Defendants who allege misconduct based on juror inattentiveness must show that:

  • the juror did in fact sleep or otherwise not pay attention during the trial, and
  • the juror missed important information that made it impossible to render a fair, informed, and impartial verdict.
Defendants should present evidence that a juror is sleeping or inattentive as soon as possible. Courts usually won't grant a motion for a mistrial or new trial if the defense knew that a juror was sleeping or inattentive but didn't bring it up until the end of trial.

While sleeping is the most obvious impediment to paying attention, problems also occur when jurors only partiallypay attention. For example, courts have found misconduct when jurors were reading, doing crosswords, writing letters, texting, and using social media. In contrast, momentary "dozing" and "head nodding" usually doesn't rise to the level of misconduct.
Again, as a former juror, in my experience if people did start dozing, the judge was pretty quick to notice if it happened, and would look for a good spot to call a break for us.

Also I thought one of the lawyer courtroom observers once mentioned that Juror A kicked Juror B's chair when the latter was dozing off, which seems a little potentially hostile until one remembers that these people spent 6 weeks together, and were probably pretty good friends by the time that ended. Juror B may even specifically have requested the treatment.

The actor, 58, was joined by his musician friend Jeff Beck, 77, and around 20 others in their entourage as they took over the chic Varanasi restaurant on Sunday night.

The group enjoyed a banquet of Indian food that had been specially prepared for them along with cocktails and Rosé Champagne.

(The owner sure had nice things to say about JD.)
Glad he had a good time. Probably felt a big weight lifted off his shoulders.
 
It's doubtful that a juror nodding off would count as misconduct. It's up to the lawyers on both sides of the case to keep the jury engaged, through the persuasiveness of their argument. If it had been particularly noteworthy, you can bet the judge would have made a comment cautioning the jury to pay more attention.

I think it could have something to do with them already knowing who the winner was going to be. Your body and mind are on high alert to record every detail in order to confidently arrive at a verdict. When that is turned down you are in a more relaxed state mentally. A big ahhhhhhhhh…
 
I watched Bruce Rivers (criminal attorney) YouTube video where he discusses the Depp-Heard post-verdict. He calls it like he sees it.

Thanks for mentioning this guy. I have not seen any of his videos. Just watched the one he did about EB's interview on CBS. Loved it.Boy, I had not seen that interview she did. She should be embarrassed. What a fool.

I believe it was in the 'extortion letter' from AH's divorce attorney that essentially said we were kind enough not to serve you divorce papers at your London Alice Through the Looking Glass Premiere, but now you have 2 days to agree to our terms or we're getting a TRO on you. So, yes, the cruelty was the point IMO.

And why is she making fun of him being in 21 Jump street? It was a huge hit show and he was a star because of it.

Meanwhile she was in a slew of silly nothing shows herself. She'd have jumped at the chance to be in 21 Jump Street.

Just like she made fun of him for 'sitting around playing guitar with other fat ol boring men' ----meanwhile Johnny is playing guitar and performing and recording with the most elite musicians in the world.

She is just jealous so she berates him.
I don't think jealousy was the only thing at play here. I think huge resentment popped in because I think she thought Johnny should have been out there promoting her and beating the streets to find her projects to pull her onto the A-list with him. When he had downtime he instead used it to catch up with friends, play music, read dozens of scripts that showed up unsolicited on his agent's desk. I wonder if she became so vile because she was angry he wasn't using that time to benefit her. Elevate her. Promote her.

But Johnny is not that guy. His previous girlfriends had all made it on their own talent and merits (just like he did) and I think he expected Amber to do the same. Get her own projects. Promote herself. Manage her own career. He wasn't interested in being her agent or manager. She had people for that. But I think she became increasingly hostile that he didn't use his power to pull strings for her, which is why she married him in the first place. She doesn't have a fraction of the talent required to acquire lead roles on her own and I think she got seriously irritable that he wasn't doing it for her.

When her marriage to him did not gain her the attention and roles she craved, she turned her venom on him rather than face the reality that she is a middle of the road actress and that's all she's ever going to be, no matter who she is married to. I think she still doesn't understand this. It's Johnny's fault Hollywood isn't beating down her door (in her mind) - when the truth is they never were. Not before she met Johnny. Not while she was married to Johnny. And not after she divorced Johnny.

The first I'd even heard of her was when she smuggled dogs into Australia. And that was only because Depp was involved. I had no idea who she was or even what her name was. The next I heard of her was the divorce. And I didn't even know it was the same woman at first. Even at this stage of the game I've never seen her in a movie. If not for him I would have no idea who she is, other than Johnny Depp's ex-wife. And she's 36 years old, not 22. I'm not saying it's fair, but as a female actress if you haven't made it in Hollywood by age 36 you're not likely going to.

I think she latched so hard onto Johnny Depp because she wasn't getting anywhere on her own and she needed him to get her there. It's probably the same reason she latched on to (or tried anyway) to Elon Musk. But that didn't work either. I think something very similar to this situation would have happened to whatever man (Depp, Musk or anyone else, male or female) who failed to indulge her entitlement and give her what she felt she was owed. The wrath and spite and revenge came out. Johnny Depp unfortunately became the target, but it could have been anybody in power, or who she thought had the power to help her, but didn't.

Johnny is not blameless for this mess, though. He left his very stable partner and children to have a stereotypical mid-life crisis and go chasing after a younger, beautiful woman. That was massively stupid and men who do this generally wind up the worse for it. As we see here.

Is Johnny Depp a risk taker? Yes. Is he sometimes reckless? Yes. Is he sometimes irresponsible? Yes. He freely admits all that. He always has. But is he abusive towards women? No, no I don't think so. He generally splits amicably from his girlfriends and even remains friends with them to this day. He's nearly 60 years old and had never been accused of abuse towards women until Amber Heard came along. When Amber made her accusations, women did not come out of the woodwork to say Depp acted that way with them, as well. Nothing. That is very telling.

Sorry, I'm just rambling at this point, so I'll just shut up now.

Could that be jury misconduct? Reason for appeal? Hope not. I wish it were addressed in the court room if it were an issue.
IANAL, but as far as I know, no. You cannot appeal an issue you did not raise during the trial. In general. If AH's lawyers raised issues of the jury sleeping/not paying attention/misconduct during the trial and were over-ruled by the judge, they could appeal that. But they never raised it, so are essentially out of luck with that point. This is the difference between good lawyers and not so good lawyers. Good lawyers will raise every conceivable issue and object to everything in order to get it on the record for future appeals. AH's lawyers did not do this as far as the jury is concerned, so the appeals court will likely not entertain it. IMO

An additional source recently told PEOPLE that Depp is "focused on himself" right now: "He is absolutely looking ahead and past this. He's looking for positivity and to move away from negativity." The source added that the actor is "happy" and "relieved" after the verdict.
