2010.05.13 ~ Werter speaks out ~ another plea?

  • #121
If what Werter is saying is true, and if Haleigh has gone uncared for and unprotected for the last 15 months because everyone was hiding the fact that there was a gun there , that shouldn't have been in that home, I swear I will lose my mind. A child's life is gone..... and everyone hid the facts of what happened over a gun? Where is this gun? In the St. John's River?
(snipped)

My opinion of the Shell Harbor search was that they were looking for a gun. I also believe the earlier search on the bridge (that LE claimed was not re Haleigh) was in fact about Haleigh's case and that they were searching for a gun.

I think there was an illegal gun in RC's possession, and possibly that gun had been used in a crime prior to Haleigh going missing--perhaps quite a while prior. IMO, RC might have feared LE finding the gun and tying him to the crime. Plus, I have had a theory of Haleigh being taken as an act of revenge/retaliation for something possibly involving the gun...can't go into it here and still stay on topic, but to me the gun is a piece to the puzzle. JMO.

Is this the same gun rc used in front of TM? Jo alledgedly stole a gun from rc on the first day they met. I got the impression that was a berreta. Now we are talking about another large gun?!!

Didn't Tommy steal a gun AFTER Haleigh went missing? Maybe he did that wanting protection for himself and his family? Joe was already back in TN so who would he need protection from....Ron!
I think that was an antique of some kind , & probably stolen for reasons besides protection. Actually, Tommy didn't strike me as being much scared of anybody. His only fear seemed to be of the truth coming out. On the jail tapes, he seemed consumed with everybody keeping their mouths shut about Haleigh. Now, if he had a story to tell, why wait til now? because he's in jail & wants out? because he was worried that someone else would talk 1st & implicate him? Why did Linsey file for divorce? He told his Gmaw that Linsey had previously heard the story. Really? Why didn't she tell it to LE? What has she heard or figured out since then, that made her go from standing by her man to divorcing him? surely not the same story that obviously didn't bother her before. Somebody gave that girl a heads up. I wonder what it was...a certain failed LDT question, maybe? Linsey knows the walls are closing in on Tommy, & got out while the gettin was good. If she had heard that story, & kept quiet, she could be charged with something. My guess is that she doesn't want to get dragged down with the rest of them, & is cooperating with LE.

"Gun" seems to be a recurring theme since day one of Haleigh gone missing. One gun or another keeps going missing or being stolen or fought about, right up until Ron according to Tim M. put the gun in his mouth right in front of Jr. Oh wait there was the gun Charles Jones said was pointed at him during the road rage.

If what Werter is saying is true, and if Haleigh has gone uncared for and unprotected for the last 15 months because everyone was hiding the fact that there was a gun there , that shouldn't have been in that home, I swear I will lose my mind. According to Werter it had to do with an automatic rifle? To go hunting? No IMO it has to do with one person stealing the gun from another and I just don't know who did/or was committing the theft.

Yes...gun is definitely a recurring theme.

Am I the only one that remembers Tommy stating that Misty kept a gun under her pillow? This was said in one of the earlier jail tapes. Anyone else remember that?

Atty: Tommy Croslin: Haleigh Cummings died in trailer

Posted: 08:04 PM ET

Tommy Croslin’s attorney drops a bombshell- he claims his client now says Haleigh Cummings died in the trailer.

http://nancygrace.blogs.cnn.com/2010/05/13/atty-tommy-croslin-haleigh-cummings-died-in-trailer/

The following three posts, along with others, were made here at Websleuths in this thread between 8:04 pm 5/13/2010 and 10:00 am 5/14/2010:

Just an FYI but Tommy's Lawyer is also claiming that Haleigh died in the trailer.

One question.. Is/was the dwelling located at 130 Magnolia occupied by the Croslins on February 9, 2009 referred to as a trailer? JMO

In the strict context of what Werter said, 130 Magnolia is even more so a "trailer". Trailers like the one at 202 Green are more often than not referred to as "doublewides".

From Ger's pictures:

The "Bombshell" has changed for some reason as of this morning, wonder why, LOL?:

Tommy Croslin claims Haleigh Cummings died in her own home, according to his attorney James Werter

Shoot Fire Miz Nancee, you might change a few more “Bombshell” headlines if you would read at Websleuths a bit more often.

I just noticed that too when I tried to go back to the page.

I don't have the link, but do recall this as well. I remember thinking that if Misty slept with a gun under her pillow that would indicate to me that she knows how to use it and would use it for protection. So, if the story about Joe were true, she would of shot him you would think. JMO though. This girl has serious issues, I am beginning to wonder if she believes her own lies. To many to keep up with for me. :loser:

I would think he meant Haleigh died in her home, her trailer. Because that is the trailer people are going to think of when they hear the word trailer.

The general public and maybe even Werter do not have any idea that others lived in mobile homes.

BTW, can you tell that I grew up around mobile homes. You learn very quickly not to call someone's home a trailer.

