Y said the incident began when she and her friend noticed Zahra crying as she walked up a steep hill behind her house.

“She was making Zahra walk up the hill by herself because that’s how she would punish her because she (Elisa) knew it would hurt Zahra’s leg,” Y said.

Baker came out of her trailer and started screaming and threatening the girls.

“She said, ‘I’m going to teach these two teenagers a lesson and whip their butts,’” Y said.

Baker continued to shout threats until H’s mother came out of the house and asked what was going on and Baker left, according to the arrest warrant.
Y said she spoke to Zahra a few times and saw that she was a very sweet girl. She also said people in the neighborhood knew Baker was abusive to Zahra and they tried to get law enforcement involved.

“You could hear Zahra screaming and Elisa yelling at her, so we would call the police,” Y said. “We called DSS (the Caldwell County Department of Social Services) on her too, but they never did anything.”

Adam and Elisa Baker were arrested for communicating threats against their family members too.

They were arrested on May 22, 2010 and charged with communicating threats against Elisa’s niece Brittany Bentley, her fiancé Zackery Tyler and the couple’s 7-month-old daughter. The threats stemmed from an outstanding debt Bentley owed them, according to the arrest warrant.

“He (Adam Baker) chased me and my fiancée. He literally tried to run us off the road twice,” wrote Tyler in the complaint accompanying the warrant. “He got in the opposite lane, swerved at the driver’s side and we had to swerve to keep from getting hit, then he passed us and slammed his brakes. We had to slam our brakes and still almost hit him.”

The couple went home and gave Baker the money she was owed, but she demanded more. She and Adam threatened the couple with Tasers, according to the arrest warrant.

“They said they would kill me and Brittany Bentley and that they knew where our daughter was and they would kill her if I didn’t pay her,” Tyler wrote.

Bentley’s complaint is similar but provides additional detail.

“Then she went to my mom’s where my daughter was with a supposed gun after she threatened to kill my daughter,” Brittany wrote. “I fear for mine and my daughter’s and fiance’s life.”

The Bakers were charged with communicating threats as a result of the incident. Adam was also charged with assault with a deadly weapon for allegedly trying to run the couple off the road.

Extending it keeps him here I guess. IDK. Maybe they decided to put off those charges because bigger ones are coming? eh, I can hope.

Look on the bright side, it keeps AB in the US for an extended stay without having to rush to charge him with anything else. He can't go anywhere as long as at least these charges are pending against him and he has not answered to them or cleared himself of them as of yet. Dragging them out is not to his benefit really.

I hadn't thought of that. He does have a history of failure to appear, but I'm pretty sure LE isn't letting him out of their sight for one second, so...yeah, I guess this is a plus. Especially if there was a chance the felony charge might not stick.

Well it does appear that BB was there and ready to testify, in fact I suppose she did. Interesting that she claims the threat was made by AB. Do we know what exactly the threat was? Not the various stories she's related to the media but on the actual legal documents.

I seriously doubt there was any testimony - one the press would be reporting what was said and two - pretty plain the lawyers requested coninuances and they were granted, no need to testify.

Yea teh - this continuance was a no brainer. The investigation is still on-going and labs are working overtime. Everyone is just sitting tight until LE is ready to charge.

I really wanted to know how either was going to respond to the charges and to the testimony of BB, especially AB.

It can't look good when your daughter has been found murdered and your in court defending yourself from threatening people with a taser and running them off the road in your big fat car for drug money. Will he blame that on people misunderstanding him too?

I was also interested in seeing just how how disheveled poor EB looked this time. After all she did miss Halloween. How did her Dark Heart cope?

I don't think that was the reason their lawyers asked for this. Certainly they don't want to give LE more time to build a case against their clients. I do think that they don't want fresh convictions on AB or EB's records going into the trial. Casey Anthony got convicted on several counts of check fraud (14? 16?) and her trial doesn't start until next year. It doesn't look good to have convictions going into a trial. I don't know about EB, I think she already has a record, but I don't think AB does yet? At least for him, they're trying to keep his record as clean as possible. And they don't want to add anymore to Elesa's record. Neither wants convictions for acts that were filled with violence and rage on their client's records before going into a trial for killing and dismembering a child. Or they don't want those convictions there before pleaing out either (if there's no trial). In fact, they might deal on this - let go of small charges and they'll take a plea on the larger ones or something like that. I bet on January 27th, they ask for another continuance if the murder investigation/case is still going on at that time, which it probably will.

Now the judge was probably thinking to give LE more time, so yeah, that reasoning fits there.

This may be a little O/T.....But do any of the locals know when the Grand Jury is scheduled to meet again?

IIRC they have to be the ones to offically bring charges against EB or AB.

I have read that it is the first Monday of each month. I do think a special session can be called before that date if needed. It is that way in a few states that I know of.

ETA: It was that way when I served on the Grand Jury for then entire month of August. We met one time other than the regular scheduled time.

Adam Baker, the biological father of Zahra, already had a lawyer, but that attorney had a conflict in the case, so on Thursday he was appointed a different one for these allegations.

I wonder what the conflict was? I'm really curious about this...

Absolutely no idea and I suspect we won't hear what the conflict is. Could be several things.
