Monday, August 26th:
*Motion Hearing (@ 9am CT) - TX - Sherin Saraswati Mathews (3) (Oct. 7, 2017, Richardson; found Oct. 22, 2017) - *Wesley Mon Mathews (37) - indicted (1/12/18) on four felonies, capital murder, injury to a child (1st degree Felony), abandoning a child and tampering with physical evidence; was bond at $1M, now at $2.25M & reduced on 8/1/18 to $1.25M cash or surety. DA will seek DP.
Trial started 6/24/19. Jury selection was held week of 6/13. Jury is 4 women & 8 men. 2 female alternates.

6/26/19 Day 3: Defense witness: Wesley Mathews. Defense rests. Judge reads charges to jury. Closing arguments. The jury will be given their lunch and will have a "working lunch". Deliberations began at 12:15pm CT. Judge Amber Givens-Davis tells attorneys they will have FIVE minutes to return to court once they receive the text that the jury has reached an agreement on sentencing. At about 3:30pm jurors have a VERDICT. GUILTY-sentenced to life in prison. Wesley will be eligible for parole in 30 years & will be given credit for time served. Wesley's attorney said he may appeal the sentence.
7/15/19 Update: Files motion for new trial. Hearing set for 8/26.
For Sini: In a letter to the 282nd Criminal District Court, the Dallas County DA wrote that "after extensive investigation it has been determined that the state cannot prove this matter beyond a reasonable doubt at this time the state respectfully requests that this case be dismissed without prejudice." She has been released from jail.

Jurors deliberated for about 3 hours and verdict: Guilty and sentenced to life in prison. Will be eligible for parole in 30 years & will be given credit for time served.

8/26/19 Update: On Monday, Mathews’ attorneys argued that photos shown to the jury during that sentencing phase were graphic and they prejudice jurors against him. Prosecutors told the judge they were careful about the photos they chose to enter into evidence. Judge Amber Givens-Davis took the appeal under advisement, meaning she will spend some time considering both arguments. She said she will announce her decision on Sept. 5.

Wesley Mathews, the Indian-American foster father of 3-year-old Sherin Mathews, will continue to serve his life sentence after a Texas court denied a new trial in the tragic death of the Indian toddler in 2017, in a case that attracted much international attention. Mathews, 39, who was sentenced to life by a Dallas County jury on June 26 in connection with the death of his adopted daughter, was denied a motion for a new trial on Thursday, US media reported.

In June, Mathews pleaded guilty to injuring a child by omission. After the guilty plea, jurors decided his sentence of life in prison, a punishment he said he would willingly serve. Sherin was initially reported as being missing in October 2017 after her father claimed he forced her to stand outside, alone at 3 am as punishment for not drinking her milk. He later admitted she died when he “physically assisted” her in drinking the milk and got chocked. Sherin’s highly decomposed body was found 15 days later from a culvert near her home by a cadaver dog.

In the appeal, reported KRLD NewsRadio 1080, Mathews raised four points challenging the admission of certain evidence. In his remaining two issues, “he argues that his life sentence violates the Eighth Amendment and that the trial court denied his common law right to allocution,” according to the ruling.

All points were denied, according to the radio station.

“I believe the 5th Court has accurately talked about most of the facts in the record. I did not see anything that jumped out at me as a factually wrong statement.” KRLD NewsRadio 1080 quoted Mike Casillas, Mathews’ appellate attorney, as saying.

The case may still be appealed to the Texas Court of Criminal Appeals in the form of a petition for discretionary review, per KRLD NewsRadio 1080. But Casillas told the radio station that that has a less than 10 percent chance

He should be grateful he got off easy with a life sentence, especially in Texas. Sini too, neither of them are fully paying for their actions. moo
 
Thinking of Saraswati this morning, another poster brought up similarities between her situation & Natalia Barnett in Indiana.

Both young ladies let down by their adoptive families.

Thankful that Texas sought justice for Saraswati!

I only mentioned Sarasvati a day or two ago, on Gannon's thread. Poor baby. I hope her sister is thriving.