BBM RED.The general public has been mislead from the beginning in reference to most of what has been stated on tv..We have only been given bits and pieces... But IMHO.... People will be thinking wrong if they think he is talking about the MH at 202 Green Lane.....I also suspect Wherter knows exactly what trailer he is talking about and where it is located.....JMO

IMO, there is an invisible link between the drug charges and the homicide case:

http://www.palatkadailynews.com/articles/2010/05/14/news/news01.txt

His attorney, James Werter, said he is “piggybacking” with the Misty Croslin case, since the two require the same witnesses. He also said he sought a plea deal.

“The state, so far, has not agreed to negotiate,” Werter said.

The state has not agreed to negotiate on the drug charges. If they are not negotiating with Tommy, IMO they are not negotiating with Ron.

Has Werter ever stated that he is now representing Tommy in Haleigh's case? Werter had said previously said that he does not represent Tommy in Haleigh's case. The only way for Werter to be involved with Tommy in Haleigh's case but not be representing Tommy is if Tommy does not need representation.

IMO, Werter had been talking but we have not heard. I believe Tommy has immunity in Haleigh's case for his full cooperation. Therefore, Tommy does not need "representation in Haleigh's case. The sentence that Tommy is looking at in the drug case is in line with the sentence Tommy would receive for disposing a body. So by giving him immunity for Haleigh, they knew they could still get him to serve about the same jail time with the drugs charges. But without Tommy in the Haleigh case, they have no chance for justice for Haleigh. Werter is upset because he did not negotiate the drug case with Haleigh's case and realizes the DA out played him.

Again, this is just my opinion of what litlte Werter has said.

Werter hasn't given up the whole story yet, so all we can do is speculate. But, I feel the story going something like this: Tommy arrives on the scene after the attack. The wild-eyed maniac thrusts a gun in his face and threatens to kill him and then go after his wife and children if he doesn't cooperate. It's too late to help Haleigh, so he has no choice but to cooperate. The perp holds the gun on him and orders him to carry Haleigh's body to the car then drive to Shell Harbor. Once at the dock, with the gun still pointed at him, he follows the instructions to tie the cinderblocks to the little body, and so on and so on. IF Werter can present a reasonable argument, I'd be inclined to excuse Tommy. But without conclusive evidence and a credible eyewitness -- in other words, anyone but Misty -- that story will never hold water.

If this is what happened, why didn't Misty call the police as soon as Joe and Tommy left? Tommy's life could have been in danger in this scenerio. At the very least you would think she would call Ron or her parents for help. This just isn't making sense to me.

Because Joe took her phone. That's why she didn't answer the 20-90 calls from Ron. But like I said, his story will never hold water.

If Joe took her phone, which phone did she try to call Ron when he was pulling in the driveway?

Excellent point, Donjeta. If, theoretically, he did take her phone, why didn't she go to a neighbor's house to dial 911? I would have been running up and down the street, screaming for someone to help me. In an emergency situation, you find a phone.

Didn't y'all get a kick out of Werter on JVM last night? Lecturing me on how the state of TN is not China. I live in TN, I know where it is at.

Joe drove to TN. His mode of transportation of getting there was via vehicle. I would estimate that if someone is driving from Nashville --to Satsuma it would take about 12 or more hours to get there.

Tommy is not scared of someone who is 12 hours away from him. Give me a freakin break.

I also don't like his attitude. He makes it sound like everyone living in the South are like the Croslin family. If I'm not mistaken the Croslin family moved to Florida FROM UP NORTH.

He makes it sound like the South is a different world from the United States. The state of Florida is full of people like Werter and others who move down there and then complain and make elitist remarks.

He really pisses me off. Sorry for the rant. LOL

This thread is as good as any to post this on - I was wanting to reread articles from the past week. There were so many, fast and furious. Many already say Oops, not available. Was the reporting that poorly written? Just in cast we have another week like this past one, be sure and put everything pertinent in your post - Videos seem to last a little longer. FWIW

It's interesting to see that Werter is saying TC and JO went to the MH that night to borrow a gun.

The original version was that they were there to steal a gun--that was what Misty had written in a letter. Misty said they came to steal the gun but the gun was not there so JO took Haleigh instead. And GHollars said she had been told that story about stealing the gun as well.

But now Werter has very conveniently offered that JO and TC went the the MH to borrow the gun. No mention of going there to steal anything!

Could it be because when someone is killed during the commission of a crime all persons involved in the crime could be charged with felony murder?

I am suspicious of the attempt to steal the gun story, and equally suspicious of the attempt to borrow the gun storry. But it seems obvious that Werter does not want anyone thinking TC went to the MH with the intent of committing any crime. This is likely why the story has now changed from an intent to steal to an attempt to borrow. This "borrow" version is designed to save Tommy from any possible felony murder charge.

I liked Werter the first time I saw him speak publicly. But I don't care for him anymore. I know he has to protect his client's interests but for crying out loud there is an innocent 5-year-old enmeshed in all the lies, and it disgusts me that attorneys will twist facts to protect the rights of those who WITHHELD information while giving no thought whatsoever to Haleigh's rights.

I was facetiously suggesting Werter's possible reply. Sorry. I should've been clearer. I agree with the rest of you. It's ludicrous. Sooner or later, someone is going to ask him that question, and I can't wait to hear his response.

After Jo raped and murdered Haleigh, he gave it back to her to call Ron. LOL

BS...all of it
