Colin says he has no idea how the black gun lock got on the gun. He can't recall ever seeing Armstrong with the black lock.Strickland says he can't really remember interviewing with APD on 5/17. He believes he spoke to Spitler about vandalism, but can't remember specifics.

Colin is answering the questions being asked of him, but has a similar attitude as we saw when he testified last week. Not necessarily uncooperative, but also not making it easy on the defense. Very short, annoyed responses. Relies very heavily on "I don't recall."

Next witness via Zoom: William Tobin, an expert on Firearms/Toolmarks.
Here is continued testimony after lunch recess.



Colin Strickland has entered the building.



Strickland is inside the witness room just outside the courtroom. Court is back in session with the state beginning its redirect of Mr. Tobin.Tobin says he did not look at any of the evidence in this case. Tobin says he is getting paid for testifying on behalf of the defense.


He is being paid $5,000 to testify. In 2022, Tobin says he testified in about six cases. Even if he doesn't testify, he still gets paid.


The state is asking about his experience and professional positions, dating all the way back to the 1960s. Testing his knowledge and expertise.


The state is reading word-for-word a publication from 1984 that Tobin had co-authored. The state is trying to show that Tobin's previous research is the baseline for which ATFE conducts its business of tool mark exams.


Tobin acknowledges that firearm and tool mark examination courses are offered at universities across the country, including his alma mater, George Washington University. He calls any class that offers a "forensic" approach a revenue-driver and has no basis in scientific reasoning.


Tobin has said the scientific community is universally behind him in his beliefs about the inconsistencies and shortcomings of the AFTE methodology. But the State is now reading word-for-word from journals and papers from several leading DNA experts, scientists and doctors who have published studies disagreeing with Tobin's assessments.


Tobin clarifies that the consensus he speaks about comes not from the entire scientific community, but from those who study firearms and tool marks.


State says it's going to try to wrap up in the next 10 minutes. Collective sigh of relief from the gallery.


State continues to quote word-for-word from various reports and papers. Even quoting from Tobin's own testimony in front of Congress.No further questions. Witness is excused. Everyone is happy it's finally over.

That's kind of a cruel twist of fate/strategy, that he'd have to say anything that might in any way support the defendant.

Guessing Kaitlin Kait Kai Allison Arie just can't let it/him go. Wants him to ... what I don't know... it's like a grovel now ... I can almost hear her, behind her pursed lips, mumbling, "admit it, you let that woman wear my helmet". As if there'd be some victory in that.

I'm over her.

The defense is publishing a muted video that shows the interview between Colin Strickland and APD on 5/17/22. You can see Strickland sitting with a baseball hat in the bottom left corner. Detective Spitler sits across from him, leaning forward. Strickland's lawyer is sitting to his right, but is not visible.The video is muted, but we can see Strickland showing Spitler pictures on his phone. He is zooming in and Spitler is leaning in, looking and nodding.Inside the courtroom, Strickland is watching the video on the computer monitor in front of him. Almost all of the jury members are doing the same, watching closely from their computer screens.Strickland, when asked, recalls that he is showing Spitler the vandalism that happened at his house.

The jury has just been handed a series of photographs that shows the vandalism. In the pictures, you can see limestones used for paving that are pushed over. Strickland says they weigh about 30 lbs. each.Strickland says his pushed-over motorcycle is heavy, so it would take someone with strength to push it over.Strickland says he showed those pictures to Spitler because it seemed relevant at the time.

It's on a kickstand, balanced. Easy enough to push it over. Not like someone would have had to have picked it up and repositioned it. MOO

Defense now pointing out Colin's fake alibi and pinning it on him, "that's a lie, isn't it?" That's correct, Colin agrees. Colin says he didn't give that alibi much thought when concocting it. Colin says he has deleted text threads."Were you fully honest with Moriah Wilson?" Defense asks."I did my best," Colin says.Witness passed.

State asking about when Kaitlin Armstrong came home on 5/11. Strickland says Armstrong was driving it and she did not say she was loaning it to anyone else.As for the helmet, Strickland says he and Armstrong both had their own helmets. Occasionally, Armstrong would wear his, but most often, she would wear her own.No further questions. Witness dismissed.

Well I guess they got him on that one. The text from that night about the flowers was a lie so he did lie but he really might not remember....he's tried so hard to forget that night ya know.
