Just curious what you all think...

The jury is made of of 7 men and 5 women.

Any guess on the gender makeup of the not guilty group of 6? :crazy:

I am not touching this issue with a 50 foot pole :floorlaugh::floorlaugh::floorlaugh:
 
I hate to bash the defense, but all I can think of when I recall Becky's cross of Jason, is "did you love your wife when you were having sex with .....and did you love your wife when......etc. etc. etc." And although I loved her point, I think she relied way too much on something that is clear to me, but perhaps not to the jury, that he NEVER talked to authorities until this trial. She put too much weight on that in her closing rather than dispelling the points of doubt the defense had raised.
 
I do not believe a unanimous verdict will be reached. I think this is headed for retrial. If it were one or two hung up, possibly, but 6, I just don't see it happening.

Will the judge call for a retrial if the jury remains hung 6 -6 ? or is it the DA who makes that decision?

I'm not familiar with hung jury decisions.

To be honest, I'm stunned by this development. LOL, you might say I'm almost speechless. Imagine that? :rolleyes:

It's up to the DA whether to file again.

I'm sure they will.

And if CW has an ounce of sense left in him, he'll reshuffle the state's team for the next go-round. Keep David S. for sure! Bump him up to 1st chair. Bumbling, paper shuffling, stammering 'ummm'ing attorneys should never be leading a capital case.
 
Was this trial a good representation of BH's talents? I ask because before the trial began, posters appeared to be really excited about her representation in this case. I thought she had some strong moments, but I was surprised given the build up. I was especially surprised by her presentation skills. Not only the ummms and uhhhhs, but her presentation often appeared disjointed to me.

It will be up to the Wake Co. District Attorney to make the decision to retry. Maybe we should start writing and calling him today.
 
Here are 2 pieces of evidence that have me scratching my head:

1. The daughter was found in a very clean state. If JY did this crime he must have left the house early AM and we know that the scene was not detected till much later. Anyway, if JY cleaned his daughter then what prevented her from going back into the room to try an assist her mother, ie., how did she stay clean for so long. This piece really bothers me to understand how the child stayed clean of blood for 6-7+ hours.

2. Video surveillance cameras at the hotel. When was the last time that JY was seen on the video camera that was disconnected. At what time was the video camera disconnected? Are there no video cameras showing a person approaching the camera that was disconnected?
 
I think most people had confidence going into this trial because this DA's office has a good conviction rate. They sometimes wait extra long to arrest the perp, to be sure they have sufficient evidence and there's no mess-ups! I was of that mind-set too!

Wow! Was I proven wrong! I thought for sure they had enough evidence to convict this guy!

I have never seen her in action before this case, and, like you, had read a pretty impressive take on her prior to the beginning of the trial. I was disappointed all the way around.
I have been totally spoiled by the 2 prosecutors in the Anthony trial, male and female, to the extent that I don't think I'll live long enough to ever see another as good as they are, individually, and as a team.

I don't know, but I was very impressed with her until the last few days. Something seemed to change and she seemed more reactive and less confident. Before that, I thought she was very anticipatory and proactive.
 
BH simply blew the cross, IMO. That's all. I apologize for being so adamant, but it's there & it is not going to disappear. That may not have been what did it for the jurors -- probably not -- but a couple of good hard questions might have given them a no-doubt about his guilt mindset. MOO.

You just don't let a person with this type hot-headed-ness and misogyny and let him get off the stand that easily. "What about this.... and this.... and this.... and this..." Oh, I was so disappointed that day. Such a let-down. :maddening:

Actually, the biggest problem I had was with Detective Spivey - IMO he totally blew it on the stand by not tying little pieces of evidence together to create an adequate picture for the jury. BH was somewhat guilty of this as well but Spivey should have poured out his 1,693 days of his life trying to solve this case. Sometimes you absolutely have to draw pictures and connect dots - it did not happen in this trial.

I think generally she had good questions, other than when she did the cross on JLY and I thought her closing was a bit weak. But if I have to hear "with regard to... um..." one more time, I think I might scream.:banghead::banghead::banghead:
 
One more thing:

We still don't know what the aff (or statement, or whatever) had in it that came from the person who did not appear. What was on that witness statement??? Is/was that a big deal? Or nothing?

I was wondering about that, but it wasn't mentioned in the defense's closing at all, was it? Seems to me if it had been that important, they would have mentioned it. Or the state would have tried to refute it in their closing.

I came away from Spivey's testimony feeling like he was a shy puppy. I was not thrilled either by his testimony nor his demeanor.
Maybe I have too much hell in me but I just detest watching people with important testimony, positions, ...... anything..... not showing fire and passion in what they are doing. I just want to shake them. Again, maybe I'm the one with too much passion but good grief I let it show when I need to.
In my next life I'm going to be a prosecutor, I swear.
