*Re-Arraignment Hearing (@ 9am CT) - TX – Army Specialist PFC Vanessa Guillén (20)(last seen sometime between 11:30am & 12:30pm on April 22, 2020 in the parking lot of her 3rd Cavalry Regiment Engineer Squadron Headquarters. Keys to her car & her barracks room & her ID card and wallet were later found in the armory room where she had worked earlier in the day; reported missing April 23, 2020, Ft. Hood military base, remains were found by contractors working on a fence along the Leon River in Bell County on June 30, 2020 in 3 shallow graves & the remains were sealed in concrete in Belton; ID’d on July 6, 2020) - *Cecily Ann Aguilar (22) – (Robinson’s GF) – arrested (7/1/20), charged (7/2/20) & arraigned & indicted (7/14/20) with 1 count 2nd degree conspiracy to tamper with evidence with intent to impair a human corpse, to corruptly alter, destroy, mutilate or conceal an object, or attempts to do so, with the intent to impair the objects integrity or availability for use in a criminal case & 1 count conspiracy felony tampering with witness, victim or informant & 1 count felony tampering with witness, victim or informant. Plead not guilty. Held without bond.
A federal affidavit released on July 2, 2020 says Robinson beat Guillen, with a hammer & that her body was later dismembered & burned. If convicted, Aguilar could face up to 20 years in prison with a maximum fine of $250K.
Trial set to begin on 11/30/20 with jury selection.

7/28/20 Update: Motions on Sept. 8, at which time Judge Albright could make a ruling on a gag order motion filed by Aguilar’s defense attorney on July 27. On Thursday, Assistant U.S. Attorney Mark Frazier filed his response to the defense motion, arguing that the gag order request is too broad in its scope. Sept. 14, 2020: The legal teams have until Sept. 14 to enter a plea bargain for Aguilar. Sept. 22, 2020: Should a plea bargain be entered for Aguilar, re-arraignment will be held on Sept. 22, according to court documents. Sept. 28, 2020: Aguilar is set to appear before Judge Alan D. Albright on Sept. 28 following jury selection.
8/17/20 Update: Judge Jeffrey Manske signed the order to deny the motion for gag order on Monday, ruling it was without merit.
9/8/20 Update: On 7/2/20 new charges were filed: Conspiracy felony tampering with witness, victim or informant & tampering with witness, victim or informant. 7/6/20: Waived right & consent to proceed by video conference. Financial affidavit by Aguilar is sealed. Appointed Federal public defender Lewis B. Gainor. 7/14/20: Plead not guilty to all charges. 8/7/20: Granted Motion for extension of time to file response/reply. 8/17/20: Order denied re motion for order prohibiting prejudicial extrajudicial statements as to Aguilar. Next re-arraignment hearing on 9/22/20.
9/22/20 Update: Judge Alan Albright ordered the trial to be reset after a request by Aguilar's defense team for extra time to prepare their case. The order continued: "The failure to grant such a continuance would unreasonably deny the defendant's counsel the reasonable time necessary for effective preparation, taking into account the exercise of due diligence." Re-arraignment hearing has been reset to 11/10/20 @ 9am & trial has been reset to 11/30/20 @ 9am per request of defense motion.
 
Alleged accomplice accused of helping hide Spc. Vanessa Guillén's body gets postponement

A Killeen woman accused of helping her boyfriend hide the body of Spc.Vanessa Guillén will not appear for an anticipated plea hearing Tuesday in Waco. A federal judge there on Monday granted Cecily Aguilar, 22, a postponement until Jan. 5 for her rearraignment, the first opportunity defendants have to change their automatic “not guilty” plea to “guilty.”

The request for a postponement, which is fairly standard practice, was uncontested by the prosecution.

Officials say Aguilar helped Robinson dismember the body of the Houston native and bury her along the Leon River. Aguilar initially told police she and her boyfriend were stargazing the evening of Guillén’s disappearance. Aguilar later confessed to investigators she helped Robinson dismember Guillén’s body with a bladed weapon and they attempted unsuccessfully to burn her remains, according to court documents. The couple then buried the remains and came back to pour cement on them, according to the documents.

Fort Hood to name one of post's gates after slain Army Spc. Vanessa Guillen

Army officials invited Guillen's family onto Fort Hood once again Tuesday, asking for their input on design concepts for a gate to be named after their beloved sister and daughter.

"The gate we designated leads to the 3rd Cavalry Regiment area where Vanessa served," a statement from Fort Hood officials said Tuesday. "The gate is accessed by thousands of soldiers, civilians and families every day."

Natalie Khawam, the attorney who represents the Guillen family, said on Tuesday that the family appreciates the gesture and the great strides the post's new top commander is taking to not only change the culture at Fort Hood, but also help protect and respect soldiers.
 
Ft. Hood to dedicate new memorial gate for Vanessa Guillen

KILLEEN, Texas -- Vanessa Guillen's family members said Fort Hood's plans to honor her through the construction of a memory gate is progress by the base.

Guillen family members were at the military base in central Texas on Tuesday where they met with Fort Hood leaders to provide input for the gate.

In a statement by Fort Hood's commanding general, Lt. Gen. Pat White III, Guillen's family was invited to "discuss and review design concepts and survey a proposed site of a gate we plan to name in Vanessa's honor."

White added, "Their input is important for our final design that will come to fruition over the next few months."

According to Lt. Gen. White, the gate would lead to the 3rd Calvary Regiment area where Guillen served.

It's also accessed by thousands of soldiers, civilians and families every day. The Guillen family added the memorial shows the new command at Fort Hood listened to their concerns.

"They paid attention and it means a lot compared to the first couple of months that we had to struggle so much to find her," said Lupe Guillen, Vanessa's sister.

During the press conference, Guillen's mother Gloria said, "I want justice in name of Vanessa Guillen. There had to be an innocent death for change. The president didn’t do anything. He lost and he didn’t do anything. He only lied. The secretary of defense didn’t do anything either."

I doubt it.

A potential lawsuit would have to be placed against the federal government. All levels of government, local, state and federal enjoy strong sovereign immunity from lawsuits.

At the federal level, that immunity is probably absolute. Thus, a meaningful lawsuit maybe impossible to place.

Governments can agree to enter into settlements for a variety of motivations, including fairness, avoidance of bad publicity, cost savings, and political pressure. Actually forcing them to pay a settlement, however, is extremely difficult and at the federal level, it could well be impossible.

I am also generally aware that it would be extremely rare, or perhaps never happening for the DOD and the various military branches to agree to pay settlements beyond the military death benefit as they would be subject to endless lawsuits for every training death and every battle death.

In the end, my guess is that the military is going to offer the active duty death benefit, then the matter will be financially closed as far as they are concerned.
