2010.05.13 ~ Werter speaks out ~ another plea?

  • #101
Funny, we have Ron's attorney saying the plea deal has nothing to do with the Haleigh case and Werter saying saying basically the plea deal is all about the Haleigh case, or should I say the cooperation in the Haleigh case......either way.

JMO - this is exactly why Werter released this tape on this day.

Ron goes to court with a plea deal in mind to save his backside, his only concern being himself.

Tommy goes to court with no plea deal about the drug charges but yet is willing to "assist" in discovering what happened to Haleigh.

Pretty stark contrast and definitely good PR. Werter is trying to force a plea deal for Tommy. I just can't belieive he believes every word out Tommy's mouth, apparently to this point, LE doesn't either.

ETA - I think Werter is quite miffed at Ron getting a plea deal but nothing yet for Tommy. Can't say I blame him.

Who ever is "involved" it seems apparent that many players know who, what, when..maybe even why it happened and yet they are pointing fingers at JO. The same person seen on videos hanging missing flyers with the very persons pointing the fingers.

So, my question is simple if JO is involved and they are so afraid of their lives then when safe in jail in stead of telling many versions and stories, tell the "truth" and demand protection or relocation for your families while they arrest the perp? IMO it isn't JO they are worried about.

Worse, Emma. If Haleigh's death occurred during the commission of a crime, it would be a felony murder, a capital crime. Tommy could face that charge even if was there only to steal a gun and had no participation in the murder.

Note to Kimster: That might be the deal Werter is going after. Knock the felony murder charge down to an accomplice charge. I can't see Werter doing all this grandstanding for the simple drug charge Tommy's facing.

yes, phew, and thanks bessie for finishing my thought properly. that Was my point lol! (I'm cutting corners everywhere these days. But still rootin' for Haleigh! :) )

I love it that we've all been here so long we can sometimes finish each other's thoughts!

IMO, there is an invisible link between the drug charges and the homicide case:

http://www.palatkadailynews.com/articles/2010/05/14/news/news01.txt

His attorney, James Werter, said he is “piggybacking” with the Misty Croslin case, since the two require the same witnesses. He also said he sought a plea deal.

“The state, so far, has not agreed to negotiate,” Werter said.

One would think the SA would be willing to help Tommy out, if they believed his story about Haleigh that is. If Werter is honest in this statement that the state is not talking to him, the SA is either waiting for lab results or they simply do not find anything believable in Tommy's "confessions".

Yes, JW sought a plea deal on ToC's drug charges, but he made it clear that the state so far has not agreed to negotiate. Yet, IMO, JW worked hard yesterday to get across that ToC had no part in the commission of the homicide, and has been cooperative in that investigation since April.

To me, he seemed to tie in ToC's cooperation with a desire for a plea deal in the drug case. But the SA isn't biting, at least not yet. Agree with you - either SA is waiting for the lab results, or they do not believe ToC's version.

JW may be a great defense attorney and well, a great defense attorney is what ToC needs. JW, appeared to me, in the incomplete video tape interview available yesterday, to have begun to lay out ToC's defense or, perhaps, ToC's version is true - and JW believes him, and wants ToC's reputation cleared. I'm still on the fence re JW.

Did anyone else read this little snippet from Nancy grace's page?
http://nancygrace.blogs.cnn.com/2010...-james-werter/

snip~The missing 5-year-old, vanished from her trailer in February 2009. According to Werter, Tommy Croslin says he and his cousin, Joe Overstreet, visited the home where Haleigh Cummings lived with her father Ronald Cummins and his then girlfriend, Misty Croslin, the night Haleigh Cummings went missing. Werter says Overstreet wanted to borrow an automatic rifle at the home to go deer hunting and that Overstreet became irate when he learned the gun was not there. “Things happened from there,” Werter said, explaining Croslin, Jr. went into the trailer bedroom to find Overstreet in a rage and Haleigh Cummings no longer alive. ~ end

ETA NOW THE PAGE SAYS....YOU ARE LOOKING FOR SOMETHING THAT ISN'T HERE. SHEESH STORY OF MY LIFE....lol

There is a ring of truth there.

