“In my mind, at this point, it’s not even a close call,” he said. “So, respectfully, all counsel and all your witnesses need to buckle down and get ready. Yes, things may change, and going forward on Oct. 16 might ultimately prove impossible. But I doubt it.”

Kurtz said his opinion was “extremely unlikely to change.”

Before the judge stepped off the bench, Martin jumped in and said she wanted to be very clear about something: The court was putting her in a position where she would need to interview the state’s forensic witnesses without having time to consult her own expert. So if Miller is found guilty, the conviction will likely be overturned on appeal, she argued.

“What the court is asking me to do is virtually impossible,” she said. “… I don’t have any idea how the court expects us to get that done. So, respectfully, I’m asking to put that on the record, because I suspect this case will be coming back.”

“Thank you, Ms. Martin,” Kurtz said. “You have made your record. But, respectfully, get ready.”

Edmonds man’s murder trial in 1972 cold case to proceed after motion to suppress DNA evidence denied

Denying a last-minute motion to suppress DNA evidence by lawyers representing 78-year-old Terrence Miller of Edmonds, Snohomish County Superior Court Judge David Kurtz on Thursday ruled that this pivotal evidence may be presented at Miller’s upcoming trial.

Miller was arrested at his home in April 2019, and pleaded not guilty at his arraignment later that month. His trial was initially set for June 7, 2019. His legal team requested more time to prepare the case and was granted a continuance. The next week Miller was released on $1 million bond to await trial. Various subsequent continuances were requested and granted, with the latest trial call set for Oct. 16.

In this latest action, Miller’s defense team argued that the DNA sample from the coffee cup that linked Miller to the crime was obtained without his knowledge or consent in violation of the privacy guarantees under the Washington State Constitution, and should therefore be suppressed. Judge Kurtz rejected this motion, clearing the way for the evidence to be presented at trial.

Jury selection is set to begin on Monday [10/19/20]. The trial could last 10 days or more.

@Niner The defense filed a motion of Law Regarding Proper Scope and Purpose of Jury Selection. That is why the actual jury selection/trial isn’t happening. Looks like they are waiting on the State’s response and then the judge will rule and continue with jury selection. Remind me and I will check the docket tomorrow to see if it has updated.

@Niner I just checked the docket again. Last item is the Response filed by the State on 10/21 for that motion I mentioned. I’ll check again this coming Monday and Tuesday. There’s a chance that jury selection has begun but they’re not updating the docket. At least it hasn’t been cancelled or pushed out (continued).
