Prosecution: 94 other capitol inmates in the jail, so can't give KC special treatment.
Orange County must follow the law. KC is held by Orange County Corrections. No provision for what defense is requesting.

Who is speaking for prosecution? Jeff Ashton? I hope so...

GO LADY!!! (sorry don't know her name):woohoo:

InSession just said wait nevermind George Anthony is not there..only Cindy Anthony and NO show for Casey Anthony. The judge didn't want any issues they think there is some GOOD reason that she is not there, they are speculating she is sick.
Maybe she didn't have a good enough shirt to wear

I think KC & her lawyers know this Judge isn't going to buy into any b/s, so I am sure KC is either really sick & it's been documented by a jail nurse or she became very very upset & had to be medicated when her lawyers talked to her about what was going to be discussed today. I don' t think her lawyers would just let her play hooky.

What's the gadget that Baez is writing on? He just reminds me of taking my 8yo son somewhere - I give him lots of paper and things to keep him busy!! I'm sorry but Baez is so out of his league and it shows. I have no sound (no speakers at work) so I can't comment on much more.

Waiver could be used later by KC to say, "But my attorney didn't let me go to hearings."
Hopefully Perry took care of this at the sidebar. Apparently CA might not have known that KC was not coming to court, either.

Maybe they'll play her the tape later with some popcorn and bon-bons:waitasec:

Anything going on? This thread is slower than usual...

Your opinion is clear, I'll just leave it at that :) LOL

I would just point out that she has no prior record, I'm not aware of George and Cindy covering up any felonies..... :waitasec:

Actually she is a convicted felon for the check fraud charges. Where she plead guilty.

Perry asks CM to respond:
Under doctrine of separation of powers, judicial branch can't interfere with executive branch of gov. absent a statutory right. What statutory right is violated by list of visitors being public.

CM: right to fair trial

Exactly! Don't treat her any better nor any worse than any other inmate being held for a capitol offense.

Deja vu.. I remember this exact argument from.. well, one of the 20 other times the defense has tried to get special priveleges for their client. As if she's the only person in the facility that's been accused of a capital crime :boohoo:

Perry: Did you site 119.011(3)c5ab6(v)12?
CM: affirms and corrects

I guess our super speed typist is missing today, lol. Either that or CM is boring the court to death, not surprising...

  • #137
I don't think the Judge is going to rule in the defense favor.

Prosecution: 6th amendment right to counsel is met by her right to see her counsel. The jail allowing contact with other visitors is giving her more than the 6th amendment allows. No statutory violations. Her due process rights are not violated.
