Cobra? I was under the impression he isn't even allowed to go back in to Putnam County..
I fully realize what I am going to say in not a popular opinion, but I'm thinking Cobra may have gotten just a litte too close to uncovering some illegal activites concerning LE in Putnam County..Cobra may have found out a little too much that caused some concern for LE... JMHOOTS

I recall the 3 hr. time block Fields requested.
I can't recall anything about a secret or surprise witness for the sentencing phase, just the trial.
A link to the information you stated would help.
Also, Misty's sentencing date has been moved up 2 wks. Does that mean Fields doesn't need as much time to prepare?
What good would a surprise witness do at a sentencing hearing where she pled no contest to 7 drug trafficking charges? Even if she does get the YO in PC she is going to get 25 yrs. on the charge in SJC. Her ship is sunk.

My take on Fields and potential witnesses on Misty's behalf would be for his hope to show that Misty should have YO status to negate the requirement that she be sentenced under the minimum mandatory laws. Under the statutes Misty may qualify but given the number of charges she might not be considered for YO. Any witness Fields brings in might testify to the type of personality Misty is, how her lifestyle did not evolve over time but was a way of life for her family even before Misty was born, etc. Basically, how people born into this lifestyle do not have a chance from the get-go, that kind of thing.

I am not saying I agree totally with that assessment, or that Misty should not have seen the error of her ways a while ago. Misty clearly knew right from wrong, hence her lies to avoid consequences for her actions, but a good therapist who deals with people like Misty might be able to score some points for her in court. JMO.

ETA: Even if Misty got YO in one county and thus could not get it in the second county, having YO status would be desirable anyway. She stands now to possibly serve out at least two separate 25-year terms; YO status in one county could mean serving one 25-year stretch (since in Putnam even if she gets the minimum for all counts, she will serve concurrently) plus whatever minimal sentence she gets in the YO county. IMO the best route would be for Fields to go for YO in St Johns...she stands a better chance there with only one charge and Putnam would then be concurrent. Again, JMO.

I would think the surprise witness would be someone of quality, a person who is trustworthy and has some standing in the community. I doubt any of the co-defendents in the drug sting would bring anything of worth to Misty's aid when it comes to the judge deciding her sentence. Who does Misty know who fits that description?
I'm looking forward to other posts in this thread as to who that person will be.

Her liablity or abilty to be a ringleader or mastermind may be less likely based on those factors. Impressionable, Irresponsiable and Inmature might make her do things or be intimidated to do things that are illegal but not understand the outcome of those actions.

She may fear someone more then she fears jail and that someone told her who what and where to deal, sell and handle the "business" she was a part of.

A quick disclaimer: I am not looking to excuse anything or anyone!

Just wondering if it would play a factor in her legal liablity rather or not she will get YO. Or possiably a reduced sentence due to any factors>

I fully support your impression here and I believe that Cobra was set up just for that very reason. Tim Miller was another one who did not stay for very long. I'm still wondering what he meant with the "it's not as it seems" comment. Getting off topic so I'll move on.

i think the witness would be a psychologist or someone that could testify to the fact it wasnt misty.s deal and who my have talked her into doing the deal. she seems like a person easily led shes almost like a door mat to me..

Anyone remember when a young woman told Tim in the bar she saw Misty out that night? She was afraid to say anything because she was on probation and might go to jail if her PO found out. Another thing I was thinking is someone from Hank SR's side of the family will tell how Misty's family lived and may have witnessed abuse when she was a child. IMO they probably helped H & L and had to realize it was useless to keep helping them. Hank's side of the family is laying very low and staying out of the limelight. IMO someone from that side could have made some money if they wanted to from this mess.

The only one I can think of is Nay. I have no idea where they are storing Nay and Amber but they are not around. The last two court dockets for Nay could not be served. Did she join the Witness Protection Program?
