And you are right, no matter where ANYONE lives, these sentencing are a dangerment to everyone. It's funny (not really) that people in vermont blame another state for letting a sex offender get off on such a light sentence, when he ends up killing someone in Vermont, but they don't see the connection that THEIR perverts could very well do the same thing.

Thanks. The idea wasn't mine, and if there's interest- I'm more than willing to hand the keys over. I already spend a full day on my other sites ,add on my day job, and 3 angels running around and I've got a full plate. But I'm addicted to coding, so it seemed like a fun project.

Whereas, Judge Cashman also declared that after 25 years, he no longer believes in punishment, and

Whereas, in accordance with Chapter I, Article 6th, of the Constitution of the State of Vermont, all officers of government are servants of the people and are accountable to the people in a legal way, and

Whereas, the Vermont Constitution, in Chapter II, § 64 recognizes that punishment of long duration can serve as a deterrent to crime, and

Whereas, Chapter II, section 64 of the Vermont Constitution also requires that the punishment consider the protection of the victim and the reparation of injuries done to the victim, which was specifically rejected in this sentence, and

Whereas, while judges may disagree over the specific duration of a criminal sentence, the minimum 60-day sentence issued in this case is so short that it is beyond the bounds of any degree of reasonability, and

Today Vermont Judge Michael Kupersmith sentenced Derek Bushway to 3-5 years for assault and robbery.Kupersmith stated that he wanted to add punishment along with a drug program(Derek was a drug user.).Derek will do 3 years since he has some time served.The prosecutor was asking for 5-25 years.


Coopersmith said that more drug programs are needed.The rise in drug related crimes was brought up.

Is it the fact that drug offenders need punishment more than child rapists, or is it the fact that this is a different judge?
The way it is worded, I would almost guess that this judge is subtly offering a rebuke to one of his fellow judges. Making a point of saying he wants to see this offender recieve punishment as well as treatment.

Sorry,I spelled the judges name wrong,I just fixed it.Anyway,here is part of what was said;
((tape 46 tc 12:01 Judge Michael Kupersmith/Vt.District Court:"Drug problems are legion in our streets. Why don't we have an in-house program?")) Judge Michael Kupersmith used the sentencing hearing for 27-year-old Derek Bushway as a forum to send a message. Bushway was here to be sentenced for the armed stick-up of Ron's Shell in Burlington a year ago. It was the latest and most serious of the heroin-addicted Bushway's criminal career that has kept him in state and federal prisons and many rehab programs most of the last ten years. Prosecutors asked for the maximum under the plea agreement of at least five years behind bars."It's bad because it involves the use of a gun. I think it's clear theres probably heroin or drug addiction desperation but a lot of are in that situation and they don't takes guns and they don't rob stores or people.""This is a very disturbing crime, assault and robbery has the potential for great violence."The judge agreed the crime is serious and deserving of punishment -- but he sentenced Bushway to 3 to 5 years behind bars followed by long-term probation because there are no drug rehab programs for convicts inside Vermont prisons -- and only very short programs once they are out." Even if I were to give the defendant the maximum under the plea agreement which is 5 to 10 years I mean he'd be out on the streets in 5 years,or even less now, 'cause he's got credit for time-served and then we're back exactly where we are. In response Corrections Commissioner Rob Hoffman says the state prison work camp for low level offenders does have a substance abuse program. But that's it. There IS money in the Governor's budget for some drug treatment at the women's prison in Windsor -- but that still needs legislative approval. Kristin. But Brian there is a difference between this sentencing and Judge Cashman's? Yes.. notice that Judge Kupersmith included punishment in the three-year sentence .. .more than half the minimum the state was looking for.

I am not sure how they did it either.I thinkmaybe that there was enough room where you provide info to sneek it in.I think they did a great job!It was worth scrolling through the pages.

No, I knew it was a different judge. And I still wonder if the wording of his message might have been a quiet message to Cashman and to the citizens of Vermont.
After all, Cashman's whole point seemed to be that punishment was the wrong idea for sex offenders. What they needed was treatment.
Well this judge says drug offenders need treatment also, but he made a point of saying they also need punishment for the crimes they have already committed also. Wise judge.

Ya know, I think this is the biggest problem with repeat offenders- they aren't in drug treatment programs while in prison so within days, many times, within hours of release they are using again and once they use they are prone to re-offend. It's a vicious cycle and I, personally, think it's about time we begin preparing these prisoners for life outside of bars... in this day and age almost no-one serves their full sentence. So start them in intensive programs from day 1.

Teach them how to be productive members of society before they are released!

Brian Joyce was in the courtroom today for the case involving an armed robber with a heroin problem. Kristin, This time it was Judge Michael Kupersmith who intentionally shortened a sentence because there are NO drug rehabilitation programs for convicts behind bars -- and NO long-term rehab once they get out

The Cashman controversy has concerned citizens planning a big rally in St. Albans next Saturday. Judge Edward Cashman's 60 day sentence for a man convicted of sexually assaulting a young girl produced an uproar that has reverberated from the halls of the Statehouse to cable TV talk shows. Now, a radio host in St. Albans wants to organize a rally to let the people speak out. ((we the people are fed up with these lax child sex crime sentences. Our motto is hard time for child sex crimes. And basically, we are sick and tired of it. When somebody rapes a girl for 4 years and gets 60 days, it's crazy, it's unacceptable.)) Beaudry says he's inviting politicians--and candidates to speak at the rally at Taylor Park at noon on Saturday, the 28th.

So can I get your opinion on this that was on the sunday news.....
A bill before the Vermont legislature would give police more authority during riots .... At this Red Sox Riot in Burlington two years ago - police could not call it a riot. Under a 2-hundred year old law - only judges, sheriffs and deputies can declare events riots. Officers also want the law changed - because it gives them some legal protection if they have to use physical force to disperse a mob. A legislative committee is set to approve the bill Tuesday -- it will then go to the full Senate for a vote.

Do you think that all of a sudden 2 years later they want to rush this???
By the way,the bill was approved.............
Are they thinking that people are going to be mad saturday.

Beaudry, who began the show by playing Twisted Sister's"We're Not Gonna Take It," vows to offer a bipartisan roster of speakers at the event, ranging from St. Albans City Mayor Peter DesLauriers to – perhaps – Gov. Jim Douglas and Lt. Gov. Brian Dubie, who was Beaudry’s over-the-phone guest on Friday.

“What we’ve had is a tragedy,” Dubie said on the air, referring to Cashman’s decision. “We not only have one tragedy, we have two tragedies. … That poor girl was not only sexually assaulted by one criminal, but by two.”

Switching to pilot mode, Dubie, who is one, compared Vermonters’ reaction to the Hulett sentence to a plane crash, with anger changing to grief and mourning.

Dubie said he has made himself available to O’Reilly for an interview, but that Douglas has not. At his weekly press conference Wednesday, Douglas reiterated his suggestion that Cashman resign and encouraged the judge to grant the prosecution’s request for a longer sentence.
