2010.07.26 Grand Jury begins

Didn't want to start yet another thread about the GJ, but BeanE posted this today in the news section. (Thanks BeanE.)

PORTLAND, Ore. -- Sources tell KGW that the grand jury in the Kyron Horman case met Monday, interviewing representatives from the Multnomah County Sheriff's Office and other law enforcement officials.

Sources said the interviews would likely continue through Tuesday and possibly Wednesday.

I find that very, very interesting.

I am not at all sure what this could even mean. "Interviewing representatives from the MCSO and other LE officials?"

When I sat on the GJ, we were given testimony of any LE right after being briefed on the case by the prosecutor. LE would tell us what the encountered at the scene, etc. Then the prosecutor would go on to call other witnesses, that mostly corroborated LE's account, or not. This is really interesting that they are now "interviewing" LE. Does anyone know if LE was called earlier on? Is this a re-eval?

Maybe they are explaining all this business about the cell phones they were supposedly looking for in the recent searches.

It could be strategy to bring the strongest witnesses in late. It might make a powerful impact on the GJ where so many other witnesses have provided testimony. Now the investigative information is toward the end and fresh in their minds. :cow:

Easily explained. It's just a rumor.

Another rumor courtesy of Bruce McCain who has nothing to do with the investigation.

"It looks like Dede's opening up," attorney Bruce McCain, a former captain of the Multnomah County, Oregon Sheriff's Dept., told "Early Show" co-anchor Monday. " ... This is not a search-and-rescue. This is a forensic search for criminal evidence, more than likely, something very specific that Dede told them about. It could even very well be one of these untraceable cell phones."

That makes sense, but weren't Desiree and Kaine towards the beginning? I'd think they'd have some pretty important testimony. It would be interesting to look at the order in which the people testified.

This GJ has been described as an "investigative grand jury" which may make it different. I haven't studied up on the differences, but Oregon is a state where a GH indictment is *not* required in order to prosecute.

http://www.cga.ct.gov/2000/rpt/olr/htm/2000-r-0330.htm

That could explain the use of 'interviewing' and why people are being called in an unusual order.
It was always my understanding that this GH was not hearing a "We've got ABC, is it enough to indict" sort of case, but that it was being used to investigate, and compel people to testify. Right now, I'm not concerned if the GJ doesn't indict someone for something.

It may not be the first time LE officials testify in the GJ room. I thought that they might be there explaining the results of the latest set of questionnaires. Didn't they get circulated after the GJ started?

Can they be called to testify about what Terri did or did not say to them directly? Her timeline etc.? I know the Investigator who was assigned to sit with the family those first few days has been called. Can he comment on her behavior too? Could go in the Lawyer thread I guess.

Desiree and Kaine – Kyron’s Biological Parents
Tony Young – Desiree’s Husband / Medford Police Detective
Chelsea Aleshire – Friend of Terri’s that spoke to her June 4th
Andrea Leckey – Saw and spoke with Terri at an area Fred Meyer’s store June 4th
Capt. Mike Shults – Stayed with the family for days after disappearance
Rudy Sanchez – The Landscaper involved in the Murder-For-Hire Plot
Kristina Porter – Kyron’s Teacher
Ben Keefer – Principal at Skyline Elementary School
9 Year Old boy from Kyron’s school
Dede Spicher – Terri’s Friend, cannot account for part of her day June 4th
Three Friends of Terri’s from her gym

Kyron grand jury could continue for months
Last Update: 3:12 pm

A Multnomah County grand jury investigating the disappearance of Kyron Horman could continue for months, according to information from the presiding judge.

KGW has learned that Judge Jean Kerr Maurer issued an order from August 20th through October 29th restricting any audio or visual recording of witnesses coming or going from the grand jury room. Maurer had issued a similar order in early August but it had since expired.

I read the above article today...looks like an arrest is not pending. Also read in another article on KPTV.com that LE may hold another press conference this week, but no specifics as to date. It was in an article about Skyline opening this week to talk to parents, etc...

That makes me both happy and sad at the same time. :(

UGH. I'm hoping the judge had to do a new order since the old one expired, and just extended the time in case it's needed, not because it's actually needed. Because otherwise, how depressing!

I wonder how airtight Dede's timeline/ story is. Did anyone actually see HER working, or just her car? I am thinking Terri could have picked her up on the way to school. Told Kyron they were going to play a game called "hooky:", they would tour the fair then come back to the truck and the 4 of them would go have some fun. Afterall, Kyron would be leaving for Desirees and Tonys that day, so as a kind of send-off. But, it had to be kept secret.
So he had to lay down on the backseat while Terri went into FM, so he wouldn;t be seen.
After all that ridiculous FM business, thats when Terri did her bad deed, and DeDe helped her with it. Then Terri returned Dee to work, and Terri returned home, posted on FB......

I'm not sure what you mean by "suspends itself." In Multnomah County, grand juries are empaneled for a one month term and during that term, the DA basically controls their work flow. If the DA already had all the evidence he needed to try someone, we'd have an indictment. Instead, it's safe to assume that they are still trying to build a case and they are bringing whatever witnesses they have before the grand jury to get the testimony on the record before memories fade or stories change. That process could continue on and off indefinitely. If and when the evidence adds up to a triable case, the DA will present the necessary evidence and transcripts (which will likely be only a small fraction of the testimony actually taken before previous grand juries) to whatever grand jury is seated at the time and obtain an indictment. That could be a month from now, a year, 5 years, or never.
I posted this in the questions for Lawyers thread.

:banghead:

It would appear the wheels of justice are at a stand still. To believe that IMO would be deceiving.

Where are you angel?

Oh you scared me for a minute when I saw this thread. I thought maybe the GJ was done permanantly. I know we've discussed a bit here and there about why they've suspended themselves but I believe they are waiting for the civil proceedings before hearing more on the criminal side since the two are intertwined. Kaine's action to drop the contempt charge and try and move up the divorce makes me believe this is true.

Did I read on the other thread something about an October cutoff for the GJ??? Have to go back and review and see what that's about...anyone know?

That was me, and I was mistaken (sorry!). This is what I remembered:
