A bit OT, but here in Louisville (KY) we have "Keep Louisville Weird" bumper stickers as well.

It's a campaign to encourage people to frequent locally owned businesses rather than large chains.

Just wanted to say welcome neighbor, I am just across the bridge from you....

Kaine, Desiree and Tony Young called before grand jury

Last Update: 12:10 pm

Tony Young, Desiree Young and Kaine Horman appeared before a Multnomah County grand jury for the first time Monday, less than a week after Terri Horman’s friend, DeDe Spicher, briefly appeared.

Wonder why they were called to testify? Could be about Kyron?

But I could also see a Grand Jury to find out who the LE leak is that seems to be giving the parents all this detailed information. LE does not usually give that type of detail to anyone even family. LE is usually concerned about "protecting" the investigation by keeping things out of the public domain.

Subpoena Issued To Another Friend Of Terri Horman
POSTED: 12:37 pm PDT August 3, 2010

KPTV

Another friend of Terri Horman has been subpoenaed to testify before a grand jury this week as the investigation into 7-year-old Kyron Horman's disappearance reached its 61st day.

The woman, who identified herself as a close friend to Terri Horman, said she will appear in court Thursday. She spoke to Terri Horman on the day Kyron disappeared from Skyline School, but at the time they spoke, the friend was not aware that Kyron was missing, she said.

So that makes Dede, this woman, and Kaine (3) definite, and Desiree and Tony (2) possible, as subpoenaed so far, right?

I think it was the Oregonian said Kaine confirmed he had testified. Happy pull the link if anyone wants it - just holler.

ETA: Here it is:

Chief deputy district attorneys Norm Frink and Rod Underhill declined comment when asked whether Kyron's parents and stepdad were testifying before a grand jury. However, Kaine Horman confirmed the grand jury appearance.

Well, here's another:

Kaine Horman told KGW that he appeared before the grand jury in the Multnomah County Courthouse but he did not elaborate on whether he testified. He was seen exiting the courthouse with Kyron's mother, Desiree Young and her husband, Tony Young on Tuesday afternoon. However, Kaine did not say whether the other two appeared before the grand jury as well.

Guess we would want to know what time she spoke to Terri....

I don't like the way this article is written to suggest this was one of the cell-phone producing friends, but it's really not clear.

Why are people who are subpeoned telling anyone about it, isn't it supposed to be secret?

  • #988
the proceeding itself is secret... however... if you are subpoenaed you can talk about it after the fact if you want to believe it or not.

I noticed that Kaine is only saying he appeared, not that he testified. This new woman is saying she was subpoenaed only. Maybe you can say if you're subpoenaed?

Dede didn't say a word - it was her attorney who said, e.g., that she wasn't asked any questions, but that was about what the prosecutor said (or rather didn't say), vs something Dede said.

I don't know. I'm not clear on it.

I think we need a grand jury mechanics/sop thread... would that be possible as a stickie? There is already a lot of good info on both the original dds grand jury threads and the lawyer thread. would be happy to help bring them together in one place

"She spoke to Terri Horman on the day Kyron disappeared from Skyline School, but at the time they spoke, the friend was not aware that Kyron was missing, she said."

Hmmm. What's that supposed to mean? That TH was aware of poor Kyron being missing and didn't mention it to her friend? I hate this cryptic reporting.

I know. I was just pondering that myself. I wish we at least knew approx what time they spoke. If it was 6 or 8 in the evening, and Terri didn't say anything about Kyron missing, it would mean something different than if it was 1:30 or 2 in the afternoon.

How long has the GJ been meeting on this case? Interesting that they have had days and days of testimony (or in the case of DDS - non-testimony)

All I am clear on BeanE is that you cannot say a word about your testimony or appearance due to the secrecy of the GJ.
I am really surprised to hear this woman tell anyone she was subpoenaed. :waitasec:
I bet we do not hear a peep once she has appeared.

Have they? I thought they met only on Mondays.

I added a question about what people can say to the Legal Questions thread:

On another site, (sorry) someone stated as fact that if Terri were to be required to appear before the GJ and testify and she invoked her 5th amendment right that she would then be charged with NOT COOPERATING and would face jail time and fines.

Anyone?? know if there is one single case out there where someone said "I'll plead the 5th" and they were charged with it?

Also, if the GJ doesn't hand down an indictment or finds the no evidence (can't think of the term) can they meet again and again until they find a charge? Or is this a one time deal?

Thank you so much to who ever answers this, I do Google but I find myself lost in all the information. I have no Grand Jury experience.

Well, here's another example where "other sites" aren't too keen on the facts.

1. See Thoughtfox's post #292 on this thread (page 12) which explains why suspects are not called to appear before the grand jury: compelling them to testify confers immunity. Grand juries are supposed to be investigative, in that they ask questions for the purposes of determining whether to indict suspects. Thus, witnesses are called to give testimony that shows whether or not there is enough to indict.

2. People appearing before a GJ can decline to testify--whether or not they
are invoking their 5th amendment right to avoid self-incrimination. Declining to answer questions (testify) can lead to civil contempt charges and possible jail time for contempt.

Grand jury rules are different from the rules of criminal trials. Anyone can take the 5th amendment in a criminal trial without penalty. There are a number of posts about grand juries and how they work higher in this thread.

the parents have said that comments they have made to the media have been what they heard/observe from Terri herself other than their own personal observations.

the sexts, and other information that has been in court documents were directly related to the safety of another human being, namely Kaine and his daughter pertaining to the restraining order.

I highly doubt the DA has subpoenaed two friends of terri moulton horman, 200 documents, KH and DY to find out about "leaks" to the media... but that is just my opinion:twocents:
