Garret. He said he was on the fugitive task force that arrested Marks on Jan 8, 2019.

Garret said the team was able to arrest Marks at the Rivertown Crossing Mall in Michigan by tracking his cellphone.

Sergeant John Forner with the Michigan State Police Department took the stand and discussed how Maya Maxwell, allegedly Marks’ accomplice, told officers where the victims’ burial site was in Oklahoma during her interview on January 11, 2019.

The Michigan Police Department’s detective sergeant, John McCaw, took the stand and explained how he was able to grab data from Cedric Marks, Ginell McDonogh and Maya Maxell’s phones through a software system called Celebright.

He discovered Marks and McDonogh’s locations services were turned off, but not Maxwell’s.

McCaw says Maxwell’s search history had “Car washes near me,” “Weather in Henrietta,” and “Temple Texas news” from January 5-9.

Then, state prosecutors brought up how Marks searched “How to block a cell phone’s data”, which removes it from the network on January 8, 2019.

Sergeant Casey Trucks of The Michigan State Police testified next.

He discussed how McDonogh’s office at the Natural Guard in Muskegon had questionable items.

Casey said McDonogh’s boss found a hidden suitcase filled with Marks’ paper work, MMA fighting license, a debit card and a loaded AR pocket pistol buried under clothes and towels.

According to Garrett, they found Marks at the Rivertown Crossing Mall in Michigan with a female named Maya Maxwell. Garrett says there was a coordinated takedown when Marks left the mall. He was the one who arrested Marks.

Garrett says his team knew Marks had a special skill set with a martial arts background, so it made the case a bit more challenging. Despite being in law enforcement for 23 years, Garrett told the courtroom, "That was the most tense I've ever been with a transport."


According to the reporter in the video, Marks is still representing himself despite being removed from the courtroom yesterday for his behavior.

Someone is wanting out of a subpoena and has filed a Motion to Quash which the judge will hear on 5/2. With the number of subpoenas in this case, there's no telling who it is.


Section 159.105 - Motions to Quash or for Protective Order(a) On behalf of a subpoenaed witness, a party may move to quash a subpoena or for a protective order. A party that moves to quash a subpoena must serve the motion on the other party at the time the motion is filed with SOAH.(b) A party may seek an order from the judge at any time after the motion to quash or motion for protective order has been filed.(c) In ruling on motions to quash or for protection, the judge must provide a person served with a subpoena an adequate time for compliance, protection from disclosure of privileged material or information, and protection from undue burden or expense. CEDRIC MARKS TRIAL DAY 10: Detective Forney has been recalled by the prosecution. Texas Ranger Adam Russell is the second witness to speak on the stand this morning. He helped Kelsey Kemp process Swearingin’s home, Adney’s home and her Toyota RAV4.

Russell testified he traveled to Oklahoma to help excavate where Jenna Scott and Michael Swearingin were located and helped transport evidence back to Texas. Russell even measured the distance from the burial site to Marks family plot at Northfork cemetery to be 703 yards.

From the gravesites, Russell received swabs from items placed at the camper site from the Oklahoma State Bureau of Investigation. One of the physical items Russel received was a Gatorade bottle placed inside the grave with Jenna and Michael.

Russell then testified going to Michigan to help Temple Dectetives Corey Powell & Ashley Cunningham collect evidence from Michigan State Police. Russell said he was also present for one of Powell’s interviews done in Michigan with Cedric Marks.

Prosecutors requested to speak outside the presence of the jury and said they have new evidence outside the discovery of Powell’s interviews with Marks’ family and friends after Marks attempted to escape in Conroe, TX.

Marks requested for these interviews to not be submitted into court saying Ranger Russell wasn’t present for these interviews and that it could cause jury prejudice for an act he wasn’t charged for.

Court is about to resume as Marks had time to review the extracted phone data from yesterday and interviews prosecution is trying to introduce into evidence.

In court this afternoon, Judge Steve Duskie is giving Marks and his counsel time to look over this footage, and is allowing Michigan law enforcement to be virtually summoned for Marks to recall.

In response, Marks asked the judge to squash the in-person subpeona for Ginell saying there's a transportation conflict for her to fly in from Tennessee leaving her kids by themselves.

