Will JB get approval for additional hours of investigative services?

I wanted to pick both #2 and #3. The State has added several witnesses to their list since the budget was set for this case, so I can see Baez getting more investigator hours. However, not to the amount that Baez is asking for. Baez is going to need to put in more of his own time on this case.

300 hours is 7 and a half weeks of work? (40hr weeks) What can an Investigator possibly need to look at that needs that amount of hours?

I think he'll get the 300 hours so that any appellate issues can be negated.

I think so, too. I don't think HHJP will take the chance that she doesn't get a fair trial because "death is different".

I think in the end JB will get his requested hours. I don't think he should but he will.

HHJP will give JB a stern talking to and JB will smirk and assure him they are nearly complete with a lovely chart Ross Perot would be proud of. JB's explanation will be something like... Wah, wah,....(insert peanuts teacher's voice here).

HHJP keeps swaying like a tree in the wind when it comes to JB and dead lines, money, ect. and JB is going to keep blowing his hot air until HHJP breaks and crashes down on him.

So I guess I'm sitting on the fence between answer 1 and 3. It all depends on how bad that old oak is starting to crack.

I predict that JB will have to submit to a thorough review/accounting of ALL "dinero". My snarkier side predicts that (following an accounts review) the Honorable Chief Judge Perry will give Jose "the look" (furrowed brow, unhappy glance over eye glasses, concerned grimace....you know what I'm talking about!)...and send him on his way. Emptyhanded, that is! :razz:

It is going to be a toss up between these two concepts. How much does the defense reasonably need to avoid an appelate issue, VS how much have other capital defendants recieved from the state. How much has the state paid in the past and what are viewed as reasonable defenses. The JAC will not care a wit about KC's special circumstances or all of the travel needed. To their eyes this is a local crime committed in FL and should cost the same as other local crimes. If they raise what they pay her than they must do the same for every other DP defendant. In this case "fair" means she is treated like everyone else, and she gets what everyone else gets.

I think there is a good chance that the JAC and HHJP will roll the appellate dice on this one, so long as they can provide adequate documentation as to what expenses normally are in these cases.

It is a sticky wicket , but the JAC doesn't want this case setting a precedent on funding . Other defense attorneys will expect the same, and the state simply can't afford it.
This will be very interesting to watch. Very difficult decision for JP. I do hope consideration is given to the initial money JB brokered and spent,as well as the time frame. It's now been well over 2 years.
I wonder if the complaints made about JL's investigation techniques will bear in JP's mind ?

If KC's defense is allowed EVEN MORE money for EVEN MORE hours of investigation, can others on death row come back and claim they deserve a new trial because they were not allowed extra funds ? I mean , this could completely undermine the JAC budget. When the money runs out, it's gone. States run on a budget. They don't have unlimited sources .Judge Perry's hands may be tied on this one.Fingers crossed !

Well what I believe is that JB is having the investigator do most of his own work for him. I work for an attorney and he does most of his investigation on his own. Why is JB, CM, and the paralegals in both their office who is on their payroll not going out and interviewing some of the people, what exactly are they doing all day.

I am hoping that Judge Perry says something along these lines to him, "Mr. Baez you may have to go out do some of this interviewing and investigating yourself because I am not approving this many added hours." Oh I can dream right!!!

I voted no more money. JAC either has limits on spending or it doesn't.
This implied threat of Baez- 'Give us what we demand or it will give us grounds for appeal' will not wash.

I agree!!! enough worrying about an appeal. If they tried for one the appeals court would no doubt (imo) look at it the same way we do. He had enough money to do it right in the beginning.I am sick of he moaning about money while lining his pockets! I've no doubt the people of FLA. feel the same way.

IIRC, the motion asked that they be allowed to appear by phone. Sorry.

They probably don't have enough money left to send someone after Baez hosed them the first time.

Judge Mission: To keep the case on track within reasonable bounds (time and money) and ensure a May 2011 trial with no appeals (asis reasonable). The scales of justice

Defense Mission: To drag the case out as long as they can and exhaust any and all avenues and funds in the search for a Defense for ICA ... this can go on forever because typically the job is never done and is called to a halt by a trial deadline

JAC Mission: To be fair to ALL accused indigents, if HHJP accomodates this Defense it sets a precedent for others -- so they need to set limits else costs will go out of control and others will suffer = no money

There is a risk that if HHJP allows another 300 hours then what is to stop the Defense coming back for more -- he needs to establish something fair as well as set ground rules to preclude abuse. The Defense knew what they had and chose not to work within that -- gambling they can just get more

I do sense that as a result of AL joining and ICA being handed down a DP threat that part of the Defense strategy is to make the State pay ... literally for the DP charge and milk it to the max. Payback games

Judgment of Solomon: To send a message I'd assume that JB will not get all of the money requested but will also come under even greater scrutiny

I know what I want HHJP and the JAC to do and that is just say NO - you were given fair warning.

But what do I think will happen? I don't know - I keep reading what other posters are saying and I'm just can't get a grasp on which way I think HHJP will lean. He has already given JB far more leeway than I ever expected him to do. If he really is His Honor Judge Hardazz Belvin - I'd like to see him in action. Because all we've seen to date is "Bear In Mind" with JB completely ignoring him. :croc:

My real question :waitasec: regarding the investigative hours already spent on the TES records is what did they really find? We've seen no public media smirking, which is unusual - so dare I guess the answer is nada, and those hours were in fact throw-away hours spent - much to-do about nothing? :furious:

1. Does HHJP buy into these claims that the Defense has found over 100 searchers that were on Suburban?

2. Is HHJP willing to fund this Defense prolonged 'fishing expedition' into these TES searchers?

3. Will the recent allegation of witness tampering factor into the decision (is JAC simply funding more tampering)?

4. Does HHJP continue to allow the Defense more rope to hang themselves or does he call them onto the carpet?
