2009.5.04 Change of Venue and tainting the Jury Pool

My feeling exactly. I have thought this from when he first said Miami. I lived there and it is nothing like Orlando. Tamp Tallahasse even the Panhandle is more like Orlando. I do believe the Judge will deny them and when and if they lose they will whine and cry that it was because they denied them. It is a win win filing for them. I hope the Judge come really down on them for not going with the gag order and the media coverage they have done. I hope he gives the defense a well deserved tongue lashing and then places a gag order.

And we git to witness it all. Right?

I am curious of the timing of this change of venue. Coincidence that Baez announces this past weekend that he will file on Monday, just hours after the Orlando Sentinel asks him for comment on the story they will be breaking about his "bad boy ways" on Sunday? I wonder if Baez wants the change of venue to get away from the negative local media attention on himself? Is he concerned that a potential jury in Orlando will have negative personal feelings for him as a defense attorney that will negatively impact Casey?

Is this change of venue more about HIM than HER??

Your probably right about his intentions but seems like it is to late for that. De bus, boss---de bus. He is so far under it that he can't see the wheels movin over his head.

I understand how the jury nullification thing worked in the OJ trial. So how is that going to work putting up a middle class Caucasian that accused a Hispanic woman of kidnapping and killing her child in front of a jury made up of mostly Hispanics. Shouldn't they be targeting a jury demographic of narcissistic 20something's who boink anything that moves and who only care about partying?

I think he also seems to be forgetting he's going to get twelve death-qualified jurors, not six 20somethings who love to party. No matter which county the trial is held in, I seriously doubt he'll get the jury he wants. MOO

Nope, haven't seen them yet. Can't wait to see Casey's affidavit either. Poor WFTV can't do anything right according to Jose and Casey. They upset Jose today because he was kind enough to hold his press conference at the top of the news hour but they chose not to run it and then Kathi Belich had the nerve to ask a hardball question. And according to her affidavit Casey didn't like when Kathi asked her "Did you kill Caylee?" when she got out of jail the first time IIRC. I wonder how Casey liked it that time when Kathi asked "Why are you strutting like that? lol."

Anytime anything happens with the Caylee case (i.e. docs released, change of venue motion, court hearing, etc) it is shown on the local news down in S FLA... not to mention that Miami has a large hispanic population and yet you are claiming that the person who took and killed precious Caylee is a hispanic woman named ZFG... hmmm.. I say keep it in Orlando.

I was thinking just that...don't they think the media will travel regardless of where they end up. LKB specifically stated this morning she had issue with the local (Orlando) media. So, they don't do road trips?

EXACTLY what I was thinking, UCF! IMO Baez vastly overestimates himself and his ability to use his ethnicity to his advantage. I say let them have their Miami trial - it will blow up in their faces and eliminate venue as a basis for Casey's future appeals.

I'm in Florida...Kathi Belich was on a little bit ago live, saying that he had filed the motion, and he was speaking with the press. Then my mom changed the channel, so I didn't hear what he had to say (probably a lot of nothing, anyway)

Kathi Belich is quickly becoming a favorite of mine. JB had his presser timed to begin right at the beginning of the early news. Kathy said no, we have something else on now so this segment will be held on our 6:00 show. He refused to talk much to her and now calls her a tabloid reporter because she asks the hard questions JB can't seem to answer. Anyway, she's my hero for not letting him lead out on the 5:00 news when that's all he wanted.

Oh, yes, and Kathi handles herself so well. Earlier in the year she asked Casey if she'd killed her child. Now she's asking him why, when he wants to change the venue for too much publicity why are he and Linda Baden out there making even more publicity. I think Kathi B. is my hero. Turned out there was an affidavit from Casey pinned to the motion and in that Casey stated that Kathi Belich is from a tabloid news show (right...local abc evening news. Kathy asks the hard questions so they don't like her much. LOLOL

Even though JB is Hispanic, his client is Caucasian and his client is blaming a Hispanic "nanny" for abducting and murdering her child. I don't think it will work at all. I also feel the jury would be insulted by this tactic. MOO

eta ~ I also believe the Judge may try to seat a jury in Orange Co. before ruling on this motion.

Considering the costs and logistics of moving a trial to another jurisdiction, I think judges will often try to seat a jury in the county where the crime occurred first, and if that becomes impossible, they will then consider a change of venue. I think the judge may decide this approach first.

According to the link below, the Casey Anthony defense team is planning on filing for a change of venue on Monday, May 4, 2009.

Usually, when a change of venue is requested it's to take the case to another jurisdiction in which the jury pool hasn't heard too much pre-trial publicity about the case.

It's my opinion that there's been so much publicity, not just in Orange County, but throughout the state of Florida and nationwide, that a change of venue won't find a jury pool that hasn't been exposed to detailed media reports of the case.

I believe a more experienced attorney would have pushed for a plea deal, Jose is in it for himself. Character is something you either have or you don't and, IMO, Jose doesn't have it.

That "Why are you struttig like that?" question was CLASSIC!

You know after all that has been exposed about JAB in the last two days I keep thinking of that question JAB asked Kathi a couple of weeks ago - you know the one "And where did you go to law school, Kathi?" JAB thought he was something - and so quick on the draw going back at Kathi like that. Don't you just know that even though it wasn't Kathi's media firm that exposed JAB - she's just loving all this info that has come out about him? As always, the laughs on him.

ORLANDO, Fla. -- Local 6 investigative reporter Tony Pipitone traveled the state of Florida to find out if Casey Anthony, whose attorneys on Monday filed a change of venue motion, could get an impartial jury outside of Orange County.

Pipitone went from Palm Beach to Miami and Fort Lauderdale before headking to Tampa and Jacksonville, showing people a picture of Anthony and asking them if they recognized her.

Anthony, 23, remains jailed on first-degree murder charges in the death of her daughter, Caylee, whose remains were discovered in December. Caylee was 2 years old when she was reported missing in July.

In Palm Beach County, which has a population of 1.3 million people, the first person Pipitone approached knew immediately who Anthony was.

An experienced Miami death penalty attorney said just knowing Anthony from a picture is not enough to keep someone off a jury unless the potential juror has an opinion about what she did and whether she's guilty of the crime.

Anthony's defense wants to have her trial somewhere where details about the case, like perhaps whether Caylee's body was in the trunk of Anthony's car, that may not be put into evidence are not in the juror's heads.

I can't understand if Baez sent a copy of his motion to many of the local media, why haven't they posted it yet? I mean it's been filed with the court now. So, why can't we see it?

Is he really wanting to change venue to Miami??? or is he just saying that to throw people off?
If he really thinks he has a chance in Miami, then he is nuts. I grew up in Miami and I am cuban and I'll tell you that for the most parts cubans are the most overprotective people when it comes to their children. Hope he knows not to pick a cuban to be in the jury, cuz then his goose is cooked.
Try Broward county, he's got a better chance here in Broward. Any way doesn't matter where he goes in every one knows the "31 days" there is no escape from that one!!
Oh I was just curious as to why he didn't choose Gainsville or Jacksonville? It's a college town and I would believe that there's not much coverage on Casey there.
