Amazing! 'Crushing his nose into his skull'. If the nasal bone broke and was pushed into his skull, it could have penetrated the floor of the frontal lobe of the brain. If this bone was pushed in at all, GZ would have most likely required surgery to return the bone to normal position and secure it to prevent future injury.

That bit about his breathing is also a whole bunch of carpola....since any EMT worth his salt knows the medical ABC's...Airway, Breathing, Circulation....your first duty is to make sure there is an unobstructed airway and that the pt can breath...That is standard, since if you can't breath or breath well then you could DIE....No EMT is going to clear him to go to the Police station for questioning if nasal swelling is impairing his breathing....I don't believe that for a nano second. IMO JMHO and stuff.

Same rhetoric - with a dramatic flare. Piers isn't letting him off easy, though. Go Piers!

Do you think zimmerman is being paid for this appearance?

Mark O'Mara is on with Laurence O'Donnell

The issue wasn't really if it would be a double jeopardy because the cops let him go but if it would be double jeopardy if they had several different charges in the trial (2nd degree, manslaughter etc.)

Sorry if it was unclear.

With respect, I don't believe that's necessarily true. I've been a juror on a trial where we were given an option of 2nd degree, voluntary or involuntary manslaughter. "Lesser included offenses" are common and do not constitute double jeopardy unless they are charged and tried at different times.

Oh please tell me that someone asked him how he made that horrible screaming cry for help with someone's hand covering his mouth....

And apparently he is just lying there allowing Travyon to do this, since I am reasonably certain that I, an old lady who weighs in at right about what Trayvon did, could manage to throw him off of me without shooting him...

No somehow this won't wash either, but be on the lookout for there to be some indication that somehow the gun just went off, setting stuff up for the accidental discharge defense IMO JMHO and stuff

It was made with his last remaining breath before Trayvon was about to take his life. Uh huh...

As to the mug shot, board is moving fast, but does anyone else think he looks thinner than the security footage from the police station?

I also want to say, that I am so pleased that he was arrested and charged. That's all I have wanted all along. I wasn't there that night, so I can't say without a doubt what happened (although I have my theories - overzealous man armed with a loaded gun and stereotypes), but that is what a jury is for... Jmho.

O'Mara on Lawrence O'Donnell.

I think GZ's attorney is a pretty sensible guy...Much less inflammatory than the previous attorneys...:twocents::moo:

Bwwahhaahhaaa....just gotta interject and say that I was so busy at work today I was only able to read the general headlines of today and CANNOT wait to get home to watch any available video of today's presser(s) and catch up with all of you!!!

I was expecting manslaughter, not 2nd degree murder! My word! See ya'll in a bit!

That is a common technique instructed by attorneys....to make him appear smaller and less threatening or able to protect himself. Like having a client shave their shaggy beard or cut their hair. Or have a woman tone down a very blond hair color or make up to make her look more girl next door.....

They were speaking about exactly that on one one of the shows tonight.
Manslaughter being a lesser included offense in this case.

JMHO

Uh Huhhhh yes, with his swollen nose making breathing difficult and while swallowing copious amounts of blood, one of my neighbors just texted me that he claimed that the nose was broken and that George was swallowing a lot of blood that never got on his shirt or jacket...She also said that when given a chance to say something to the Martins, instead of any kind of sympathy for their loss of their son, he bloviated on how much his family has been devastated and how much they have lost, being afraid to walk the streets and the loss of his brother and such...what class :>(

by the courts through cases. This law is fairly new so I don't know what well established case law there is on it. But there's a lot you can do to eviscerate a law through how it is "interpreted" by the court. For example, a case could establish that if you, say, choose to pursue a person who you have already assumed was an armed criminal and against the advice of the 911 operator YOU called then you aren't able to invoke SYG. Something along those lines. A lot will depend on the actual evidence as to whether SYG is even an issue-that will be decided at the hearing to determine whether GZ is immune from prosecution based on SYG. Beyond that, I honestly don't know how it works, i.e. if the hearing determines he's not immune than does SYG still act as an affirmative defense? No clue-never done criminal work so a little beyond me.

This might help a little on the process:

What happens now that Zimmerman is charged in Trayvon Martin death?

http://news.blogs.cnn.com/2012/04/11...ath/?hpt=hp_t1

Excerpt:

Step 5 – Defense files a motion to dismiss based on Florida's “stand your ground” law

•If Zimmerman is charged, he is entitled to a pre-trial evidentiary hearing on whether he is entitled to the immunity based on the law. [before a judge only]*

•The burden at that hearing is on the defense to prove by “a preponderance of the evidence” (more likely than not [that is the standard of proof]*) that Zimmerman was justified in using deadly force.

•In Florida, an individual can use deadly force anywhere (with no duty to retreat) as long as he/she:
1.is not engaged in an unlawful activity;
2.is being attacked in a place he/she has a right to be; And
3.reasonably believes that his/her life and safety is in danger.

•The judge decides whether Zimmerman’s actions were justified, and therefore entitles him to the “stand your ground” immunity.

1.If the judge finds the force was justifiable, then the charges are dismissed and Zimmerman is immune from further criminal prosecution and possibly, civil liability.
2.If the judge finds the force was not justifiable, then the charges against Zimmerman move forward.

• If the judge rules Zimmerman is immune, the prosecution can appeal that decision to a higher court.

And remember, GZ father also stated that GZ never got out of his car and confronted Trayvon.

Hopefully GZ new lawyer will put a stop to these media interviews.

If he's smart he'll shut them all up. In the meantime, I'm rather enjoying all the inconsistencies.

Yay! Good for him. It's about time someone from that side vocalized acknowledgement of Trayvon's parents loss.

I'm so relieved a charge with real meat on it has been leveled. But I shudder now to think of the amount of money the NRA is going to flood into GZ's defense fund. This has to be their worst nightmare....I fear getting justice for this teenager is going to be a monumental task when challenged by the lobbying efforts and financial backing of the NRA. Mustn't interfere with their bottom line---SYG supports their frontier mentality and they've put so much effort into fomenting people's fear......I'm so glad that the Martin's can go to bed tonight with the hope that their baby's death will not have been swept under the carpet. I just don't have much faith that in the end GZ will get his just desserts. He is already a martyr to many.

  • #578
Does anyone know if he can still invoke SYG in regards to a minor?

To invoke SYG now would be a huge mistake. SYG only works if you killed someone committing a crime or at least someone with a criminal record and preferably armed.

To invoke SYG in the killing of an unarmed person who has no record and was not committing a crime is to admit you never gave this person a chance.

I don't know what a broken nose is supposed to look like, three weeks after the fact.

My son threw a toy at my mom he was 2,she kept saying her nose felt broken. She never bled her eyes teared up and it hurt if it was touched. I took her to the ER and sure enough it was broken but they did not do anything for her,no bandage nothing but did give her pain killers.

I was really surprised they arrested GZ. I have not been on here much the last few days.My son told me how they had to shut down the police station in Sanford which IMO terrible, should have arrested everyone involved.Still MO that when he goes before a judge he might still be protected under SYG.IMO They only did this to quiet the masses. It will be interesting to see the actual evidence.
