2010.10.29 Status Hearing

AND...am I mistaken or somewhere in one of JB's whining sessions, did he mumble something about "an impeachable offense"????? JP just cut him off?

I know it was denied...but JB's motion was incorrect in that it only talked about the log records, not the recordings themselves. The way I understood it was that if JB were to go back and refile on the grounds of the actual recordings, that would hold with the new ruling in this precedent case that just came out.

Hope that didn't sound snarky....did not mean it to. I'm just confused.

I think the issue, TotallyObsessed, which had me confused is after they discussed it back and forth and forth some more, HHJP said the Bent Decision is NOT "complete or formalized" so he was reverting back to his original ruling - which was NO!! LOL - is was still NO when Baez came back and said is "denied really denied" just kidding - but it felt like that.

So no worries about why you aren't sure. I had to go back and watch that bit. I think the point HHJP was also trying to make is even is Bent becomes law, it still means only personal telephone calls the perp makes.

What are they going to tell her in Ohio. From birth to age 3 she played nicely with her dolls.

Seems to me that she'd be going up there to ask about Casey's parents; how they raised her and if they could conjure up any abuse allegations to add to Casey's claims. I don't think they care a whit about what kind of child Casey was. . . moo

I'm thinking Finnell wants to go to Ohio to look into Cindy & George and the way they were as parents to Casey more than what Casey was like as a child. As in, did Cindy/George do something to her to "damage" her way back then...

Gotta love HHJP :)

If Finnell can't get people to talk to her on the phone and she beats on the door does she expect to hear something she can actually use to defend KC? If these people she's trying to contact had anything to offer the defense, they would have called Baez by now!!

I took his answer to mean- No they would never say that because they would be DEAD fing wrong. And they should know me better than to make a statement like that.

I didn't take it as a slap to LDB but more to Mason.

Oh, I didn't think of it like that... you are probably right. I'm just so paranoid about everything the defense has gotten away with....

I feel better now... thanks!

For the first time ever in all the hearings, i got the feeling that casey has finally been made to see the reality of this all. Mom and dad cant save you. Your dream team has jumped ship because the evidence is irrefutable. The new lawyers must have given casey a dose of some kind of reality because they are talking penalty phase. ica's reaction to the whole, whats a copy? fiasco with baez, was priceless. She knows now that this judge has seen all the money and the skeletons and has heard all the excuses and lies and does not think that her or her defense team is very cute. This judges biggest interest is justice for the life that was taken too soon, not ensuring ica's rights are met on her every whim. That was made painfully aware to her today and shes starting to crack. Baez has done this all for himself and he is dangerously close to being ridiculously incompetent. I hope he is not the reason this trial gets an appeal, because at this point, it seems the only way an appeal would be effective.

I don't think you are corret TotallyObsessed - my impression was only personal telephone calls - on an actual telephone, not the ones used at the jail, screen to screen.

I thought the motion was denied.... so KC can have personal phone calls with her parents and the calls not be released?

Now I am confused..... :waitasec:

That's a great point ... although if they are not willing to cooperate by phone then I don't see that changing by being there. I'd be even more intimidated and un-willing to get involved if they turned up at my door in my town.

The catch is, even if they offer anything by phone they can get called upon so ... it is likely even if they have observations they'd want to keep out of it.

motion was denied to revisit the previous motion...

the case Baez was citing is narrow and only applies to personal phone calls... not all the other 🤬🤬🤬🤬 he was trying to cram into it.

Come in Tokyo.....Mr. Mason...the defense has known about these documents for a very long time that you alleged to the judge were being kept from you. WTH? Since February, for the love of God!

NO - sorry I got that going - I left out a bit - IF Bent becomes law - it only covers personal phone calls, not the rest of the things like mail, visitation, commissary, etc., that Baez has tried to get.

But Bent hasn't become a precedent yet - I'm not sure what this stage is called but it's not an in-stone law. I guess that means it will be appealed.

HHJP reverted back to his earlier decision which was No, No, and Definitely Not and it's final.

Everything stays the same as now, all released. Judge Perry said the Baez could file a new motion specifically about the phone calls and nothing else as that is what pertained to "Bent". His motion was denied today because in usual Baez fashion he took a scorched earth approach and wanted everything not to be released. That's how I understood it.

I guess there is not anyone out there that is wanting to take the fall for ICA, even people from Ohio. They are treading on thin ice with all the harassment of people on their "witness list". They might want to rethink that strategy and move on to something else.

welll hmmmmm... i have not a clue what happened. would anyone recap plz? i dont have tv at the moment.. just the internet.. is it online anywhere?

TIA

Ha! Best hearing ever! Gotta watch this one again 'cause I kept getting kicked off.

It was great.
Judge Perry played Judge, lawyer, professor, hall monitor.
It was something else. lol
