2010.04.29 Motion to Seal Casey's Jail Logs. Why?

Listing to the motions the defense has left - one of the primary ones is Lyon(s) objecting to listing her experts or witnesses during the death penalty phase.

So I'd clearly say this is to protect who ever the heck she is going to bring in when they are discussing the death penalty, after a guilty verdict. Lyon(s) will probably need them to visit Casey to get an opinion out of them.

Just don't want their hand tipped.
 
That's exactly what I thought, because they definitely read the blogs and probably see us criticize how much time they haven't been spending with her lately..especially how little time Jose Garcia has spent with her!

Considering by KC's own admission in her own handwriting in letters written by KC...how she thinks JG is a hottie...yeah.

The thing is, and the reason I posted this thread to begin with, is that there is a ryhme and reason for everything the defense does. The motions they file aren't just spur of the moment. They have held close to the vest their experts (anyone recall a recent hearing with JS in which the defense didn't want to name their experts in the budget hearing to give away their defense?) and I have to wonder if one of those "experts" is a highly trained psychiatrist/psychologist...it would kinda of fall under the HIPPA law...but still, I am wondering if a particular expert has been employed by the defense to get KC to see the gravity of her legal sitch. I could be wrong...
 
Would the HIPPA law that protects us all have anything to do with sealing the logs, albeit too late? The Health Privacy Act says it's nobody's business what the state of our personal health is or who the health professionals we see are. Or even IF we see a health professional

If it was in reference to a physician of any kind to visit her it is not the fact that such saw her, but the actual information of the visit itself. I work for a Health Org in cardiology and became health information certified and there is soooo much to it! Unfortunately for the defense it doesn't apply here. :nono:

Yeppers. They most certainly do...and oddly enough have no problem quoting our posts (albeit snipped)...I have to wonder if the pile of evidence JB has is mostly us...our posts and links to sites that we give. JMO.

I have never worked in a county before that allowed motions to be filed via fax. Everyone I have ever worked in you had to file in person at the clerk's office or via their website. Frankly, filing via fax seems dangerous, to me. Too many things can go awry with fax machines and often, time stamps are very important.

Is it fax filing or electronic filing? In Cali we have been doing it for years. It is pretty safe but yes, errors can occur. Some courts in Cali only allow electronic filings for attorneys.

I think they want the log sealed so that whomever is visiting KC...the videos are not released.... if the visit is not attorney/client privilege....e.g. family visit as mentioned before.
 
Sorry that this is OT, but it is relevent.....

With the Sunshine Laws in Florida, it seems the defense has to file a lot of motions to keep things secret....wouldn't it be easier to repeal the Sunshine Law? It seems to inflame the public and taint the jury pool.....it would make this current motion a moot issue....or are we talking public info under the Freedom of Information Act that gives us access to this information?
 
How DO you view the visitor logs anyway? Is there a link for that or do you have to go in and look at them?

Not positive, but I think you have to go to the Orange County courthouse and request and pay for a copy. Just like the media does when discovery is released.

Wouldn't they be considered working on her defense not treated her per se?
 
But do all of you guys think there might be a bigger reason to keep said logs secret? Why hide something unless it matters in the stake of things? I can't think of any reason that they would want to keep the logs hidden, unless, it had to do with an expert. JMO

Also, btw, I am watching the Russia House...and my mom is a dead ringer for michelle pfeiffer ...literally. Even though my mom annoys me severely.
 
I want to see the vaca schedule so I can cross reference it with any defense training or cruises to Dreamland that are scheduled for that time.

NG always states that someone in jail/prison can have no expectation of privacy. Why do they think she is different?
