I would think if he were really interested in KC's defense he would have been back. He has not so it will be interesting to see if he does testify for the defense. I guess we will know shortly when the witness list comes out. Does anyone know if we will actually see a copy of the witness list? Dr. Lee also lists a fee of $12,500 for travel expense fees from Connecticut. That is for lectures and probably does not include a fee for doing the lecture.

That's what I was looking for....the actual (very short) defense witness list I thought Baez had previously filed with the court? Is there a link to that on this page and I am missing it?

Do you think that Baez sent Brad, so he would go over the talking points and spill more than Baez's we'll wait for the trial mantra? Hm the GR is interesting. I think they are forgetting that KC was told to not take visitors, she's the one that chose to see her parents that day. I'm 99.9% sure that video will be shown at her trial.

I think this was discussed in court and agreed upon the error of the filing and if memory serves me correct he kinda joked about we had to do all that to get to an understanding (paraphrasing from my memory only!) and thus I don't think we ever had a ruling but rather the document on page 3 was filed with the court.

Does that help?

I remember those clips vividly - my TV almost got tossed out the window I was so furious. Yes, he should have said that but his mission was to muddy the waters............reasonable doubt..........collect fee's and thank his buddy JB for the referral to his buddy G! (Obviously opinion!)

How will they deal with the timeline issue? Or did they just say they were going to deal with it. Should be interesting to hear their claims of why a mother with a missing child partied like it was 1999 :)!

There is no evidence that he wont come back pro bono. As a matter of fact, i believe that he has to testify for the Sa under the same pro bono. After he inspected the car (which was a very bold move by the defense), I believe he came back and inspected the body.

Seriously, what would he come back to look at?

notthatsmart, you know perfectly well from discussions on other threads that Lee never came back. Posting that is a very bold move on your part, my friend.

Am I reading that document correctly? The state requested the defense witness list a year ago and the defense only handed over the names of three witnesses. Is that all that has been handed over to date?

I have always suspected that Dr Lee never received payment for his first visit (and is probably still awaiting it) since it is during this same time frame that DC was hired, but shortly thereafter cancelled the contract due to non-payment (and filed complaint with BAR concerning such).

So looks like a money issue for me all around...

Dr. Lee, I`ve just got to ask you, you know, tot mom Casey Anthony was siphoning gasoline from her family`s car to fill up her own tank. How the heck are you getting paid? I`m sure you`re costing a pretty penny. Dr. Lee does not come cheap.

LEE: No, we did not get any pay for that and for -- I`ll say, you know, this country, as you know, everybody entitled a defense. And many forensic experts, we do pro bono cases and that`s our obligation to our profession. As an expert, we look at evidence, doesn`t matter inculpatory, exculpatory, we report (ph) as it is. I don`t think should be labeled as a defense expert going to just for defense. Many time, found more evidence, inculpatory evidence, than the police found. There -- you know, case history, case example, many time we`re allowed to work on the case together. Many of my cases, I let the defense expert observe. It`s nothing wrong.

LEE: Nothing unusual.

GRACE: Dr. Lee, are you telling me that you are working on the case pro bono, for free?

Not only that, but IRCC he took pictures of the scene from afar and the defense made a stink about wanting to be included before it was determined it was Caylee and the judge shot that down but ruled the state to notify the defense when they were done and the state did and turned the crime scene over to the defense and it was a no show, right? I think on a media appearance or two and maybe in one of their filings; they stated the reason they didn't do an investigation was the crime scene was destroyed. If memory serves me this was the basis of one of the motions to dismiss the case by the defense. It was always precarious to me that they didn't fully avail themselves to that opportunity. It was as if they walked up, said well this is ruined we can't find anything now and walked away. If I had been on that team, I would have combed the site as thoroughly as the state did. Sometimes actions speak louder than words in the media!

IMHO, etc...

Actually, when LE contacted the defense to tell them they were holding the scene for the defense, the defense said never mind without even going out there.

Months later, Baez decided he did want the defense to look at the scene after all. By then it had been released back to the property owner. The property owner wouldn't even answer Baez's attempt to contact him for access to the property, on which the owner had erected big fat new No Trespassing signs.

Baez went crying to Strickland with a motion for forced access to the property. It was a shining moment. :-)

Yuppers. They've gotten themselves in a major pickle. Richard Hornsby explains it well. Their goose is finely cooked.

ETA: Richard Hornsby:

...the problem an expert witness list creates for Baez is two-fold.

1. It requires your experts to finally give their opinion – and an opinion is no good unless is supports your theory. If their opinion does not support your theory, you don’t list them.

2. It allows the State to inquire into how they are getting paid, by whom, and financial arrangements they have made, and media rights they have negotiated, etc. And if the experts are doing this “pro bono” the State can then go into ulterior reasons they agreed to work on the case – books that are coming out, etc.

3. Finally, when the State deposes an expert (or any attorney deposes the other sides’ expert) the opponent has to pay the expert what the expert charges the hiring attorney. So if these experts are not charging Baez, they are not allowed to charge the State.

Basically the witness list opens Pandora’s Financial Box for Mr. Baez.

Well, I hope they do not try to contact Henry Lee, Ph.D. via the address given on THAT contact point...right university, totally WRONG city! Again, another perfect example of how Baez was performing his duties as the "first chair" on a wing and a prayer!

The defense team EXPECTED to be permitted to attend the autopsy...each and every minute detail as each and every fragment was culled from the dump site. The ME et al.'s decision: nope, no audience as we do not have an idenity for this victim and it would be a compromise to the dignity of this individual. (To which I say "WTG, Dr. Jan!").
Catch some of the TV still footage as of 12/13/09, one can clearly see Baez and Henry Lee at the burial site, OBSERVING and one would hope...documenting via their own specialists from afar BUT....when the site was officially released, they trashed the value of the site!
This group of "legal beagles" wants all kinds of "do-overs" and special gifts, the level of entitlement & expectation is phenemonal!:furious:
