The Court of Appeal can overturn an acquittal if there has been an error in law.

I do not understand though. SO if they get a warrant for my house they can not search my dresser? Or my cupboards? The laptop was found in the car so I do not understand how that warrant did not cover it.

I'm not religious at all, but I'll be praying until the verdict comes in.

Have you read the studies where sick people who are prayed for do better than people who aren't, even when they don't know whether people are praying for them or not? I take that as evidence, not of any single God necessarily, but rather that there are things at work we don't understand.

Maybe the rage the better part of Canada is feeling right now will translate into energy that the jurors feel and act on. I hope.

I think the way the laws of search & seizure work Alison .. is that LE has to specify items of interest they are searching for in the warrant. If, during the course of that authorized search, they find something else that they believe could be or contained evidence of a crime, they have to get another warrant if it is not itemized on the original. Because they had no way of knowing what was on the laptop, they could not know that evidence would be contained on it, therefore their search was a violation under the Canadian Charter of Rights & Freedoms.
