DNA on a boot: Trial opens in 1972 killing of Jody Loomis | HeraldNet.com

October 26, 2020

EVERETT — It was a different world in 1972.

The strip malls and subdivisions we now call Mill Creek were not even blueprints. It was all evergreens and farmland then, deputy prosecutor Craig Matheson explained to a jury Monday.
[.....]
Miller’s trial opened Monday in the same courtroom in the Snohomish County Courthouse, with Judge David Kurtz presiding. A few family members attended, having waited almost five decades for justice.

Defense attorney Frederic Moll acknowledged to the jury that Miller’s DNA was recovered from one of the boots. But he pointed out that deputies failed to wear gloves at the autopsy, that evidence was lost and mishandled over the years, and that the boot itself was contaminated with a lab worker’s DNA.
[.....]
Prosecutors listed 27 witnesses whose testimony could be put in front of the jury: eight detectives, retired police officers, forensic scientists and people who knew Loomis. Two of those witnesses have died, including the man who found her in the woods. His deposition was recorded as Miller awaited trial.

It’s a trial taking place in the midst of a pandemic. Jury selection was held last week in a spacious room of the Drewel Building, with dozens of potential jurors wearing clear masks and speaking into a microphone, to better keep their distance.

Good thing they wrote about it because the court docket still has a response by the state to the jury question motion on 10/21/2020 as the last item. They must not update the docket once the actual trial begins.

Some of these court sites hardly ever give "what is going" with the cases. I hate those!! Grrr.... don't they know we follow these cases??!! LOL!

I was glad to see that alert for Jody this morning - otherwise.... we wouldn't know anything.

I just searched for someone on twitter following the trial - and came up empty. Can you try @Suglo - maybe you'll come up with someone since your in the U.S.
Paldies! :)

Well - since it is in Washington - and I'm over here in Europe - with a 10 hour time difference... hopefully someone reading this thread will be able to give a synopsis on what is going on? :)

Or will there be a "replay" of this trial that I can see tomorrow?

The only tweet I found was by the Everett Herald newspaper. No one is tweeting about it as far as I can see. Here’s the link to the one tweet I found:

From link, thanks..rbbm.

''Years of detective work, advances in DNA technology and a pioneering pairing of that DNA evidence with public genealogy databases led Snohomish County deputies to the door of the Edmonds man in 2019.

Now the trial hinges on the question of whether the DNA evidence, in context, will be enough for a jury to find Miller guilty of first-degree murder.''

''Miller, who ran a ceramics shop with his wife of more than 40 years, has pleaded not guilty.''

''Prosecutors believe Jody Loomis was either forced or lured into the woods by Miller, who was then 30. By all accounts presented so far in the trial, Loomis and Miller did not know each other.''

''In light of the pandemic, the trial is being streamed on YouTube.

Witness testimony is expected to continue next week. Judge David Kurtz told jurors the trial is on schedule for jury deliberation to begin by the second week of November.''

from link..rbbm.

''Further testimony scheduled for next week will come from additional DNA analysts involved in extracting the crime scene sample and other samples (for example, that of Thomas Morris) pertinent to the case. It will also include evidence from recorded jailhouse phone conversations made by the defendant while he was incarcerated.

Proceedings will resume at 9 a.m. Monday, Nov.2 when the state will continue presenting its case. The trial will likely last at least through the end of next week and could take longer. Interested persons can follow the minute-by-minute proceedings via live-stream by visiting Courtroom Live Stream website and clicking on the link to Judge David Kurtz. Note that court live-streams are not archived and can only be viewed as they are happening.''

Plead not guilty. $1M bond reduced (5/31/19) to $750K, back (7/17/19) to $1M. Out on bond.

WA - Jody Loomis, 20, Mill Creek, raped/shot, 23 August 1972, *Arrest in 2019 DNA*

10/27/20 Trial Day 2 Tuesday: State witnesses: No info available yet. Trial continues on 10/28/20.
10/28/20 Trial Day 3 Wednesday: State witnesses: Jana Loomis-Smith (sister). Kenda Machorro (last person known to see Jody). One of those witnesses, Walter Morris, then 33, died months before the case went to trial. A prosecutor & a defense attorney questioned him last year in a deposition, and a video recording of Morris’ gravelly voice was played for jurors. Cathy Gogal Lenac (gf of Morris). (Morris & Lenac found Jody in the Mill Creek area in Aug. 1972). Linda Hook (neighbor). Witness testimony is expected to continue next week. Judge David Kurtz told jurors the trial is on schedule for jury deliberation to begin by the second week of November. Trial continues on 10/29/20.
10/29/20 Trial Day 4 Thursday: The state’s case moved to testimony from detectives, evidence room supervisors * coroner’s office personnel, who detailed how evidence – including pieces of the victim’s clothing & autopsy photos – was collected, handled, and stored. Pieces of this evidence were removed from the storage bags & presented as exhibits in the courtroom. This testimony told the story of how over the years the physical evidence from this case was moved from the original evidence room in the old Everett JC Penney building on Colby to a different facility on the county administrative campus, and how parts of the evidence log – the record of who had checked out & examined pieces of evidence – went missing & remain so to this day. On cross examination, the defense seized on this to point out that it opens the possibility that some of the evidence might have been compromised, and requested that it be excluded, a request that Judge Kurtz denied. Trial continues on 10/30/20.
10/30/20 Trial Day 5 Friday: Testimony included additional information from detectives & others who examined the evidence over the years. The final witness on Friday was the DNA analyst who prepared the most recent DNA profile from the sample extracted from the victim’s boot. Further testimony scheduled for next week will come from additional DNA analysts involved in extracting the crime scene sample & other samples (for example, that of Thomas Morris) pertinent to the case. It will also include evidence from recorded jailhouse phone conversations made by the defendant while he was incarcerated. Proceedings will resume at 9 am Monday, Nov. 2 when the state will continue presenting its case. The trial will likely last at least through the end of next week & could take longer.