The judge denied Marks request and asked Marks to work with his wife to make arrangements.

After this discussion Marks cross examined Texas Ranger Adam Russell who testified this morning. Under questioning Russell admitted he did not know the test results from the blood swabs gathered from Swearingin's home.

Russell also said he was unaware if DNA was gathered on the water bottle gathered from the burial site of Jenna Scott and Michael Swearingin.

Due the severe weather, Judge Steve Duskie ended trial early today to give Marks time to finish looking over the extracted phone data and video footage.

The day was cut a few hours short because of severe weather but started out with state prosecutors attempting to admit new evidence outside the presence of the jury.

The evidence includes four pieces of video and audio footage from interviews with Maya Maxwell, Ginell McDonough and Marks' family conducted by Temple Police Detective Corey Powell.

Marks has to review this information in order to prepare for cross examination of witnesses. ...

Marks says he wants to quash the in-person testimony for his wife because she cannot leave their children behind in Tennessee. Marks claims his wife is scheduled to be at the Bell County Justice Center for six days which will make things financially hard for their family.

The judge denied Marks' request. As of the latest, the jury will be hearing from McDonough next week.

Day eleven of the trial was supposed to begin at 9:30 a.m. in the 426th Bell County District Court.

Instead, Marks told Judge Steven Duskie he was not feeling well and would not be able to focus. Marks is defending himself against charges he killed his ex-girlfriend Jenna Scott and her friend Michael Swearingin in 2019.

Duskie asked Marks' standby counsel if they believed he was too sick to continue. They agreed he did not look well and would not be able to focus. Duskie asked prosecutors for a response. They agreed to continue the trial until Tuesday.

5/1/23 Monday, Trial Day: Marks told Judge Steven Duskie he was not feeling well and would not be able to focus. Marks is defending himself against the charges. Duskie asked Marks' standby counsel if they believed he was too sick to continue. They agreed he did not look well & would not be able to focus. Duskie asked prosecutors for a response. CEDRIC MARKS TRIAL DAY 12: Temple Police Forensic Detective Tom Wolf is the first witness to speak today. He received and extracted data from Cedric Marks’ devices, and also got limited info from Jenna Scott’s phone and Michael Swearingin’s tablet.

Regional Organized Crime Info Center Forensic Video specialist Kennedy Ring was the next witness to speak this morning. Per TPD Det. Corey Powell’s request, Ring clarified select footage from January 3 - 4 2019.

Ring presented the jury enhanced videos she worked on with magnified frames of Swearingin’s neighborhood surveillance, whataburger footage, Walmart footage, and footage from First Baptist church Temple.

In Ring’s enhanced Walmart surveillance footage it shows the man and woman who appear to be Cedric Marks & Maya Maxwell with the woman’s shoes resembling the same pair Michigan law enforcement seized when searching Ginell’s rental home.

UPDATE: Cedric Marks wife Ginell McDonogh, is now on the witness stand. The prosecution has now gone through Ginell’s messages and call log from Jan 1 - Jan 9.

In Ginell’s multiple multiple calls between Maya and Marks in this time period, Ginell says she doesn’t remember any of the conversations.

On the stand Ginell admits to lying to police in her first interview over Marks leaving Michigan to go to Texas. Ginell said she did this after being instructed by Marks.

Lastly, in Ginell’s direct examination, Ginell testified she knows the info she gave authorities led to the discovery of Jenna Scott and Michael Swearingin. Marks will cross examine Ginell in trial tomorrow morning.

Regional Organized Crime Info Center Forensic Video specialist Kennedy Ring was the next witness to speak on the morning of Tuesday, May 2. Per Temple PD Det. Corey Powell’s request, Ring clarified select footage from January 3 – 4, 2019. Ring presented the jury enhanced videos she worked on with magnified frames of Swearingin’s neighborhood surveillance, Whataburger footage, Walmart footage, and footage from First Baptist Church Temple.

As of around 3 p.m. on Tuesday, May 2, Cedric Marks’ wife Ginell McDonogh is on the witness stand. The prosecution has now gone through Ginell’s messages and call log from Jan. 1 – Jan. 9. In Ginell’s multiple calls between Maya and Marks in this time period, Ginell says she doesn’t remember any of the conversations.
