You mean the Judge will allow KCs team to manipulate the truth by playing with pictures?
Because why alter the picture if not to change something?
I am lost on that last sentence.

The problem has nothing to do with having a secure server or knowing how to use it. The problem is they cannot use tools like photoshop to do things such as adjust brightness, change colors, markup, crop to alter the context or in other ways manipulate the images to suit their purpose.

Honestly it's a grey area. Normally I would see no issue with a defense team using such tools to take a closer look at evidence. But that is only valid as long as no photoshopped images are ever shown to a jury or presented as evidence. Does anyone here really imagine this crew could stick to those standards?

I counted five (5) spelling/punctuation errors in the one page document. I would also question referring to the Judge as "Stan" but I did not count it as an error.

Jose needs to find himself a decent legal secretary in additon to an IT person!

The writing is terrible! I cringe when I read the motions. I want to get out the virtual red pen...

BTW, if you look at the name plate on the judge's bench, it says "Judge Stan Strickland." I would assume that's the way he likes it and JB goes along with that.

Methinks Baez is about to become a term in the urban dictionary of slang meaning:

a) to delay unnecessarily in order to monetarily profit from a venture, or to file poorly written legal documents protesting and claiming injury or unfair treatment when said profits run out OR

b) to conduct business in a way which is counterintuitive to both expeditious productivity and/or the best interest of the client

Nope. They are not sworn in and do not take an oath.

I think he keeps pushing for that area because that is his old stompin ground. He knows people there. I find it curious that his request for COV does not ask for JAX, TPA, Pensacola. He is pushing for an area with a strong latin community. Early on, he planted the discrimination seed a number of times. He is hoping to have endeared himself as "one of them". Here's a solution......I think we ALL know this jury is likely to be sequestered. Perhaps, he could select his jurors from another area and "put them up". It would save the SOF a lot. I doubt that's even possible, but wouldn't that be nice. I doubt that a change of venue will be granted based upon the fact that he has been the one to do all the media appearances. Does he think that people in Miami don't watch the Today show, GMA, etc.... He fought AGAINST a gag order. You can't have it both ways. "JB....shut up, stop whining.....people will forget all about your "girl" and you will get your fair trial. Look, people have even stopped funding KC's snack binges. Her notoriety is already dwindling."

Not under oath, but almost all professional ethics codes, bar associations, and state/federal rules say when an attorney signs his name to a pleading or motion that he's attesting he has a reasonable belief to believe its true or after reasonable discovery it will lead to the resolution of the case.

There are penalties for being untruthful, and in civil cases you can even have sanctions against you for stretching the truth in pleadings.

The "unwritten" understanding is the lawyer has to tell the truth. I did some pro-bono criminal defense work for juveniles over the summer, and the head of the program at my firm told us to never ask the client if he's guilty. If you know from his mouth that he's guilty, you can't submit filings saying he's innocent. Your job is just to protect the client's rights, not prove they are innocent. It was a little unpleasant.

Perhaps this has been addressed? OK, so JB states that his "experts" are having difficulty accessing the photos due to a "technology deficit". I did a little looking. The IP associated with baezlawfirm.com is 64.14.72.84. It is not only showing up as a MA IP but it is also showing up as an IP from Bulgaria. The host server for his website is listed as : NS1.hoster907.com and NS2.hoster907.com. I would bet cash money that he is re-routing his IP and that because of that, he can not verify the security of images hosted on the server. I know from experience because my co. owned the server we used that you can monitor and route traffic as needed. HOWEVER, if he is using server / email masking, then he can't control content. KWIM? Thoughts????? Additionally, why would he need to re-route traffic and mask his IP??

It's kinda like he was waiting to see what they had, and then get the photos to his hired guns for them to start on their books. . . errr.. I mean reports. Except when he got the reports last week(?) and tried to actually use the system, something didn't work properly on one end or the other, and now he's whining. He should whine about not having some techies test drive that puppy and TRY to break it, and then it'd have been ready.
