here comes the motion for prior rulings
first up: Compelling the tape of JJ
 
CM---at issue is that inmate was incarcerated and could not have placed remains there at that time. JJ was found by CM's investigators and said he'd searched the specific area and remains were not there at the time of the search and area was not under water as claimed by other witnesses.
 
Well not the best hearing so far..lol
pretty boring..I don't think they are going to win this (defense) bc it would cause too many problems for the county jail
 
Based on the motion to seal visitor logs I'd assume that the Defense want to send in psych experts to explore KC's state of mind and see if a viable defense can be used on those grounds -- as a mitigator.

Yep, I think they want to send in a whole psych team and maybe even Dr Phil! :dance:
 
come on perry do your research before the hearing.

you look as unprepared as the defense when you have to wait on a ruling.

Question: If judge Perry decides that Casey Anthony's due process rights are violated by public records being ... well... public.. doesn't that give every other inmate who has been convicted an appeal issue? If Casey Anthony's constitutional right to due process is violated by the public release of jail visitor logs, then all other inmates' right to due process was violated also IMO.

I think its ridiculous to say that just because there is a significant amount of media attention that her rights are being violated, or that she deserves special protection. If her rights to a fair trial are in ANY way impeded by the media circus, well then she should stop an think about who created said media circus. If she had told the truth, or confessed, or cooperated with law enforcement none of us would be watching this right now. She made her bed. Time to lie in it I suppose.
 
CM wants this tape recording because the man's voice itself may be compelling--when was he telling truth and when not

He indicated that he'll rule against it given the fact that he's "already done his research and can find nothing to substantiate the Motion."

OMG did the defense actually just ADMIT that? WHOA! I guess no more she's innocent, just wait til the trial!
 
CM needs to come to court more prepared. Review cases you are going to cite BEFORE you get to court.....geewhiz.
 
Mason saying later statements by JJ sound like they may have differed from the original statements. They'd like therefore to hear the recording.

If the body was moved there later, although it would not necessarily mean that the defendant could not have killed Caylee, it could mean she didn't, or that another party was involved, it does create a body of reasonable doubt that they need to know more about

Describing another case in which a victim made a surreptitious recording.... the judge is asking for the outcome of that case, Mr. Mason checking it
