I can grudgingly understand why the defense would want to be not that ingenuous in their approach to this, since they are trying to defend a client with so much evidence against her that stirring up doubt is all that is left to them, but I can't understand why people who aren't the defense would want to keep asking the same kinds of questions over and over and then refuse to comprehend and/or accept the answers. MOO

People might be the family or agents on their behalf. JMO :angel:

Nowhere in Baez's latest motion does it state that he at any time went to NeJame's office and when he gets there they didn't have it.
IF Baez went to view ALL the records(and I do not believe he did) and could not he would have stated so in his Motion, N'est-ce Pas?

Baez, who so adamantly wants those records, is granted access to them but never goes to view them. I believe marspiter has answered that quite well above...$$$


No one is stalling, No one is preventing Baez from viewing the docs, NeJame has them and they are available for viewing..

Wouldn't you think it would be cheaper to view them than to have them copies and sent to the defense? So if they can't pay to view them....how are they....oh, never mind.

I honestly think that there are some who are desperate to paint the Defense and their actions in a more credible, plausible and, heroic light because the Defense are doing so badly and grasping at straws .... so they are also grasping at straws.

It isn't an easy job at all, in fact it is very tough. You need someone to support the underdog right? -- throughout everything. Bad and worse.

I am not buying this. Pardon the pun. I see the Judge did indeed order the defense to pay for these expenses. How was the prosecutions expense paid?
I noted that Ldb tried to get the Judge to order the defense to pay for the prosecutions airplane tickets for the deposition of Jk. This is all new to me. I have never heard of such things. Can the Judge actually order Kc to pay for things up front when he knows she has no money? Obviously he can. He just did in that order. So we will execute Kc based on whats in her wallet rather than on the evidence. Well thats easy. We know the State has more money than the defense, so case closed.

What about these very important documents that Tes has that relates to the case? Like JJ's tes forms that he filled out about the crime scene as he states in his sworn document? Hey if the defense can't afford it, then the state needs to pay for it. Kc has a right to a fair trial. Thats my opinion.

The state paid millions so far seeking justice for the victim and towards KC's fair trial. Is there some reason the As can't or won't assist in paying to defend their innocent daughter? Most families do assist family that way.

Who said TES is stalling? That is so silly, Mark had a scheduling conflict. He gave the court a list of several dates that he can be available that are in the very near future. What in the world? Who said they were stalling?

Mr. Nejame stated in his interview that is in writing, in quotes and in full in a link on this thread, and on video........that the defense has NEVER came to ask to see the records, since the judge's ruling in August!! They have not asked for a date to depose Mr. Miller....again since the judge's ruling...in August. It is in post 9. Intermezzo was kind, and fast I might add, to find it for me this morning.

They didn't do so in September
or October
or November
or December
or January
and we are in the second week of February

There is no excuse for this. NONE. If they have the time, energy and enthusiasm to make national media appearances they could have made time to schedule a 1-2 day deposition of Mr. Miller, even on Andrea's limited Thursday and Friday time tables.

They are going to look so silly in court with this. I expect Mark to make a motion to strike, for these reasons and ask the judge to not even entertain this motion. The judge may have the hearing on the motion, to reiterate for the record his earlier ruling, as some of you have mentioned....Baez seems to need to hear things more than once before he gets them. I hope he will keep it short and in his words "Rule and Roll", and say..what's next....Mr. Baez , now let us discuss your deadline for the witness list.

They need to admit that Casey is indigent and get on with it.

So now it changes from the Judge's ruling that a representative be present and the defense is to pay for it to NeJame is charging to have a person watch over and its $300 an hour.

Have you read the Judge's Ruling?
I would be more than happy to provide the link again.

Better yet, my question to your question is "And just how did you come across this information?"

I don't see this as much as the Defense affording the money to pay .... it is all about wanting to pay and wanting to seek the court's assistance. They don't want to pay and they want help to review the records, like the tips/leads. It is not THAT important. Moo.

What price is KC's life worth to the Defense?, to the A's?, to KC? It isn't the cost. It is all relative. Moo.

Having said that, the Defense has succeeded in their goal.

The goal was to take the focus off the recent SA motion and the new evidence and materials from that investigation -- in that the Defense have succeeded in creating a different noise about TES and the searchers. Moo.

JK would be a defense witness who claims she will not come to Orlando to be deposed. I would think that if defense whats the deposition they would have to pay, not the taxpayers of Florida. Obviously you don't live in Orlando. Where do you find that the Judge knows KC has no money? The State is not defending her, she has her own attorneys. If KC is executed it will be because 12 jurors feel it is just punishment for killing her child not because of her wallet.

Would JJ's TES form reflect his search on Suburban Drive because he went there on his own? I don't remember seeing anything from TES regarding JJ reporting to Tim that he searched on Suburban. But you would know that already if you have been reading the posts in this thread. If KC can't afford her attorney then I believe the State will appoint another attorney for her. Until such time JB has to pay the required fees. When he had the money JB did not want to pay. Looks like KC may be at the end of another hallway.

Anyone know if KC can no longer pay her bills and now wants the State to start paying will she have to disclose how she was able to pay up to this point, but can not do so now??? Another question. If KC can't pay for her attorneys and they decide they no longer want to work pro bono then would the State pay all of her defense team when a Public Defender who is DP qualified could do the job without all the highly paid fluff (I can't make the hearing because I have a book signing and you'll have to move the trial to June because I have classes and finals in May)? JMO

Correct....BUT they cannot copy them, take notes from them, or anything of the sort.

The only thing they can do is if Baez feels that there are records of searchers that are of strong relevance to the case, they (Baez/MN) are to notify JS for consideration and if JS feels that particular searcher SHOULD have been included in the original 35, then Baez would get a copy of THAT record.....

But I don't think Baez wants to "see them"....me thinks Baez wants COPIES of all 4000+ searchers so he can turn them over to AL's investigator to see if they can possibly come up with someone else to throw under the bus as possible suspect....strictly for the sole purpose of deflecting attention away from SA, doc dumps, prosecution motions, etc....

Think RK....sure took the media and public's attention away from evidence against KC temporarily...

THink about the poor searcher who may have been previously married to a "Mrs Gonzales" who once babysat a 2 year old back in 2004, and who won the local "Decorate Your XMas Tree with Duct Tape" contest in 2007!

I think in order the Judge signed it states that defense has to pay up front. Of course that could be for the deposition. JMO

The Prosecution did not file the Motion, Baez did.,
The Prosecution is not requesting the Records from TES, Baez is.
No need to go steer the conversation to the Prosecution when this is a legal motion between Baez/Casey and NeJame/TES.

How does the Judge know Casey has no money? Did Casey/Defense submit a document showing Casey to be indigent?

The State has more money so because of that Casey will be executed.

Regarding the defense not wanting to pay.....please visit the AL thread as there is reference to this subject. One of the topics AL has discussed in articles, teachings, and lectures is that you do your best to wait until information you want is part of discovery and then ask for it.....By doing so....you get it without paying. Common practice.

I wonder if JB will take on the "World's first class action suit filed by an animal group"...... "hamsters will unite and argue against the unauthorized use of their image for the purpose of disparaging an attorney and cite the discrimination they suffer based upon their species of origin.

JB could even call in TM to argue that the hamster wheel is a flawed product that can cause bodily harm. They can recreate hamster injuries do to improper physical restraints within the wheel.


It will be one heck of a book deal with additional rights to an Animal Planet special / series / product line. Endless possibilities.
