Masters calls #BrandonDaniel's behavior that of an #addict. Based it on his drug use history and lab reports.

Indeed, the intoxication was voluntary and he knew very well what he did, even though this doctor says he's not reliable.

But, IMHO, they are trying to save his life.

From what I read about BD, he was out to shoot someone that night. To me, he seemed to take his time stumbling around in the Wal-Mart aisle, like he wanted to be challenged. I apologize, I've tried to catch up, but has his roommate Dante testified?

According to this article (if accurate) it appears BD loved challenging the police, dating back to Colorado.

State is now asking for a short recess before they start cross to review the doctor's notes.

Defense passes witness. State asks judge in #DanielTrial to review doctor's notes before cross examination.

MissSally, I don't think Dante, the roommate, has testified yet. I don't know if he is on a witness list.

Did the State just get the doctor's notes now? I thought that had to be given to the other side before trial?

Well, what should be done and what is actually done is not always the same.

Defense attorneys like to tell their experts not to write reports, so they don't have to turn it over to the state.

If the defense knows this witness's testimony will be involved and that notes will be part of it IMO it is unethical not to turn them over to the other side. I would think the attorney withholding reports/notes would be reprimanded by the court and if behavior continued sanctioned and or fined?

Dr Masters walking around the courtroom during the break, perhaps hoping he will get more airtime then his addiction specialist counterpart Dr. Drew.

He seemed to be the last one BD saw or spoke with regarding the Wal-Mart trip. According to Dante, BD was looking for trouble. He certainly didn't need to shoplift, from the looks of things.
