Respectfully, IMO it does. GZ walked up to Tray, he was not forced to, and he already called him a suspicious person. He should have remained in retreat since he was in a public place and waited until LE arrived. He was not in his castle. SYG expanded the castle grounds.
If GZ started the confrontation and was the initial aggressor, then it does not apply to him per Florida law.

If Martin started the actual confrontation and was the initial aggressor, then it does not apply to Martin.

If either of them started the confrontation, and the other was the initial aggressor, it becomes much more hazy.

I believe the contention here is that merely following someone from a distance does not meet the reasonable standards for aggressive conduct. What happened during the actual confrontation would determine who was in the right and who was in the wrong.

I'm having a problem visualizing this. He was holding a cell phone, holding a bag of Skittles and an Arizona bottle of ice tea. How many hands does he have?

Don't forget he had his hand in his waistband and he had something in his hands. LOL

One guy against how many other witnesses? There was a woman in the 911 call who said that Trayvon was yelling help.

Not a single person on 911 call that we heard claimed that Trayvon (how in the world would they know his name) was yelling for help.

What does being fat have to do with how hard he would have to be punched?

I don't understand that.

Takes a bigger force to knock him over unless KO

She never saw anything until after the gunshot and the screams stopped. Her saying Trayvon was screaming means very little.

Not necessarily.

If GZ was acting in self defense, TM would not be considered a homicide victim.

That's like saying if someone attacked me and I killed them, the attacker is a homicide victim. That's just not true.

My friend, you are mixing up the legal definitions of "homicide" and "murder."

Every intentional killing of a human being is a "homicide" (including capital punishment), but not all homicides are murder.

In your examples above, you are talking about "justifiable homicide", which is also the issue in the Martin/Zimmerman case.

Can you make sense of why TM punched the bus driver?A day or two before this happened.

Why are you asking?? Why does it matter?
Should the bus driver have stood his ground and killed Trayvon?

I presume his cell phone was in his hand since he was on the phone.

You think he felled someone with one blow and then jumped on him and beat the carp out of him with his cellphone in his hand?

  • #589
That's just plain wrong!

Most of what is being done is wrong.Police were not done everyone needs to let all the facts come out.You can not incite violence like this it is insane. The family wanted it taken away from local police and it has been. Then they said they want GZ charged and arrested,Now it is charged arrested and convicted.IMO It is a witch hunt at this point. What will happen if DOJ finds GZ was in the right,he was attacked and he had a right to defend himself? What then riots? That is not Justice at all it is revenge IMO.

If we are talking about Mary C, that's exactly right. She doesn't claims to have seen who was screaming.

So to all who think SYG applies to GZ.. Let me ask this why doesnt SYG apply to TM?????? No one has attempted to answer and it has been asked a few times on this thread...TM could have cliamed a SYG defense but he was murdered....

IMO,JMHO AND ALL THAT!!!!!!!!!!!

It is like winner takes all.

Oh OK my bad.

People are claiming violent acts years ago somehow indicate Zimmerman is a violent, loose cannon.

A violent act days before this incident would do just the same. There's no evidence to back up the claims of a bus fight, however.

She knows Trayvon? Did she say this on the 911 call or after, three or so weeks after?

Mary Cutcher said she hard a child crying right in front of her porch, but she said, no one was fighting. A man calls 911 and says there is fighting right by his front porch.

LE says Mary Cutcher's public version is different than her sworn statement.

It is like winner takes all.

I tend to agree. I support self-defense laws if a person is in their house or car. But when these type of laws are applied to people fighting on the street I think it's too much.

Exactly

Can someone please post the diagram/map of the locations where the murder, etc. took place. I know there is one posted but I can't find it. TIA!

If we are talking about Mary C, that's exactly right. She doesn't claims to have seen who was screaming.
In fact, she claims she only heard "childlike whimpers" and then a gunshot, which is contrary to every other report out there. You can even hear the screams on 911 calls made multiple houses down. How she took that as "childlike whimpers" right outside her window, I'll never know.

You know what really makes me want to :banghead:?

What the he77 else was GZ going to say??? Of course he's going to say it wasn't his fault! Of course he's going to say it was all self defense!

He's standing there, just having shot a kid, what else was he going to say, yeah I'm guilty lock me up and throw away the key??

The problem is, nothing shows that either one was the aggressor at the moment, except witness testimony that places Martin on top of Zimmerman, beating him, as Zimmerman was screaming for help. That still doesn't indicate who made the first aggressive move, though.

And no, following someone from a distance is not aggressive conduct and there's no evidence to substantiate Zimmerman did anything but this, before we go down this path.
