Wednesday, July 17th:
*Status Hearing (@ 9am CT) – TX – Scarlette Olivia Newsom (2) (Oct. 17, 2018, Dean; taken off life support after 5 days) – *Joshua Thomas Fulbright (23/now 28) “BF” arrested & charged (10/17/18), indicted (12/18/18) & arraigned (1/22/19) with 1st degree felony count of injury to a child resulting in serious bodily injury. Indicted & charged (1/13/22) on 1st degree murder all other charges are dismissed. $250K bond. Bond reduced (12/23/19) to $50K. Out on bond on 12/23/19. Posted $50K bond (1/13/22) with GPS monitor & having no contact with Newsom.
*Was rearrested & re-indicted (6/21/24) & booked into Wichita County Jail & charged (6/21/24) with Capital murder of a child under 10 years of age. Held without bond. Clay County. Trial will be held in Montague County/Tyler County court
Jury trial was set begin on 12/6/19 with jury selection, but were unable to find 12 jurors. Trial was set to begin on 3/25/20-cancelled due to COVID is continued on 8/22/22 for Jury selection. Will be tried in Montague County.
Trial was set to begin on 5/7/24 was continued on 11/12/24.

2/27/24 Tuesday, Trial Day 1/Jury Selection Day 1: Trial has been rescheduled on 5/7/24. Next announcement hearing on 4/15/24 @ 9am.
4/15/24 Update: Announcement hearing held. State's motion for continuance filed. 4/16/24: Proposed Order on State's motion for continuance.-granted. Next status hearing on 7/15/24 @ 9am.
6/21/24 Update: Fulbright was rearrested on 6/21/24 & was booked into the Wichita County Jail on Friday on a warrant issued from Clay County after he was re-indicted for capital murder of a child under 10. 97th District DA Casey Hall said the new indictment excludes the death penalty for Fulbright. She said she hopes to get the trial on the docket by late summer or early fall because she wants to finish this case before her term ends in December.
6/17/24 Docket update: Notice-The following case was reset from 7/15/24 to 7/17/24 @ 9am in the 97th Judicial District Court of lay County. Status hearing now on 7/17/24.
7/8/24 Update: Prosecutors will attempt for a third time to convict Fulbright for the death of Scarlette in Clay County in October 2018. 97th District Attorney Casey Hall said Monday the trial is set for 11/12/24 in Montague County on a change of venue. Fulbright was being held Tuesday in the Clay County Jail on a $350K bond. Fulbright was initially charged with injury to a child & released from jail on a $50K bond. When prosecutors attempted to try Fulbright on those charges in December 2019, the result was a mistrial because a jury could not be selected out of 80 potential jurors. In January 2022, a Clay County grand jury indicted Fulbright for a murder charge. A second mistrial occurred in August 2022 when Fulbright’s attorney, Mark Barber, was arrested on a drunk driving charge in Archer County. Barber has since resumed representing Fulbright. Fulbright was placed in the Wichita County Jail on 6/21/24 on an indictment of capital murder of a child under the age of 10 and was held without bail. He was transferred to Clay County on 6/28/24. DA Hall said the state will not seek the death penalty against him. A conviction would mean life in prison without parole. Hall said Newsom has agreed to testify against Fulbright at the trial.
