'Bennet, the baby's great uncle...first met Smith on Thursday night when...he found her, his mother, and the baby's mother and father in his house...mother..explained that Marshall and her step sister had the same mother but different fathers.'

'Smith appears to have multiple names and has had run-ins with the law in multiple states'

'The baby's bassinet was 2feet from the parents' bed and he found a paring knife on the ground next to it'

The family relationships are confusing me. The paring knife isn't so much. It's only my opinion but I'm very glad mom or dad didn't wake that morning and ask, "What are you doing with my baby?"

BBM. The other way around zwiebel

He said his mother later explained to him that Marshall and her step-sister had the same father but different mothers.

Smith appears to go by multiple names and has had run-ins with the law in multiple states, authorities said. The Texas warrant stems from a felony indictment charging her with tampering with government documents late last year while she was in jail in Colorado.

A spokesman for the Arapahoe County, Colo., sheriff’s office declined to discuss the details of her arrest there. A spokeswoman for the district attorney’s office in Tarrant County, Texas, said it’s not clear why Colorado authorities released Smith instead of sending her back to Texas.

I'm just as confused about how a person tampers with government documents while in jail.

I read an article about a prison escapee who tampered with his release documents and convinced the authorities to release him four years early.

But on another note, the Washington post article makes clear that police searched KS' cell phone and from there accessed her facebook account and her email account(s). I wonder if she consented to a search of her cell phone. I remember a great deal of concern about warrantless searches of devices. It would be a shame if that data was made inadmissible should this go to trial. Then again, perhaps without examination of the cell phone they wouldn't have found Kayden. Legalities.

God Bless baby Kayden, this is truly a miracle that he is alive after being outside for so long. xo

BBM

Yes KS consented to having her cell phone searched.

From the complaint filed against KS.

10. Investigators from the FBI and the state of Iowa questioned Smith regarding the whereabouts of the missing infant. Smith denied any knowledge of the child's whereabouts. Smith consented to a search of her cell phone, her Facebook account, and her car.

I think KS placed Kayden in the tote with the intention of returning for him after speaking with the officer. But due to the warrant she was taken into custody.

The part that I think is missing from the complaint is that someone must of contacted KS by phone prior to KS calling BM's grandmother. Likely BM made a call to KS asking if she had taken Kayden. Why would KS call BM's grandmother that early in the morning out of the blue?

At 4:54 KS called BM's grandmother and was instructed by the officer present to pull over so LE could locate her.

Then KS must of called LE back at 5:21 after placing Kayden in the tote at the BP station and said she was at the K&G station. When an officer was pulling into the station and she was instructed to "flag down" the officer which she did.

That gave KS 25 minutes to hide the baby from the time she was initially talked to when she called grama's home and when she contacted LE telling them she was at the K&G station.

I don't agree with the way this was handled. Obviously the officer asking KS to pull over so she could be located by LE caused KS to hide Kayden. I think the officer should have asked if KS had the baby, when she said no that should have been the end of the conversation. I'm assuming this was just a patrol officer and not a detective but it should have been assumed that Kayden was with KS and asking her at will to contact LE knowing she possibly had Kayden in her possession would have caused her to dispose of the baby.

KS's location should have been pin pointed by pinging her cell phone so her movements could have been tracked westward along I-80. LE could have then set up ahead of KS and conducted a traffic stop or surveilled her in an unmarked vehicle until she pulled over at a gas station where contact could have been made and Kayden would have been found in the car unharmed.

It didn't take a rocket scientist to figure out who must of taken this baby. I was 99.9% sure KS would be implicated in his disappearance right from the start. I'm sure most of you that followed the case thought the same.

Can't find link ATM... But IIRC Brianna called KS to see if KS had Kayden prior to Brianna calling 9-1-1...and... Of course, KS told Brianna she did not have Kayden...

but... I wonder if that alerted KS to call grandma at that seemingly coincidental time when LE was at the home?

and, IMO... The call that (I think) Brianna made to KS asking if KS had Kayden would have alerted KS that the LE would be "on her heels"...

does anyone else remember this in any reports?

:dunno:

Wondering if any contact has been made with Brianna's father to verify KS story? IMO KS is telling a big lie and knew the father had no contact with BM therefore the truth would not be discovered.

Such a sad story that Surprisingly had a happy ending! Maybe this will bring this family together.

I bet Brianna is cuddling that gorgeous little man tight today. I'm so happy they have a happy ending, it could have been tragic so quickly.

I'd like to know what Brianna's dad has to say too 1&2&3, I won't fall over with shock if it turns out there is no relationship between them.

From this.....I take it that she did not even admit to anything or tell LE where he was until after LE found the boy.

Like maybe after they found the boy, they knew she was guilty and then went to interview her again and applied all kinds of pressure on her to get her to confess, and only then did she finally give in and admitted things and even drew a map. LE needed that confession so they can prosecute her, but they may have found the boy on their own right before that last interview. I dont think they had any map before he was found.

Thats my take on how I read this.

Oh... Good point...

I just had assumed she made the map prior to LE finding Kayden...

KS is one sick person...

Hopefully this horrible experience will mend some of the family issues. Mom daughter and bf.

I do hope the same...

I imagine that Brianna may have been emotionally "hungry" for a supportive, caring "mother figure"... KS probably knew this... And played into Brianna's vulnerability...

Maybe the husband is fake too.

Regarding not seeing comments on FB about her being pregnant, maybe LE could see things on FB that we could not due to privacy settings.

I am really thinking husband is bogus, too!

:waitasec:

it appears KS got married in July 2013 so if her due date was supposedly Feb.5th, is it possible she trapped dude into marrying her because she was supposedly pregnant?

the dates match if she supposedly got pregnant in June and they then had a quickie wedding

that's my theory anyway ...

Honestly, we completely lucked out here.
If Kristen had left Kayden in a duffel bag instead of a plastic tote... he would be dead right now.

Kristen should have told LE where he was immediately.
However, when she didn't... LE should have searched that area immediately.
They KNEW that she had him with all the evidence they had in her van. They KNEW.

I hope they review the way they handled this and handle it differently if there is a next time.
Just because it turned out okay this time, doesn't mean it couldn't be handled better next time.

She could have just as easily strangled him and dumped his body when she got that phone call from LE.
This could could have ended SO badly in so many ways. We are so lucky that Kayden is okay. :seeya:

Your kidding me.....right?

I guess THANK YOU so much Kristin Smith for putting Kayden in a plastic tote and not a duffle bad so that LE could "luck out".

There will always be someone who bashes LE for not doing a good enough job when in fact LE did a much better job this time then I've seen in a long time when it came to a missing baby. I guess they better talk to all them cops and tell them that they only lucked out...next time they can do better. I guess we better review what they could do better next time instead of realizing they DID something that WORKED for once. Please. Give me a freaking break.....