I'm having some difficulty separating a great defense attorney doing his job for his client, and the information I have gleaned from the biographies available on JW, which portray an individual of integrity and character. I want to believe JW re ToC's version, but not gonna just yet.

Perhaps, from the entire interview in JW's office? Complete tape of JW interview available anywhere? Maybe just me, but he's laying out either ToC's defense or he buys it.

I have heard this automatic rifle mentioned before. If they are really saying it is an automatic rifle then it was stolen from someone. You have to have a very special license to own one of them.

What a mess. I can believe JO was involved, but I can't believe Tommy's only involvement was at the wrong end of a gun, not after all this time, and not after Misty made accusations against JO a long time ago.

There is photographic evidence of Misty calmly hanging up missing flyers right there with JO the very next day, FGS, how 'askeered' of him could these people really be?

Tommy lived right by Ron and Misty. JO was gone when Ron got home, so what was stopping them, being so innocent in all this, from telling Ron what happened as soon as he got there? IMO, Ron, at least in the heat of the moment, would have gone after JO immediately, thereby, one way or another, removing whatever threat they felt they were under.

IMO, from what I have heard from the tape and now from Tommy's attorney, Tommy, Misty, and JO were probably all three equally involved, and now Tommy, IMO, is trying to get the blame off of him and onto someone else. In his story, where was Misty in all this? She told LE she slept through the whole thing. Uh huh. Then there is Jr., sleeping in Ron's room. Is JO really going to be searching for a gun and not look in Ron's room? Then kill Haleigh right there in Ron's room, and not only did Misty sleep through all this commotion, but so did Jr.?

IMHO, Tommy needs to work on this story, because to me it is a big steaming pile of poo.

ETA: I forgot to mention, if this story is true, they then let 'child-killer' JO go on back to Timmy's and Chelsea's house like nothing had ever happened? Did they bother to give Timmy and Chelsea a head's up about the person staying in their home? Puh-lease.

I call BS on this story, & only a fool would believe it.

Lanie, like your post. I don't think I could ever believe Tommy at this point. All of these players lie, lie, lie.

yeah, it may be WHAT happened, but Tommy is missing a few truths. If this happened, then Tommy was an outright accomplice. He had to have been in the room with Joe. nothing else makes sense. We know that Tommy is a gun thief & he may have been outraged also. but, I'm having a hard time connecting the dots between gun, outrage, & Haleigh's death. There has to be more to it. like a sexual assault.

  • #118
Didn't Tommy steal a gun AFTER Haleigh went missing? Maybe he did that wanting protection for himself and his family? Joe was already back in TN so who would he need protection from....Ron!

  • #119
So now Tommy, Joe, and Misty were not going to steal the gun and sell it? And then why put the gun in the "culbert" ??? Is this the gun held on Tommy & Misty to get rid of the body? Too many stories that do not jive - and with Ron's temper, He didn't shoot anybody or all of them? So, Joe molested and killed Haleigh right there in the bedroom because he couldn't borrow (steal) a gun? If LE is buying any of this, why isn't Joe locked up?

  • #120
"Gun" seems to be a recurring theme since day one of Haleigh gone missing. One gun or another keeps going missing or being stolen or fought about, right up until Ron according to Tim M. put the gun in his mouth right in front of Jr. Oh wait there was the gun Charles Jones said was pointed at him during the road rage.

If what Werter is saying is true, and if Haleigh has gone uncared for and unprotected for the last 15 months because everyone was hiding the fact that there was a gun there , that shouldn't have been in that home, I swear I will lose my mind. A child's life is gone..... and everyone hid the facts of what happened over a gun? Where is this gun? In the St. John's River?

According to Werter it had to do with an automatic rifle? To go hunting? No IMO it has to do with one person stealing the gun from another and I just don't know who did/or was committing the theft.
